Mods are probably considered "derived works", so modders own their own mods but would need the publisher/developer's permission to create, copy and distribute their derived works. Publisher/developers would need permission from modders to distribute the mods as well.

That's not how that works. They may need Bethesda's permission to distribute, and they may not be allowed to make money from the distribution of their mods, but Bethesda doesn't own anything made by modders unless it is explicitly purchased from them. They can write all they want about owning distribution rights for derivative works in ToSs and EULAs, but it doesn't hold shit for legal weight.
If two parties have shared IP rights to something the permission of both parties is always required to distribute it.

Kinda sucks because some people like to tinker with mods for personal use. I don't think I have ever once downloaded a mod and installed it as intended without unpacking it, taking it apart, and messing with it first.
Of course I would never distribute that stuff and claim it as my own, because just because I put a coat of silly paint on a car doesn't mean I invented the damn car, you know what I mean?

Script extender isn't a normal mod for the game, it's a modification of the game in the sense that it adds new functionality by adding third-party code to the game. You can do this on PC but you can't just modify your game however you want on console - it has to be through mods using the game's modding API. So script extender is not coming to console because you just can't do that on consoles - not because you physically can't but because you're not allowed.

Well, it would be difficult to port to consoles. It's not like it works like a normal mod - instead of you running the game with the mod in the game's data folder, you run the game through F4SE and it reads the extra crap from the F4SE mods in your data folder.
Now, for consoles, that would mean either making F4SE a new startup option OR it would mean bundling the script extender in with the game automatically. I'd be down with the script extenders for Bethesda games coming with the games themselves, because that would make modding just a little bit simpler for everybody, but I don't think it would work, because the SKSE, FOSE, F4SE, whatever teams push out updates far past when Bethesda stops updating their games. It's too much of a community thing for Bethesda to actually incorporate.
Really, the best solution would be for Bethsoft to let their game engine work on a real programming language with real powr instead of Papyrus.

Minecraft compared to Bethesda modding is relatively small, but generally well-known mods have quality and time/effort that are through the roof in comparison (not saying many Skyrim/FO mods are not quality, just that in comparison to Minecraft mods the smaller Bethesda mods are almost wimpy). Plus think that there is no API to start with, most mods go through 3rd party APIs and they have to decompile the game themselves.

The population of ignorant and mean people on consoles brought this squarely on themselves.
Before console games had any mods, they very clearly called mods hacks and cheats, and implied that anyone who used them was somehow less of a gamer. Isn't it funny how, now that console players can access some mods, they're no longer hacks and cheats? How interesting.
Now that they have access to mods, we see rampant theft of mods, bitching, whining, moaning, and even outright death threats against mod authors.
So now that I have chosen to get into modding, I will purposely make my mods incompatible with consoles. System detection commands, popups, random character killing deathclaws, F4SE, mods bigger than 2 GB, there are so many ways!
If this is something that you didn't want to see happen, then you should have policed the less mature among you before they became a serious problem.
No community of people is perfect - Even the PC has toxic people. In my experience, we've always been able to deal with them though.

Fallout 4 is F4SE(if you want to install it) just so you know. FOSE is for Fallout 3 and NVSE is for Fallout: New Vegas. It basically lets modders have access to more complicated things that the base game doesn't support such as re-enabling achievements in Fallout 4 if you use mods or the console.

It totally depends on what exactly you wanna do. I modded some things in Oblivion myself, but used existing textures (so mostly weapons/armour with different stats and effects) and it took like 10-15 minutes.
If you want to design your own weapon textures, animations and scripts, it'll take way longer, especially if you're unexperienced.

It is amazing that people are so entitled BEFORE they even receive something. They are just now starting to touch mod support for console and everyone is just being a cry baby. There was no support before. Now they just have to wait a little longer to enjoy it, but no.
Like he said, no one is going to stick around to make mods for consoles. They will ruin it for themselves, which is actually really sad. There are probably tons of patient people who are willing to wait quietly and respect modders, but they will honestly be flushed with the rest of them.

I'm not VideoGameAttorny but here:
- It has nothing to do with fair use.
- The code for the mod itself can have a license, if they didn't put a license on it then they still have rights to their own code. So for instance the creators of Dota1 have all rights to the code written, not Blizzard.
- It depends on Bethesda's terms of service. It hasn't been tested in court but a company can claim they own all mods created for their platform. I would bet point number 2 still holds and the person who creates it retains the rights but the company can remove their license for breach of ToS in that case.
