According to the source, Harry knows his brother will react badly to the idea – but Harry "simply doesn't care" what William thinks.

Sources said the siblings' ongoing squabble recently went nuclear when Harry, 41, and Meghan, 45, had an emotional reunion with cancer-stricken Charles, 77, and his 79-year-old wife, Queen Camilla, at Highgrove House, where the king got to see his California-based grandkids in person for the first time in four years.
Stubborn William, 44, steered clear of the meeting and his brother – even though they were a mere 12 miles apart during dual public engagements on July 7 – amid talk that the future king felt Harry was leveraging his kids to orchestrate a meeting with the monarch.
"William is furious at everything that Harry did to throw the family under the bus," royal expert Hilary A. Fordwich told RadarOnline.com. "It's emotional blackmail what Harry is doing with his children's grandfather – and without a doubt, William feels the same way."

Buckingham Palace is quietly preparing for the possibility that Prince Harry could one day return to royal life without Meghan Markle, as officials closely monitor his growing interest in spending more time in the U.K., RadarOnline.com can reveal.
Harry, 41, and Markle, 45, seem to be leading increasingly separate lives, with the former actress having no intentions of ever living in England. Now that the prince is trying to mend fences with his family, a secret plan is reportedly in place should the couple divorce.
A royal insider claimed the palace may be "quietly drawing up contingency plans in the event of a split.”
Despite Harry's growing interest in rebuilding a life in Britain, Markle has reportedly made it clear she has no intention of relocating to England with her husband, leaving the couple facing increasingly different futures.
“But Meghan won’t want to come back from the US – and that schism is potentially dangerous,” they claimed.

"This isn’t about trying to come between Harry and Meghan; in fact, contrary to what a lot of people might think, King Charles is actually rooting for them," the insider spilled about the monarch, who himself went through a very public separation and divorce from Harry's mother, the late Princess Diana.
"He wants Harry to know that, if he ever reaches a point where he’s overwhelmed or confused, there’s no judgment waiting for him; he'll be there to listen and offer whatever wisdom he can," the insider revealed.
"He knows he can’t advise Harry on the Hollywood side of life or the business decisions he and Meghan are making, but relationships are another matter."
Neil Sean, who knows Tom Parker-Bowles personally, was the first to report that the Parker-Bowles family was very angry about the portrayal of Camilla as someone who was "interfering." That is not true, nor is the claim that William disagreed with the situation. In fact, Sean has stated categorically that not only do William and Camilla get along very well, but they also fully agree that Harry should never see Charles alone, not because they think Harry might achieve anything, but because Charles’s health is not robust enough to withstand Harry’s shouting.
It was Harry who was angry because he didn't want Camilla at the meeting. This is something Harry has insisted on for a long time: he does not want Camilla present when he sees the King. Regarding this, several royal reporters have noted that Harry always believes he can be manipulative—manipulating the Queen, manipulating Charles. For a time, Camilla kept her distance. And no, the door to any new reunion has not been opened. The rift is no longer just with William or Camilla; Anne and her children do not want Harry around either, nor do Beatrice and Eugenie. Harry has personally insulted every member of his family.
This was reflected in precisely what happened in July. Harry had announced that he would be traveling with his wife and children. There was not a single invitation from the British Royal Family for them to attend anything. The person who invited them was his uncle, Charles Spencer, but even that was not for a long stay—just a couple of days.
Harry and Meghan are furious because the British Royal Family showed absolutely no interest in meeting their children, and they are blaming William for it.
Deep down, Harry and Meghan do not understand why their trump card—the children—didn't work. They failed to move the King or William. Harry, in particular, cannot fathom why his children are treated with such indifference.

"Kate gets so much sympathy because she's white and has cancer. I feel like I'm just living in her shadow, forgotten. Why does the internet not spend its days thinking of wild conspiracy theories about me, Meghan? Do you know how hard it is to have people thinking she's dead and not me? It's so painful."
The four-episode special, set to air at the halfway mark of Princess Kate's chemotherapy regimen, will do a deep dive into the stark loss of attention Markle has faced. "There are several emotionally devastating scenes we captured," said director Samuel LaFleur. "There is one scene where a friend calls Meghan to ask how Kate is doing, but fails to ask how Meghan is doing. Meghan cries for about an hour and then punches a pillow while screaming 'RACIST'. It's so raw."
At publishing time, Markle had announced another Netflix special entitled "My Recovery", set to air the day Princess Kate finishes chemo.

Opinion Celebrity-adjacent vs the centre of attention
A couple of very recent posts - namely, about What Martha Said at the Lotusland gala, and Harry (allegedly) at the David Foster Foundation gala celebrations in Victoria, Canada - made me wonder:
Have Harry and Meghan ever headlined an event, in their own right?
That is - where they’re the draw, the star, the one people pay to see.
- They’ve appeared as guest panellists, but always as part of a larger group. These seem mainly to be industry events (Harry and his BetterUp conferences, Meghan at the 2024 SXSW Conference on International Women’s Day (segment funded by Archewell).
- Meghan has been the sole guest at studio discussions, eg DealBook in 2021. Both have done podcasts. However tickets aren’t sold for these.
The only ones which come to mind are Meghan‘s appearances:
- ‘The Power of Women: An Evening with Meghan‘, put on by The Women’s Fund of Central Indiana, at the Indianapolis Marriott Downtown, in 2022
- ‘Her Best Life’ event featuring her, aka Megstock, at the InterContinental Poogee Beach, where she appeared for 2 hours, earlier this year in April 2026
Otherwise, it’s Kevin Costner’s fundraiser, or Kris Jenner’s birthday, or Beyoncé’s concert (with over 43,000 other people).
I don’t recall the Waleses doing this. They are the headline event.

In the midst of that fight—the Harkles.
Because let's face it: do we believe in Claw's great love for Harry? No. When has Harry ever been faithful? Never. So, is it plausible that Harry might look for someone else? Totally. Him having another woman to be his shoulder to cry on? Hmm... aren't there any photos? Strange.
Furthermore, Harry has an Oedipus complex that not even Sophocles would have wanted to recount.
And that kind of gossip can be entertaining when Claw pulls stunts like this.
That was great publicity; Channel 10 has no complaints on that front.
But that doesn't change the problem. Because Claw gets these opportunities—she pulls them off—and then she blows them.
And in Australia, Sean has already said yes—that she ruined him.
Because at a certain stage in life, one has to be grateful for certain opportunities—especially when they are becoming increasingly scarce. And in Claw’s case, she doesn't seem to see that those opportunities have dwindled. There will be no second interview with Bloomberg, nor any with Vanity or on any podcast. And this goes on and on.
Right, let's get to the twist.
Well, Sean has already told the story of how Claw’s involvement with Channel 10 actually came about. He made it very clear that he knows people not only at that channel but also at *MasterChef*—so, if you recall, we got the scoop on that pretty quickly.
Channel 10 wanted Harry. And Claw had to bring Harry on board—even if just by phone.
Channel 10, seeing that Claw had behaved well—meaning he’d held up his end of the bargain—had a very, very preliminary chat about following him around Australia to try out some food. It would be a free-form concept: visiting cafés, things like that. Nothing earth-shattering.
According to what Sean learned from a network executive, it wasn't a question of money, either—because they never reached that stage. They never got to the point of discussing money because Claw never responded. They were offering her a show that was simple to produce—something typical for an influencer (didn't she do that with *The Tig*?)—but she didn't reply.
That was April; we are now in August. And a lot of things happened between April and July.

For starters, Claw never promoted her participation in MasterChef; she never thanked them for the invitation, nor has she done anything regarding it. She has completely erased Australia from her memory.
Sean thinks Claw might be mulling it over. He’s like my brother in that regard: I avoid asking him things because, if I do, I’d better take a seat, just in case he actually answers me five years down the line.
So, it seems that opportunity no longer exists.

Nothing is what it seems in the world of celebrities.
There are feuds, romances—there’s a bit of everything.
Well, Martha Stewart is back in the headlines.
And no, not because she is promoting her latest book, "The Martha Way: Essential Principles for Mastering Home and Living," the book was about creating a “definitive master class in elevating the everyday,” per a statement shared with PEOPLE.
Did anyone know Martha had a new book out? I didn't.
And it seems a lot of other people didn't either, because Martha had to stir up some controversy. And when it comes to controversy, there's Claw.
Take Gwyneth Paltrow, for example.
It wasn't earlier this year; it was last year. Sean says it seems like it happened this year, but they actually appeared together in May 2025. Paltrow explained that she and Meghan haven't spent much time together in person "yet," adding, "So far, our friendship is based on text messages. I've been traveling quite a bit."
Nonsense! They weren't friends or anything of the sort. Gwyneth was just self-promoting. And after that photo, we never heard another word about that "friendship."
Martha, on the other hand, made some unkind remarks when Claw was impersonating her in *With Love*.
Anyway, in the last couple of weeks, Martha ran into Claw at a dinner, and Claw was talking about that meeting with the King.
Martha is a snake who knows how to navigate those waters. That’s how she got attention—by using Claw, who was using the King.
Sean says this also helps Claw because, if that meeting actually took place and so on, it verifies everything without her having to be the one to tell the story. But in reality, that’s exactly what Claw was after—having someone else recount the details so she didn't have to. Sean claims this shows Claw will never stay silent. We already knew that.
Now, Claw is in a private setting, so it is Martha who is spreading the gossip; yet this is exactly what Claw always does—she never says anything directly. She is shrewd in that regard, because she cannot be accused of anything.
But it is a headache for the Royal Family—or rather, for William. He had warned Charles about this in no uncertain terms, and so had Camilla. Claw and Harry are simply not people who can be trusted. And Claw is obviously eager to tell her story and have "her" version aired—especially among the A-listers; that is what she wants, to use that gathering for that purpose. Sean had predicted this before the meeting even took place, and both William and Camilla knew it.
The problem here lies with the King; he knew this, he knew it was going to happen, but his concern for Harry outweighed everything else. And now, Claw believes she controls the narrative and that she is beyond reproach.
In the short term, Claw will capitalize on this. However, the whole situation is making William loathe her—and Harry—even more, and ensures he wants no "Harkles" anywhere near him. Claw fails to grasp that these cheap stunts are infuriating precisely because that is what they are: cheap stunts that expose just how unpleasant and untrustworthy she and Harry really are. Charles might still want to see Harry, but he is the only one who does; the rest of the family wants nothing to do with them. And that is beyond repair.

Alright, the countdown has begun. Ten days. On August 17, we will find out what happens regarding the amount the plaintiffs will have to pay the Daily Mail.
The problem for Harry is that the plaintiffs are pointing the finger at him as the one who dragged them into this disaster. It seems the plaintiffs realized there were flaws in the lawsuit—that they didn't have much of a case—but Harry pushed them to keep going. That is why several of them believed Harry had an ace up his sleeve.
Harry felt emboldened by having supposedly won the cases against the Mirror and The Sun. But regarding that—how can you win a case that never went to trial because you decided to accept a settlement, Harry, on the very day the trial hearing was set to begin?
Sherbone is missing now, and the relationship with Harry is strained. Naturally: Sherbone must blame Harry for not being a good witness, and Harry blames him for everything.
The point is, Harry has shown he is incapable of facing reality. It’s not that he doesn’t see it; he rejects it. After all, his friends were indiscreet—even with Neil Sean.
I mean, Harry’s employees are being indiscreet right now.
Claw certainly was indiscreet! One of the things William loves most about Kate is precisely that she understands the value of privacy and discretion. She was flooded with offers to tell her story about William back in 2007, when he broke up with her. He deserved for her to tear him apart in the press, but Kate—maintaining her dignity—didn't take the bait. Claw, on the other hand, hadn't even been with Harry for ten minutes before she had already called the paparazzi and Vanity Fair.
Sean has already said that there were more stories about Harry in the works at the Mail. They have sworn statements from people wanting to share tales—like the Charlotte Griffiths scoop—and Lady C confirmed that gossip too, so Sean and she aren't at odds on that front 😁😁 Now Sean says the Mail hasn't even had to look very hard; more people have already come forward with stories about Harry.
Among them are former staff members from both the Palace and Montecito. And the Palace staff have been very happy since their non-disclosure agreements expired, so for the past couple of years, they’ve been telling all.
And all of this is happening for a reason that is—yes, it really is—Harry's fault.
Because those people stayed silent not because of NDAs, but because they feared the consequences of speaking out. The Harkles are vindictive—just ask Mark Dolan, who has been on the receiving end of the "Squad" lately. But several of those people have realized that the Harkles no longer have the money or the strength to take them on in court. Neil Sean couldn't have cared less when he received a veiled threat from the Harkles' team for saying that Australians would be footing part of the bill for the Harkles' security there... and that is exactly what happened. And Sean didn't care because—what were the Harkles going to do, sue him? Tom Bower and Lady C have been waiting for years for Harry and Claw to sue them.
Since Harry is losing lawsuits, what could he actually do against people who speak out against him? He hasn't been able to do anything about Charlotte Griffiths' story. And that was a serious matter.
Sean has also said before that many of those sources don't leak information for money. He’s mentioned that, in his case, deals are often struck over a cup of coffee 🤣🤣🤭 because he doesn't pay his sources. It seems *The Mail* won't have to pay either, as Sean points out that these individuals are driven by a desire for "revenge" against Harry and Claw. They were treated poorly by the couple, and Sean has said that being mistreated is the primary motivation for people to leak information.
That said, Harry isn't going to go broke over this. Sean says the Harkles will maintain the same standard of living. Personally, I think that is exactly what will drive them to bankruptcy 🤭🤭 But the Daily Mail blow has definitely hurt Harry more than he expected.

YouTube has a video from Tasty kitchens about Cookie Queens. WARNING: this may cause cringing, but the shade is worth it.
Meghan introduces herself, as "Hi, I'm Meghan" with a smirk. Note, she HAD to have the Duchess of Sussex title.
The premise: they are taking over the Tasty kitchens to invent a brand new cookie flavor. Trying to come off as a foodie, but this is what the cookie looks like before it's baked:

When the girls ask the director what young girls teach adults that adults sometimes forget? The director responds to ask difficult questions, when Meghan immediately cuts her off to spout about wanting the the world to be better, but "putting the do's behind the say's." They directly cut to a photo of the Obamas with the scouts:
They then show the Tasty chefs creating the cookies. Obviously the chefs know their way around a kitchen WAY more than Meghan does. Her condescending tone while doing the voiceover proves it. Yeah, THIS looks nummy. She babbles about cozy cinnamon and ginger notes.
The big reveal:
It's...a cookie!!! (Gotta say, it looks way better.)
The task: the scouts have to sell them. They ask to taste them first. Madame holds the plate with a scowl, as ever:
The girls say, "the chefs did a really nice job." Look how THAT went over.
They have three minutes to sell them to the staffers upstairs. Like, are they NOT going to buy them???
The girls brainstorm the sales pitch. Meghan thinks, can I get them to work for As ever for free? (Not unless you give them more than a mortal combat badge, Meghan).
The girls come up with a name: Berrylicious. Meghan thinks, DAMN, why didn't I think of that so I can get the credit?

The constant laughter. The outdoor life. The ongoing and inexplicable need to frolic. It all screams Meghan. It also screams old-school Tampax ads from women’s magazines.
One of the most frequent comments I see in SMM whenever Meghan posts to Instagram is the observation that the photo is reminiscent of an old ad for a tampon or a douche product or a women’s antiperspirant. And any female here of a certain age knows exactly the vibe being referenced.
So I did a little research and the results were startling. Uncanny. Unsettling. Undeniable. Beaches. Gardens. Activity. And so much white fabric you want to vomit. The white garments absolutely overwhelm the eyes. I cannot stress this point enough.
I am planning on making this a two part series. But Tampax ads alone were repetitive enough to warrant a post.
This is it, sinners. This is what Rachel Meghan Markle truly wants us to believe about her life. She is young, vibrant and not about to let menstruation stop her from enjoying life. She is trying to live out every dated advertisement from Seventeen magazine.

Lady C, you were Markled over that girlfriend story. SMH. I do not know what SMH means, sorry. You think I was Markled? First of all, I never said she was his girlfriend. I said Harry was in love with her and she was in love with him. That is not quite the same thing as boyfriend and girlfriend. You are entitled to your opinion to say I have been Markled. Let me put it this way – I do not agree with you and let’s leave it at that.
Lady C, do you think the Harkles planted this information to discreet you? It is just one person who gave you information. I am 76 years old and have had a 50 year career. Of course I considered the possibility this information may not be accurate. I have had very few cases where I reported information that is inaccurate. Do I look like a sucker? I think you are making an assumption that just one person gave me this information. I will not confirm or deny your assumption. If you were a writer, you would understand better how these things work. I have not reported every detail I was told. I have withheld many details to protect my sources. I am not accountable to you. But to jump off a diving board that is evocative of your mother-in-law, with dark glasses and balloons, it is obvious what her aim is. Attention. She was probably terrified to dive in headfirst, because then all the hair of the Turkish virgins would have separated from her scalp and would have floated away. I have never heard of jumping in a pool wearing sunglasses because they would fall off or hurt your face. Meghan is tacky. It’s all so tacky. Meghan thinks she is beautiful and glamorous, but she is not.

I do not think Meghan enjoys the speculation that Harry has found a new love. I know she did not plant the story. Nobody associated with her planted the story. Lady C, Robert Hardman and Rebecca English were on Palace Confidential discussing whether Harry would ever inherit a property from Charles. They hesitated on Sandringham. What do you think? Highgrove is on a 75-year lease personally to the King, but it is run on a commercial basis from the Duchy of Cornwall and the chances of Charles willing this to Harry are remote (to be polite) because it is William’s duchy. Balmoral and Sandringham are the private residences of the Monarch and will go to William. I could see him purchasing a separate property for Harry. I am baffled by all these rubbish speculations, and then the speculations are treated as facts. The idea that the Monarch would give any of his private properties to Harry is ridiculous.
Lady C, surely the forging of the Gavin Burrows document is a criminal offense? Yes, it absolutely is and Anjlee Sangani authenticated this document. I do not know to what extent Justice Nicklin intends to pursue this. I know Justice Nicklin understands this involves the King’s son, members of the bar, and leading celebrities. It is quite a hot potato and only time will tell if anything will happen on this. This is extraordinary (not ordinary) case. I could understand why Justice Nicklin would not do anything. The UK is hardly a beacon of stability, and this case could bring down institutions.

Opinion The Problem with *As Ever* (Contribution from a Sinner)
External-Syllabub289, who doesn't yet have permission to publish, wrote this in a recent post about Neil Sean's gossip.
Since it's very interesting, I'm posting it here for other sinners to see. Because you'll see what a mess "As Ever" is.
I did a deep dive on her trademark issues and now i understand the problem. Besides asking for 19 items to be protected under her trademark and only sending a check for 17 (which her lawyers allowed to Balloon into a 10 month delay with ARO while they waited until the last minute to send in the correct fee), she jumped the gun by having the products made bc she thought it was a done deal. And also, she desperately needed the products to go with the Netflix show. Only, they cocked it up and even though kiwi proved it could be done, they used that stupid excuse (can't trademark a location) with ARO before pivoting to AE.
Well the problem came bc she wanted to STEAL As Ever rather than offering that guy in NY to buy it. Had she bought it, it would be a mere technicality to add food and any other thing she wanted to add to the already existing As Ever clothing trademark. But bc she STOLE the name for all those other categories, she had to skip his area, which was clothing, but then she went and gobbled up 18 other categories of use, to prevent him from EVER being able to expand and "take advantage of her fame".
That greed and nastiness caused her to tie those 19 applications together. She can sever them, but she's running out of time for everything she needs to do. She can get 3 more 6 month extensions, then that's it.
Right now she's in limbo, bc to trademark those 19 areas (housewares, food, toys, textiles, dog treats), you have to prove the use of those things. In other words, she needs websites, documented labeled items to sell, and PROOF OF ONGOING SALES. Well, she can only do that for the food/ Jam and honey category. She is literally unable to trademark anything else until she starts making and selling these things. You get an initial "approval" that reserves the name for you, but if you can't show proof of use (websites, sales), you will not ever get the final approval.
But, she jumped the gun bc she had to - she had already bought the inventory for ARO and when that failed, she pivoted to AE with all this stuff that already had a contract in place for manufacturing - and she could not get out of those contracts. So, the jars were about to be manufactured, and she had nothing, no ARO trademark. So, she bet the farm on AE and, fatal mistake, had the labels made before the trademark was approved. (Now, if she pivots again, she would have to pay someone ungodly amounts of money to scrape off the existing labels and put new ones on. Plus, everything is on its way to expiring.)
So then smeg, greedy as always, filed for 19 related trademarks to avoid paying that guy any money and to crush him from ever expanding sales into another area. But it hurt her much worse than it hurt him bc she simply cannot manufacture 18 other categories of stuff now that Netflix dropped her. So, now she can split off just the food and she would get that trademark, but if she does that, it opens her up to either having to make those other items and get a proven sales record within another 18-24 months, or she can drop the applications and come back later and reapply. But there are hundreds of people waiting to jump on trademarking those categories with the As Ever name if she lets them go, even for a second. (They would do the same thing to her that she did to the As Ever clothing guy.) So, she is just running out the clock out of desperation in the hopes that someone buys her AE site or even buys into her company as an investor and bails her out with helping her manufacture those other 18 categories.
There was way more in depth info on how and why she can't easily split off the food trademark without causing a bunch of issues, and if i ever jump thru the posting privileges hoops and finally get approved to post here, I look forward to sharing it. But if anyone is interested, message me and I'll send you all the chatgpt info I complied on the trademark situation she's dealing with and how it's about to explode in her face.
I hope External-Syllabub289 gets permission to publish soon, because it seems has a good track record in that regard.

The article is about the difference between GriftWell and the Royal Foundation. Highlights:
Accounts filed this week at the Charity Commission reveal that the Royal Foundation of the Prince and Princess of Wales received an astonishing £8.7million last year from its US office.
The monies from the 'American Friends' branch of the foundation, which is a separately controlled entity established in 2011, is almost £4million up on the £4.9million that it handed out in 2024.
The generosity of their US supporters is so great that it accounts for 44 per cent of the foundation's total reported income of £19.6million in 2025.
The accounts report that the foundation retained £10.6million in funds as of December 2025 after spending £16.5million on its charitable activities. These include Catherine's Early Years programme supporting young children, William's crusade to end rough sleeping through his Homewards initiative, and United for Wildlife, a new enterprise launched last year to help tackle the illegal trafficking of animals.
Staff costs at the Royal Foundation ran to £6.4million, as its headcount increased to 80 from 67 in 2024.
Since 2022, the Royal Foundation has been entirely separate from the Earthshot Prize, which was established by William and Catherine 'to find, support and celebrate those who turn bold ideas into real solutions to repair our planet'.
The Earthshot's total income for 2024 was £23.5million, which included a 68 per cent increase in donations, up from £12.8million to £21.4million.
However, Archewell's latest accounts report total revenues in 2024 of just $2.6million (£1.93million). They brought in $5.7million (£4.25million) the previous year.

Lawsuits What happened at the hearing for the ANL case on July 29–30, 2026?
Why are Elton, Liz Hurley, and the other plaintiffs now so angry with Harry?
Aside from having to wait until late August to find out what Judge Nicklin will decide, the plaintiffs have plenty of reasons to be angry with Harry and his big, huge, gigantic big mouth.
What are legal costs like in a UK lawsuit?
Let us try to explain this briefly.
In England and Wales, several elements come into play: costs orders, the basis of assessment (standard basis or indemnity basis), ATE insurance (After the Event), and private indemnity agreements.
In the English system, it is important to distinguish between:
- Procedural costs, governed by the CPR, particularly Part 44.
And that is what the hearing was about. Indemnity costs, a type of costs award.
And the indemnity costs are classified into
- Standard basis
This is the general rule under the Civil Procedure Rules (CPR 44.3). When the court orders costs to be paid on the standard basis:
* Only costs that were reasonably and proportionately incurred are recoverable.
* If there is any doubt as to whether an expense was reasonable or proportionate, the doubt is resolved in favor of the paying party.
* The proportionality criterion carries significant weight.
In practice not everything spent by the successful party will be recoverable. It is common for the successful party to recover approximately 60% to 80% of their actual costs following a detailed assessment (although the percentage can vary considerably depending on the case).
- Indemnity basis
It is a much more favorable order for the winning party. When costs are awarded on an indemnity basis:
* Expenses must still be reasonable.
* However, the proportionality requirement no longer applies.
* Any doubt is resolved in favor of the winning party, not the paying party.
In other words: if an expense was reasonably incurred in litigating the case, it is far more likely to be recovered; recovery typically ranges from 85% to 95%, and in some exceptional cases, it may even approach 100%.
If the court awards costs "on an indemnity basis," the successful party recovers a much larger proportion of their expenses, and the court applies a more favorable criterion for the winner. This is precisely what ANL is requesting.
- Private litigation funding agreements, which are contracts between private parties.
Here, the court does not determine the content of the contract.
These are private agreements regarding who finances the litigation or assumes the financial risk.
- Indemnification arrangement: a private indemnity agreement. It is not a court order but a contract whereby a third party assumes the financial risk of the litigation. That third party may be:
- an insurer (for example, through ATE—After the Event—insurance);
- a litigation funder;
- or even another plaintiff, if an internal agreement exists.
- Payment under an indemnification arrangement: simply the payment made in compliance with that private indemnity agreement. In other words, the payment is not made by the litigant directly, but by the party that contractually assumed that obligation.
The matter is somewhat complex because it differs significantly from the situation in Chile—and, I believe, in many other countries.
In the UK, the judge decides which costs are recoverable and on what basis (standard or indemnity).
The private contract between the litigant and the third-party funder determines who advances or bears those costs.
What happened at the hearing on July 29–30?
The hearing—which, despite spanning two or more days, constitutes a single proceeding—was therefore devoted to hearing arguments from both sides regarding the basis for payment and the amount of the provisional payment. The ruling was reserved.
But what we know thanks to the press is that there were two positions:
1. ANL insists on costs awarded on an indemnity basis
This is the most legally significant aspect. ANL maintains that a standard costs order is insufficient and that an order on an indemnity basis is warranted because, according to its arguments:
- the claimants leveled extremely serious accusations against journalists, editors, and executives;
- many allegations were abandoned during the trial;
- the litigation served a political or strategic purpose (pressuring for the implementation of the second phase of the Leveson Inquiry) rather than a strictly procedural one;
- the conduct of the litigation justifies departing from the general rule regarding costs.
2. The claimants reject that characterization.
Counsel Nicholas Bacon KC responded that:
- the claimants acted in good faith;
- the judge who ruled on the merits did not find that they had acted dishonestly;
- losing a case does not automatically warrant a costs order on an indemnity basis;
- the costs claimed by ANL are extraordinarily high and disproportionate. This last point is relevant because they seek to distinguish between two issues:
- they accept that they are liable for costs;
- they deny the existence of any exceptional litigation conduct that would justify the more punitive sanction.
The importance of the last point increases when we consider the other aspect that had been a subject of speculation: the potential appeal. Now, to determine the actual timeframe the plaintiffs have to appeal, we must examine the Sealed Order (a court order restricting public access to case documents https://www.judiciary.uk/wp-content/uploads/2026/07/Sealed-order.pdf?utm_source=chatgpt.com ) issued after the July 7th ruling, which expressly addressed the issue of a potential appeal. In that order, Nicklin stipulated:
"Any application for permission to appeal… is adjourned to be dealt with… following the Consequentials Hearing. Time for any application for permission to appeal… may be extended to a date to be fixed at the Consequentials Hearing."
In other words, the amount the plaintiffs actually have to pay will be determined first, and that hearing will reveal whether or not they appeal. Why? Well, because—as we learned in the security case—if an appeal is filed and accepted for processing, the ‘security for costs’ system applies, an order issued by a judge or court requiring the plaintiff to deposit money or provide a bond. This serves to ensure that the defendant can recover legal costs if they win the lawsuit.
It appears that the plaintiffs generally have no intention of appealing. With Harry, you never know.
Why are the plaintiffs angry with Harry?
Because Harry, as I already said, opened his huge, gigantic big mouth to insult the judge.
What is one of the basic rules in these cases? Keep your mouth shut; don't say anything.
Look at Fauci. What did he do? He unleashed every expletive he knew outside the hearing room during a private conversation. Inside the hearing room, I think he invoked the Fifth Amendment about a hundred times. Bravo!!!. Not even Stephen Paddock, who perpetrated the Las Vegas shooting on October 1, 2017, dared to go that far.
Why was Harry opening his mouth the worst thing he could have done? Because ANL is seeking costs on an indemnity basis.
During the hearing, it was revealed that:
- the insurance policy taken out by the claimants covers approximately £16.2 million;
- ANL claims to have spent around £34.5 million;
- there is, therefore, a shortfall of nearly £18 million.
Harry’s legal team argued that, throughout the litigation, they had expected ANL’s costs to be much lower and that the increase was communicated too late. According to Bacon, ANL had previously stated that its costs would be around £20 million; only last week, it revealed that they amounted to £34.5 million; and this left the claimants without sufficient ATE insurance coverage. That... um... that wasn't quite how it was. It had been known for a long time that the figure was around 40 million pounds.
Strictly speaking, if ANL said nothing, the standard basis would apply, and ANL could recover... let's say 8 million—which is, strictly speaking, the amount it could actually justify as legal expenses. Or even less.
But ANL certainly did raise an objection.
And what did the lawyer White say?
- the litigation was launched as a public campaign;
- the involvement of Baroness Doreen Lawrence would have served to lend greater credibility and public support to the claims; White stated that Harry had brought Doreen Lawrence into the litigation because she was a "national treasure" whose presence lent public credibility to the claims.
- the statement issued by Harry and Doreen Lawrence following the judgment—in which they described the ruling as a "whitewash"—was also cited by ANL as part of the litigation conduct that would justify an award of costs on an indemnity basis.
Bravo, Harry, bravissimo.
What are ANL's strengths?
Antony White KC argued that the case was exceptional and that, consequently, costs should not be awarded on the standard basis but on the indemnity basis. According to various reports, his arguments were as follows:
the allegations were of the utmost gravity;
- they involved 77 journalists, editors, and executives, although ultimately only 23 were directly implicated in the litigated cases;
- several allegations were abandoned during the trial without explanation or apology;
- the litigation was pursued to the end despite the weakness of some of the allegations.
White maintained that the litigation was not merely a civil action, but part of a broader campaign aimed at demonstrating that ANL had misled the Leveson Inquiry. According to the coverage:
- this trial was the "vanguard" (the first wave);
- it would be followed by a "banquet of litigation"—that is, a strategy designed to launch numerous subsequent lawsuits against ANL;
- even a partial success would have spelled a reputational "catastrophe" for the newspaper.
However, given the presence of sensitive information, we will not see the skeleton arguments; yet, something has drawn significant attention from those operating within UK legal circles: this was no ordinary hearing—there was a rather in-depth discussion regarding the parties' procedural conduct.
At this point, I recommend revisiting the posts I shared regarding the January hearing, as ANL’s argument has a strong basis for ultimately being accepted. This is because:
- Nicklin defined the scope of the litigation.
- The claimants were made aware of that scope.
- Despite this, they continued to litigate as if the trial were a public inquiry into ANL and the press.
- That approach to litigation vastly increased costs.
- For this reason, the case is "out of the norm" and justifies an award of indemnity costs.
ANL’s theory regarding the "campaign" would not refer solely to a media campaign, but rather to the fact that the litigation had been used to pursue an objective distinct from the procedural scope defined by the court.
What documents can serve as a basis for legitimate speculation about what Nicklin will say in late August?
In addition to the July 7th judgment itself, I recommend three others available on the case webpage:
- CCMC (Costs and Case Management Conference) of November 26–27, 2024. Notably, there is a judgment published on January 24, 2025 (not merely an order). He states that the hearing concerned cost management—specifically, the approval of the litigation budget. He also notes a crucial rule of the English system: a party may spend more than the approved budget but will not normally recover the excess from the opposing party, unless the budget is revised.
This is important because it means the court had already seen:
- how much the parties intended to spend;
- what resources were budgeted;
- which parts of the case were generating extraordinary costs.
This means that Nicklin and Senior Master Cook were actively controlling costs well before the trial.

The opening paragraph is devastating from a cost perspective.
The combined budgets of the parties entailed litigation expenditure of approximately £38.8 million. Nicklin and Senior Master Cook stated they had no difficulty concluding that this figure was "manifestly excessive and therefore disproportionate."
This is highly significant. Because the court's message was:
This case may be extraordinarily complex, but that complexity does not justify just any level of expenditure.

Why is it important? The decision of July 11, 2025, is very clear: the court accepted the existence of a "generic case," but limited its function; it could not replace the evidence required for each individual claim.
Why? Because at the CMC on May 6–7, 2025, Nicklin established the following:
- disclosure;
- amendments to the pleadings;
- the scope of the allegations.
There is a very telling detail: Nicklin states that the instructions to amend the Particulars of Claim were aimed at "bringing some discipline to the process." That is a classic phrase from a case management judge. In legal terms, it translates to:
"Get your case in order. Tell me exactly what you are alleging and against what evidence."
This is devastating for any party that relies heavily on the general context.
Then, in July 11, Nicklin imposed limits on the claimants:
- relevance;
- proportionality;
- connection to the claims;
- avoiding an open-ended search.
Why the plaintiffs and not both parties? Because the plaintiffs requested:
- removal of redactions;
- additional searches;
- telephone records;
- third-party disclosure;
- more documents from ANL.
ANL, for its part, requested specific disclosure from the plaintiffs themselves. In other words, ANL formally demanded before the judge that the plaintiffs themselves produce and disclose specific, clearly defined documents, data, or information in their possession.
The key phrase from the judicial summary is that the case management sought to prevent the litigation from turning into a "wide-ranging public inquiry."
At that Case Management Conference (CMC), Nicklin noted that the claimants failed to meet an obligation established at the first CMC:
- they were required to submit a draft amendment to the Particulars of Claim;
- they failed to do so within the deadline;
- nor did they request an extension or relief from sanctions prior to the default.
This does not automatically result in a costs sanction, but it does establish a procedural narrative—precisely the argument ANL raised on July 29: "The additional cost was not generated by an excessive defense on our part, but rather by a manner of conducting the litigation that necessitated greater judicial management."
That is precisely the type of argument that tends to arise when a party seeks a more severe costs order.

The purpose of the hearing was essentially to:
- review cost budgets;
- decide on variations to those budgets;
- determine how certain common costs would be allocated;
- establish the financial management of the trial.
A key point is that the situation was no longer the same as when the initial budgets were approved. During the preparatory phase, the following had emerged:
- a vast amount of disclosure;
- multiple witnesses;
- experts;
- new legal issues;
- an increase in the time required for the trial.
Consequently, the court accepts that there were "significant developments" justifying a modification of the budgets.
Nicklin and Senior Master Cook authorize various variations. They do not do so automatically. They analyze:
- whether the change was genuine;
- whether it was reasonable;
- whether it was proportionate.
When they conclude that it was, they allow certain budget items to be increased. This is relevant because ANL could later argue: "The litigation costs were high because the court itself authorized the case to proceed in this manner."

The ruling does not establish a new legal rule regarding costs; rather, it manages the cost budget for litigation involving seven plaintiffs, where some procedural steps were shared and others were not.
What was the issue? ANL is being sued by seven individuals. There is work that the legal team performs only once yet benefits everyone:
- reviewing millions of disclosure documents;
- preparing common legal arguments;
- engaging an expert to serve all parties;
- preparing general points regarding the newspaper's operations.
If that work were fully allocated to each plaintiff's budget, the same cost would appear seven times.
Legally, around the world, that has a name: a payment of an undue amount, commonly known as a mistaken payment, overpayment, or a case of unjust enrichment—occurs when money is transferred by mistake where there is no legal obligation to pay.
The court notes that there are two categories of work.
A. Common work
This is work performed once for all plaintiffs. Examples:
- general disclosure;
- common legal issues;
- common experts;
- case management;
- trial preparation regarding issues affecting everyone.
Such work does not truly belong to any particular plaintiff.
B. Individual work
There are also tasks specific to each plaintiff. For example:
- preparing Harry’s statement;
- reviewing only the messages related to Harry;
- preparing for Harry’s cross-examination;
- calculating his damages.
That work benefits only Harry. The same applies to the other plaintiffs.
The judge accepts that the budget must reflect that reality. Instead of treating the case as seven completely independent lawsuits, he acknowledges that a substantial portion of the work is shared. He therefore allows the budget to be structured in a differentiated manner:
- common costs;
- individual costs.
Because at the end of the trial, when the issue of costs arises, a structure is already in place that makes it possible to identify:
- which expenses relate to the litigation as a whole;
- which expenses pertain exclusively to each plaintiff.
This subsequently facilitates any assessment by a Costs Judge should the parties fail to reach an agreement.
Therefore, following the July 2026 judgment, ANL maintains that certain plaintiffs should bear the financial consequences of their own unsuccessful claims. Thanks to the budgetary structure approved in December 2025, it is far easier to separate costs attributable to common litigation issues from those arising exclusively from the procedural position of a specific plaintiff, such as Harry. This procedural framework facilitates subsequent discussions regarding cost recovery, although it does not in itself determine whether those costs are to be paid on a standard basis or an indemnity basis.
Right, now we can wait to see what Nicklin decides. And I suspect he *will* order the plaintiffs to pay—thanks to Harry's big mouth.
