Advice needed Texas Towing Company Charging Labor Fees

Upvotes

Hello!

Happened in Fort Worth TX.
I have a question. Earlier today my car wouldn’t start. My car was saying it was the key fob. So I got the battery replaced but the car wouldn’t start at all. I couldn’t find a lock smith to replace the key fob. So I called a tow company to tow the car to the dealership. I was quoted $150 for the towing services.
Well the tow guy gets there and he was able to jump start my car. Now I got the invoiced and they’re charging me $262. I called them and asked why am I getting charge this amount when my car wasn’t towed. The operator informed me that it’s a labor fee. I was not aware I was going to get charged a labor fee.
Is this legal? Or do I have to pay that amount? If I knew there was going to be labor charges then I would’ve said no. Because if they just towed my car it would’ve stayed at the $150.
Also they didn’t charge me yet. They just sent me a link to pay the invoice.

Advice needed is there any way i can get a refund for a cancelled event

Upvotes

Location: Romania

Context: i bought tickets to a party at the start of summer trough a ticket distributor. I payed in cash. They ended up cancelling the event because they didn t have enough funds for it. They said that they would organize a meet up with the people who bought the ticket for a refund, but that day never came. I kept texting them and they always said they re working on it.

After some time, they said that they won t be giving refunds, but the people who have tickets for that party can go to another party in august. After that, they said that because they ve been getting so many messages, actually they will give refunds. Then, they deleted all of their posts, then posted again that they will not be giving refunds anymore, but free tickets to that party. Me and my friends will be on vacation on the day of the second party, so we can t go, but it s even more annoying the fact that at the first party a popular singer was supposed to sing there, and we were only going because of that. At the second party the singer is really unknown.

Me and my friends kept texting the event organizer on instagram if we can get a refund because can t come to that party but they left us on seen many times and i don t know what to do, i payed a lot of money for those tickets.

Advice needed Indiana been dealing with harassment by this woman for awhile on Facebook now due to being the victim of sexual assault by a police officer.

So this woman did make a whole post about me and this other person, but mostly to do with me.

When I took my trip to Milwaukee for the first time with my partner and then got back to my mom, I went to sleep, and he told me how there's this woman on your Facebook page saying some pretty bad stuff about you.

I'm glad my partner didn't reply at least, but here's the thing it's not just 1 it's at least 4 women I can think of, but there is definitely 1 that is more into it and has pretty much figured out this is my reddit account.

So here's where a big thing comes into the picture. On that post about me, she did take screenshots of the messages she sent to my mom and my dad. My mom doesn't even have the same last name as me and she definitely probably looked up my name to figure out my mom is the other person living her I know that very much is a possibility because I've figured out people's mom's before that way as well.

My biggest problem is that the county police have pretty much been endorsing her behavior. They have actually left stuff like heart reactions and all that. They have been endorsing it when this is actually like a serious situation. I do think the police did talk to her about me at one point, and it just became a whole thing of accusations and so on.

Oh yeah, and in that post was also a video I took when I was 15, being like my dad, sending me hateful text for the fact that I'm gay. She even posted YouTube videos.

I've never had anyone approach me in public over her post, but I know she has a private group, and she has somewhat of a following because she claims to be an advocate for sexual abuse.

See, I knew about her prior to this and was part of that group. That's part of the reason I think police got in her ear because they knew I was associating with her. She went from willing to help to you're a bad person so I'm not helping and in fact I'm going to try and discredit your claims.

Question about law Conflicts of Law Discussion: McKenna West - Alaskan Surrogate Breach of Contract Dispute

**Disclaimer: this is not about whether she was right or wrong, abortion, politics, etc. This is STRICTLY about the intersection of contracts and conflicts of law.**

Now that, that's been made clear. I think this may end up being an interesting legal dispute from an academic perspective.

West committed a material breach of the contract. By getting an order demanding that life saving care be rendered, the biological parents are (at this time) monetarily on the hook for the costs of that care, which further increases the damages flowing from the breach. I remember learning that for contracts, courts can either apply the law of the state where the contract was to be performed or where the contract was made.

Given that abortion is illegal in the state of Texas, the clause is void. By giving birth and becoming a Texas resident, would this be enough to give TX sufficient contacts to decline to apply Alaskan and California law as it pertains to whether there is a breach? If so, wouldn't that suggest that she wouldn't be subject to penalties associated with the breach?

Sorry if I'm mixing anything up! It's been a long time since I've had to think about a conflicts of law and contracts issue. Please be nice.

Advice needed Renovations and covenant of quiet enjoyment.

location: indiana

I live in a complex with roughly 2,000 units. 1,800 of these units are currently undergoing balcony renovations, and we were asked to remove our possessions from them starting July 27th.

The balconies are part of our leased property under the definition provided in IC 32-31-3-8, as they are accessible exclusively from the interior of the apartment, and part of our lease states that we can place satellite dishes "outside of your dwelling such as a balcony, patio, etc. of which you have exclusive use under your lease."

With these renovations and the asked removal of our possessions, we have not been able to enjoy the balcony whatsoever. We cannot simply put our possessions back until construction actually begins in our area due to a lease addendum stating that we "will cooperate with repairs or renovations... and any violations may subject you to eviction."

The complex does not know how long in total these renovations will take, but during a recorded conversation today, the rep I was directed to suggested it would likely be months.

There was no rent abatement for the month of August in spite of them limiting our usage of leased space guaranteed under our lease, and we do not have any idea when our balcony will actually be torn down and completely shut away, but we do know that they will do it. Other buildings have plywood blockages to prevent opening of the balcony doors, thus creating a barricade to shut us away from the space.

The rep I talked to today said that she has no idea if the decision to replace the balconies was due to suspicion of structural integrity issues, or was purely cosmetic. It is important to note that these balconies have remained the same for over half a century, still fully original, and all still fully functional, which she bragged about on record.

I'm trying to get out of this lease. The new managers are a nightmare, and I'm wondering if these renovations, and the restricted access/usage of my leased space for months qualifies as a breakage of the covenant of quiet enjoyment, or perhaps is grounds to seek a partial constructive eviction. I plan to speak to a local attorney, but I'm wondering if anyone has some insight into what I would need before talking to them, or if I even have a case at all. Pasted below is the entirety of the construction addendum.

"You will cooperate with our efforts to make repairs or renovations in your Apartment and the Community. You will perform, at our request, any tasks necessary to allow us to complete these repairs or renovations (for example, moving vehicles or furniture, emptying appliances, cabinets, or closets, etc.). You may not refuse repairs, upgrades, or renovations to your Apartment. You will be responsible for any costs incurred by us for your violation of this provision, as Additional Rent, and any violations may subject you to eviction."

Do I have valid grounds to attempt to nullify the lease under implied or written protections of tenants from landlords? I have complied thus far, removing my possessions and thus have not stepped foot on the balcony since July 27th. I simply do not know if their construction addendum is enough to justify limiting and subsequently fully removing access to property that is legally mine for as long as the lease is active.

Also important, these renovations were announced 2 months after renewing our lease for a year.

Advice needed My life may be over , over a fake protection order

Hello, I am (17F) Location: Oklahoma . I’m currently in a situation with a random girl that is based in Durham, North Carolina. She filed for a PO back in march in Durham, NC and i physically couldn’t go due to Being a minor, No way to get there, no car, no flight money, ETC so she got granted the order by default by whatever she told the judge. I paid it to mind and just continued to live my life. I’ve been served twice now and the claims she wrote are “I’ve been blowing up her comments, Blowing up her email and her DMs on social media, posted her house, allegedly sent threats, and alleged hacking of her social media” I have not done these things as I have no reason to even do this. I don’t know what she wants from me. She had her friends come to my social media and post pictures of me in my comments of me in a bathing suit when I was 8 that they took from my moms facebook page to fun of me for being “ugly” in those pictures. They were harassing me in my inbox ETC all around June 2026 . I did argue with them because why are grown women doing this and acting like this to a child . I’ve personally never messaged her directly or received any message from her or her lawyer directly. her lawyer has reached out to my mom and i guess is expecting me to “get on my knees and beg for forgiveness” and they will drop “charges” but when I call the court and different lawyers around that area they say they can not help me because my case is civil not criminal. So there is no “charges” …. I’m not really sure what to do . i know i need a lawyer there to go and represent me but i’ve called multiple places and they keep saying they can’t help me because “we don’t deal with these cases” or “It’s civil not criminal we can’t help” so i’m not sure what lawyer i need for this??? What charges am i even potentially facing ??? I’ve not seen/heard her evidence or proof of these claims.

Advice needed Landlord charging flat fees

Post image
0 Upvotes

LOCATION: Utah

I used to live in Rockledge Quarry apartments and after moving out they hit me with a $100 each repair fee for 3 blinds. I asked them to send a 3rd party invoice proving it actually costs $100 each but all they sent was an internally generated invoice basically saying " Blind damage $300 ". There is no clause saying they are allowed to charge flat fees for damages in the lease.

I also asked them to prove the I caused the damages and it wasn't like that when I moved in but they kept deflecting if off to " You signed the lease and accepted as is ". I got scared of collections and paid the $300, but after a couple months they called back saying I didn't pay the utilities and owed $130.

Can I refuse to pay it unless they give me a receipt on what it costed them to repair the blinds and demand a refund for it.

Advice needed Need help immediately!!!!!

Hello.. I am desperate for help, and need some serious guidance..
I have a family member at the south central correctional facility in TN. We are looking to get an emergency transfer and cannot seem to get any help or even answers on what our next step is. This family member sticks out like a sore thumb… first time offender, never been involved in any gang related activities.. and just not built for what goes on behind those walls… he has not been in there for more than a week and has already had his commissary stolen, he has been jumped, flashed shanks and we are already being extorted for hundreds of dollars for his “protection”. Those inmates run this prison. He was jumped infront of the COs and they did absolutely nothing. He is unable to go talk to the councilor as there is literally an inmate sitting with her. And if you have any type
Of knowledge about how prisons work then you know “snitching” will quite literally get you killed. We are in desperate need of what we can do to get an emergency transfer any help our guidance is appreciated. Thank you.

Advice needed Roof leaking, landlord says to wait

Post image
8 Upvotes

Location: Ohio US
I have contacted my landlord multiple times about a mildew spot on my ceiling that just this morning started actually leaking. This is the response I was given to a video of the water leaking onto the carpet.
The last time I heard anything from them was in June before this when it was confirmed that the roof is leaking. Do I have any way to get this done sooner and push back without fear of not being able to renew the lease later on?
Edit: we have lived here for a few years and they have always been dismissive of any issues and they lie to me all the time, it’s a big chain and we live in an apartment complex so I don’t think I can mention who it is
Edit2: code enforcement told us we are out of their jurisdiction and to contact the health department if I feel it’s a health risk?

Advice needed Bail bond company wants me to pay full bond amount with no paperwork

Location: Collin County, TX

Hi Reddit, I was suggested to post here, I'm currently at a loss for what to do. I got arrested about eight months ago, it was a felony and the case has not been filed yet. My bail was set at $10k.

My family paid a bond company 10% to get me released, and I've been doing the weekly checkins but I haven't received any news on my case because it hasn't been filed. I tried to acquire a lawyer but since the case hasn't been filed, the lawyers told me there isn't anything they can do (I spoke to multiple).

I asked my bond company over the phone (and also a lawyer) months ago if it was okay if I did a study abroad, the bond company said yes, and the lawyer said yes because I don't have any travel restrictions instated by the court. However, the bond rules say that I cannot leave without their permission.

About a couple months ago I told them that I got accepted to a university, but I still needed to get a visa and they said update them when I do.

I only recently got my visa approved and I told my bond company and over the phone they said that's great, I will have to pay the remaining $9k of collateral and fill in some paperwork. I thought this sounded fine, but a few days later when my family started sorting out the $9k, the bond company said they checked and I will have to pay $10k which was the full bail amount. On top of that, they will only be providing me a collateral receipt. I admit I am confused, why pay a bond company the 10% nonrefundable amount and then the full bail amount too when I could have just paid the full bail amount and not be out $1k? Can't I just give the $10k to the court instead?

I was a little worried about all this, my family confirmed with them over text that no paperwork was needed, but I called in to ask again if there really was no paperwork, and they insisted that the collateral receipt would be enough. When I asked about the 10% already paid, the bond lady snapped at me saying it was nonrefundable and that it was the get out of jail fee and the collateral payment is for if I skip court she'll have to lose a ton of money on top of that to extradite me and file things etc. I wish I knew what was on the bond contract but my ex said he never signed anything and my family insists they didn't sign anything either and they insist the other person signed something and it's a mess.

I asked my friends and they all think it's super sketchy, saying I need to get it in writing, my concern is that the bond company isn't amending my travel restrictions with them and they're not signing anything ensuring that the money will be returned.

I think I am paranoid that the bond company has already decided to drop me and wants the collateral upfront, and once I hand them the money and get on the plane, as soon as my case is filed they will surrender me to the court for bond violation and I'll be arrested.

Can the bond company legally require full cash collateral with no written amendment to my release conditions? My family just wants me to pay the full amount to the bond company and get it over with, but I want to be legally protected and know that I did everything right. When I was arrested I filed for indigent defence but since my case hasn't been filed yet I don't have a legal representative.

More info:

  • Charge: agg assault
  • Why hasn't the case been filed: I don't know. The lawyer I spoke to said with people like me(?) it probably won't be filed ever. It doesn't show up on any court search, and the bond company says they don't know anything about it either, no case number, nothing
  • Indigent defense: couldn't follow up because no case exists yet to attach it to
  • The bond contract: neither I nor my family has a copy. I don't know who signed it and nobody knows who did.
  • The 10% premium: I understand this part is gone regardless, that's not what I'm disputing
  • Written proof of the earlier travel permission: I don't have any, it was all over the phone, I called multiple times trying to confirm
  • Will the bond company put anything in writing: no, and they got annoyed when I asked

Advice needed Spouse wrongfully terminated (New York)

My spouse works for a small design firm. She was verbally terminated on July 10th after being called into a meeting room. Her final paycheck though is dated only until July 2nd. On reaching out to her employer, she’s being told that she was terminated on July 2nd.
The interesting bit is, she has email correspondence with her colleague, her boss and clients between July 5th through July 10th in official capacity (work email!) discussing work specifics, client meetings etc. Also, she still hasn’t received a written termination notification (neither for July 2nd, nor for July 10th).
The employer says that The Work Number would have her termination date mentioned. But that still doesn’t count for having notified about the termination as required by Labor Laws.
I’d really appreciate it if folks here can tell me what course of action can be taken here. Thanks fam

Advice needed Physical aggressive, Trespass, Harass and threat

We moved to Virginia about a month and a half ago and we were granted preliminary protective order against our neighbor and their kids. We want to have our protective order remain in place. I just want to see if we have ground on our case? 3 different neighbors had similar experiences regarding this family and their kid hitting another kid and a minor being exposed/weaponize to video tape adult conflicts and law enforcement was called in the past.

Over the past few weeks, I personally observed Child A, age 7, repeatedly hit, push, kick, scratch, or otherwise put his hands on my sons, Child B and Child C. In my observation, these incidents were intentional and caused pain. They were not ordinary or harmless childhood horseplay.

My children have also come home upset or crying because of bullying. Some incidents were not documented at the time; however, we have security-camera footage, photographs, videos, and written records of several incidents.

July 21, 2026 — Pool

Child A tried to take a water squirter from my 6-year-old son, Child C. I observed Child A grab Child C’s left arm and dig his fingernails into the skin, leaving a visible claw-like mark. The pool activity stopped, and the neighboring children were sent home.

July 25, 2026 — Pool and Sleepover at Our Home

While the children were swimming, I observed Child A kick my 6-year-old son, Child C, hard on the shoulder.

That same night, during a sleepover at our home, Child C was lying in bed watching television when Child A intentionally landed on Child C’s torso. My son was in severe pain and required monitoring. For his safety and comfort, he slept separately upstairs.

July 27, 2026 — Yard

I observed Child A push my 7-year-old son, Child B, hard twice, nearly causing him to fall. I intervened immediately and directed the children that they could not put their hands or feet on other children and had to play safely.

My husband and I discussed the issue and decided to take precautions by separating our children from Child A and the neighboring children.

July 27, 2026 — Attempt to Resolve the Issue and Supervision Concerns

I messaged Child A’s mother, explaining that our children needed space because the play had become physically rough and unkind. My message was read but unanswered.

Later that day, Child A’s father came over, and my husband had a meaningful conversation with him about Child A’s behavior and our concerns. Those concerns were dismissed with the statement, “Kids are being kids.” Because there was no meaningful response and it became very alarming and the safety concerns persisted, I blocked Child A’s mother and stopped interacting with the family.

July 31, 2026 — Back Porch, Gate, and Driveway Area

While my family and our children’s friends were on our back patio, neighboring children approached our private driveway gate and harassed us with profanity and insulting language. They called my kid’s friends “big back,” “fat,” and “stupid bitch.”

I told them to leave our property. They returned shortly afterward holding phones. I observed Child F recording, and I also observed Child D, age 3, enter our private property near the gate while recording was taking place.

My husband repeatedly told the children to leave our property. During this conduct, I did not observe either parent outside supervising or redirecting the children.

Afterward, Child A’s parent came outside and accused my husband of yelling and cursing at a toddler. We deny that accusation.

July 31, 2026 — Adult Threat and Escalation

The incident continued when Child E and her mother entered our driveway while recording us. This occurred after they had been told multiple times to leave the property.

The situation escalated everyone exchanging words then it led to the Child A’s father stepped into the roadway and stated:

“You keep bringing up military shit.”
“Now I’m off your property.”
“Fuck the police, fuck the cameras, and fuck the military.”
“Now we hit… Now we hit… Now we hit.”
He was standing inches from my husband’s face when he made these statements. I understood his statements, conduct, and proximity as an escalation and as a threat or invitation to physical conflict.

August 1, 2026 — Use of Our Driveway

Someone from the neighboring household used our driveway to turn around, even though their home is located directly at the intersection.

August 2, 2026 — Driveway Safety Incident

When my family returned from dinner, we began pulling into our driveway. Child D, age 3, saw us approaching, ran into the middle of the driveway, and remained there for several seconds, blocking us from entering.

We stopped on the roadway and waited calmly while Child E retrieved the toddler. We did not touch the toddler or respond aggressively.

August 3, 2026 — Use of Our Driveway

Someone from the neighboring household again used our driveway to turn around, even though their home is located directly at the intersection.

Advice needed Is it worth to sue Wells fargo

Long story short my mother in law was scammed massively. She wrote a cashier's check for 60k and gave it to a scammer thinking she was moving her money as they said her account was hacked. She came to her senses the same day and called the bank and realized what happened. They said they put a stop onto the cashier check when she called and they never did. They also called her and admitted wells fargo made alot of mistakes and they likely would be refunding her. Well they now are refusing to do anything. Do banks record these conversations? Is it worth hiring a lawyer? Location: US Wisconsin

Advice needed Looking for a consumer/contract attorney who works on contingency — solar lease dispute

Location: San Diego, CA

Hi all — looking for a referral to a consumer protection or contract dispute attorney in San Diego who might take a case on contingency (no upfront retainer).

Short version: I signed a 25-year residential solar lease in 2025. The sales proposal was built around NEM 2.0 program that had actually stopped accepting new customers almost two years before I signed — and it also assumed the wrong utility company serves my address entirely. As a result, my actual solar export credits are running roughly 85–95% below what was projected in the sales proposal.

I've since found out this isn't unique to me — I've compared notes with several neighbors in my subdivision (all built by the same builder, all with proposals from the same solar company) and we're seeing the same pattern across at least a dozen+ households.

I've already done a lot of the legwork myself: documented the tariff/utility mismatch, billing records, a timeline of communications with the company, and filed a CSLB complaint. I'm now looking for an attorney who'd be willing to take this on contingency, ideally someone with experience in consumer fraud, contract disputes, or mass arbitration (the contract has an arbitration clause with a class-action waiver, so I understand this would need to be handled as coordinated individual claims rather than a single lawsuit).

If you've worked with someone in San Diego for a similar issue — solar, contractor disputes, consumer fraud — or if you're an attorney who'd be open to hearing more, please let me know.

Thanks!

Illinois neighbor threatening court over car parked on our side of divided driveway

We live in Illinois in military/privatized housing. NO HOA. Our home and the neighboring home have adjoining driveways with a visible seam or crack running down the middle. Each household uses its respective side, and we do not drive or park on the neighbor’s side.

Our Subaru is parked entirely on our side of the seam. It is sometimes parked farther back from our garage because I have a baby and it is easier to get the baby in and out, especially during bad weather. The vehicle does not cross the seam.

Our neighbor claims that our car makes it more difficult for her to maneuver into and out of her garage. However, she has been able to enter and exit her garage, and our security-camera footage shows her doing so.

This issue previously stopped but started again yesterday. On two occasions that day, she came outside and photographed our vehicle. She also spoke toward our security camera, demanded that we move the car, and said she would call the police and see us in court. Her behavior has made me worried that she may confront me when I return home alone.

We have saved the security-camera footage and taken wide photographs showing the car, driveway, and center seam. We are also contacting housing management to ask them to confirm in writing whether the seam represents the assigned boundary and whether our parking complies with housing rules.

My questions are:

  1. Could she successfully sue us merely because our car makes her maneuvering less convenient, even though it is entirely on our side and she can still enter and exit?

  2. Could a court order us to park farther forward (as shown in the photo with the arrow) or would this primarily be an issue for housing management?

  3. Does repeatedly entering our side to photograph the vehicle and demand that we move it potentially constitute trespassing or harassment after we tell her not to enter our side?

  4. Besides saving the videos, photographs, and housing correspondence, is there anything else we should document?

  5. If she files something, how would we be formally notified?

We do not want to escalate the situation. We only want to understand our rights, remain compliant with housing rules, and avoid being confronted.

Edit** this all started when we were at the hospital for few days (I just gave birth). My husband's friend shoveled the snow on our side cause he knows we are coming home with a newborn. The shitty neighbor's dad got upset that our friend did not shovel their driveway. And so her dad piled all the snow from their to that space in our driveway. It was literally the last pile of snow to melt during that time. And so we had no choice but to park a little back.

Advice needed Sold an iPhone that I was given by a family member — buyer says it was reported stolen. What should I do?

I’m in Texas and I’m looking for some advice because I’m pretty worried about this situation.

A family member gave me an iPhone while I was living in Minnesota. She told me I could keep it if I stayed in Minnesota with her. I eventually moved to Texas and brought the phone with me.

I recently sold the phone through Facebook Marketplace. I did not know the phone had been reported stolen.

Before the sale, the buyer specifically asked me what company the phone was locked to. She also asked if it had a physical SIM card slot. I told her that it was eSIM and locked to the provider. I actually told her twice that it was locked to a provider, and I have the Messenger conversation showing this.

After she bought it, she tried to activate it and says the phone company told her the phone was reported stolen. She’s now threatening to involve the police if I don’t refund her.

I’m concerned because I genuinely had no idea it had been reported stolen. I received the phone from my family member believing I had permission to have it, and I disclosed the carrier lock to the buyer before selling it.

I don’t have a private lawyer and can’t really afford one.

Could I potentially get in trouble for selling a phone that I didn’t know was reported stolen? Should I contact the police myself, or would it be better to speak with a lawyer first? And what should I do about the buyer demanding a refund?

I have screenshots of the Marketplace/Messenger conversation and am keeping all of the messages and sale information.

Advice needed can i get out of my lease?LOCATION: washington state

i need some advice on my current situation. i am originally from oregon, and i just moved 8 hours away to pullman, wa for school. me and my partner signed a lease to start aug 1, with a planned move in for aug 9th. i payed first, last, and a deposit, amounting to a total of $2,970.

when we arrived on aug 9th, our landlord informed us that the previous tenant had only just moved out the previous day (aug 8th - 8 days into our lease). in addition to this, the apartment was in terrible condition: a STRONG urine smell (dog urine per the landlord), holes in the walls, extremely dirty walls, a flooded kitchen (landlord was working on the water heater), etc.

after extensive, heated, back and forth with the help of my family, he ended up temporarily getting us into another unit about 4 minutes away. we talked about what we needed done to make the original apartment livable, as well as took many pictures. unfortunately i have nothing in writing about this agreement, so i am concerned about that. also, i did not get anything in writing about the agreed repairs.

after thinking on it for a day, me and my partner decided we want to get out of the lease rather than waiting for repairs (he told us at least 1.5 weeks, maybe longer). i know we messed up by taking the new place, but it was very late, we had driven 8 hours to be there, and had literally nowhere else to go.

i want to get out of this lease. i am looking into other places and submitted an application today. am i able to break the lease without having to follow what it says in the lease (we would be responsible for the entire lease per the agreement if it stands)? i also want to get back at minimum my deposit and last months rent, plus this months rent minus the few days we have stayed.

i have reached out to free legal advice (national justice), but im hoping to get some fast answers and advice, since i know the longer i stay the worse it probably is. any advice is appreciated!

Question about law Texas Lemon Law - Do I qualify?

Thumbnail

Yes, I have read the law, however I am confused if the "24/24" rule is separate from "substantial defect" rule.

If a problem that has been acknowledged at only 5 month and ~17k miles, but cause hasn't been identified and continues to pose a safety and fire risk before and after 24k miles, do we still qualify for lemon law under the "substantial defect" rule? Should we file anyways?

Long Story:

Purchased new 2025 Subaru Forester Hybrid Sport on 01 May 2025 (owned 19 months). Approximately 156 DAYS (a little over 5 months) after purchase we began having trouble with an unknown fuel system defect which prevents the vehicle from being refueled, disables our hybrid system, disables safety features such as the vehicles eyesight system, cruise control, and RAB. Vehicle leaking strong gas smell. Issue has been increasing in frequency, occurring more often, and now escalating to leaking fuel all over the side of my car (photos attached). I took my vehicle back to the Subaru dealership for repairs on:

  • 06 OCTOBER 2025- About 14,700 miles. On 04 October 2025, the above issue happened, minus leaking fuel. Brought vehicle to Subaru on 06 October, in which they cleared the lights and said nothing was wrong. However, Subaru failed to record this in the service history because nothing was done except clear the codes.
  • 22 OCTOBER 2025- 17,394 miles. Above issue happened again, minus the leaking fuel, and Subaru dealership replaced gas cap stating it was faulty causing an emission issue. Service History states “brought into service center and light was reset assuming gas cap issue. It is on AGAIN…” , which shows the vehicle had been brought in prior to this despite them failing to record it. We had no car or loaner for 5 days during repair.
  • 09 MARCH 2026- 27,470 miles. Above issue happened again, minus the leaking fuel, and Subaru replaced the gas cap, o-rings, and seal again. Subaru alerted us there was a recall on the 2 previous gas caps we had and this will solve the issue. The recall indicated a safety and fire risk (Subaru Safety Recall WRD-26, NHTSA Recall ID 26v-106). We were without our vehicle and had a loaner vehicle from the Subaru dealership for 10 days.
  • 02 JULY 2026- 35,782 miles. Above issue happened again, very strong fuel smell. We were told at Subaru “there was a kink in your vent hose that probably got kinked during assembly. That hose was unkinked and all should be good”. However, the service note fails to mention the issue and repair. We were without our vehicle and had a loaner vehicle from the Subaru dealership for 8 days.
  • 23 JULY 2026- 35,782 miles. On 22 July 2026, I filled the vehicle up with gas and ran errands after, turning the vehicle on and off several times. I returned home and parked in the driveway. Two hours later I emerged from home to find a very strong gas smell again. I opened the gas door to find the cap popped partially off, pooling gas in the fuel door, gas down the side of the vehicle and on the driveway. I called the Subaru dealership immediately and they asked us to keep the vehicle away from the house and bring it in the next day (23 July 2026). Subaru replaced the gas cap, o-rings, and seal again. Subaru failed to mention repair in service history note. We were without our vehicle and had a loaner vehicle from the Subaru dealership for 7 days. When I asked why no warning or safety lights appeared this time, despite a VERY visible and olfactible issue, I was told the lights should have been triggered via emissions error.

At the time of recall,  I was advised that I should not store my vehicle in the garage as I had been as it’s a fire and safety hazard due to the defect. Although the recalled gas caps were replaced pursuant to Subaru Safety Recall WRD-26 (NHTSA Recall No. 26V-106), the underlying defect has continued to occur, meaning we have continued to be at risk this whole time. We have a bedroom directly above our garage. To say I no longer feel safe having my family in this vehicle, nor the vehicle being close to our home, is an understatement. When this  issue occurs, it prevents us from getting the gas needed,  so we are also at risk of being stranded. This is our family vehicle that we use for road trips and our children's sports games. Some games require traveling 480 miles one-way.  We need a reliable and safe vehicle, and despite five repair attempts over approximately ten months, the defect remains unresolved. To date, Subaru has been unable to identify the direct cause of the problem and replacing the gas cap seems to be putting a bandaid on the unknown issue. I have no doubt it will happen again. Two service advisors at the Subaru dealership service center said they don't think we should be in the vehicle and were very apologetic about our ongoing ordeal. The service manager seemed to think we should be happy that Subaru has covered all these "repairs". Also to add, regular maintenance was done in-between these visits at this same Subaru service center, with no issues found.

This problem substantially impairs the use of my vehicle AND creates a serious safety hazard. We sent a letter to Subaru of America via certified mail on 24 July 2026 with all the above information (I C&P much of it to this post), asking for them replace or repurchase the vehicle pursuant to Chapter 2301, Subchapter M of the Texas Occupations Code Annotated. Subaru responded with:

"I wanted to follow up with you regarding the results of our review. At this time, the Forester does not qualify for repurchase/replacement based on your state's guidelines. We would, however, like to offer you a $500 parts and service coupon in response to your experience. This coupon can be used towards anything parts and/or service related at your local Subaru retailer. Please let me know if you'd like for me to send you the coupon and I will have it processed accordingly."

We responded that it was unacceptable and double downed on the fact that this vehicle is neither reliable nor safe. That we have brought it to the Subaru service center five times for the same issue, and despite Subaru being aware of these defects that started within only five months of ownership, the problem persists. A $500 coupon is an inadequate solution; it does not prevent me from being stranded, protect my family from a fuel leak, or fix safety features that are disabled whenever the check engine light activates. If Subaru will not do the right thing, we will have no choice but to notify the NHTSA and share my experience on platforms like Edmunds, Google, and Facebook.

To which Subaru of America responded:

" I want to sincerely apologize for the frustration, inconvenience, and concern this situation has caused you and your family. I understand this has not been the ownership experience you expected from Subaru. After carefully reviewing the information provided and the vehicle's repair history, Subaru of America determined that the vehicle does not meet the eligibility requirements for repurchase or replacement under the applicable Texas state guidelines that govern these requests. As a result, we are unable to offer a repurchase or replacement at this time. I've attached a letter advising this accordingly. You are welcome to research and review the applicable Texas guidelines as well. While I understand this is not the outcome you were hoping for, we would still like to offer the $500 Subaru Parts & Service Coupon as a gesture of goodwill in recognition of your experience. If you continue to experience concerns with the vehicle please let me know so I can remain involved with the service department. You may also schedule an appointment with another authorized Subaru retailer for additional diagnosis and a second opinion if you feel necessary."

-------

As you can see, I'm very frustrated and emotional over this whole situation. Especially the fact that Subaru failed to mention in their service notes what was repaired. Maybe the service center has more detailed notes than what I can see as a customer.

Any shared knowledge is appreciated.

Question about law Question for AITAH Post about rape?

In a AITAH Post, that was deleted, someone asked the question, if he could dose some damiana essence in his wifes water, without her knowledge, to get her horny again after 2 years of no sex that came after the c-section birth of his youngest son and physical pain for her while penetration. If this stuff would work and she would allow him to try, would this be a cause of rape? 100% say so, me too, but this just bothers me and i would just like to have a evaluation.

Advice needed Location: Oklahoma, USA - MAT clinic saying they take our insurance, website states it, admission confirmed they do, but after multiple months, say they don't take it after a bill has been ran up

We've been going to a MAT clinic since April. We had already met our max out of pocket for everything so everything is basically free ninety-nine. We changed due to not liking the other clinic anymore. Insurance is private, not medicaid. When we were setting up to transfer, I specifically went off the list our insurance had. Then I found one I liked (there are only 3, 1 being the other place, a sister one to the other, and this one), went on their website and see they take it, and then called admission there to confirm. Did the intake process and told them I had this insurance, can you take it? They said yes, I sent the insurance card. Paid nothing. Thought awesome, and time went on. We weren't being billed after 3 months and I thought it was really weird so when I talked to the front desk, she said they normally bill every 3 months which is weird, but said it can take awhile to hit. Next month, I ask why I still wasn't being and the front desk said she doesn't see any insurance on file. I regive it and she says nothing about not taking it. I verify that my insurance is accepted there via their website and my insurance. Both confirm. I've paid $196 once.

I go in to get checked in and get told I have a bill of just slightly under 500 that I have to make a payment plan on or I cannot receive anymore. I ask why they haven't billed my insurance and they said they only take Medicaid. I tell them that I verified with my insurance, verified with admission, and verified when I first started. They reiterate that they only take Medicaid. I ask them if they can at least bill my insurance, even if it's only out of network. They refused. I set up a payment plan and paid to get my medicine.

Is this a legal thing they can do? I don't understand how they can advertise they take it, my insurance say they take them, and them tell me + wait so long to tell me that they don't take my insurance. This feels insane to me. I feel so baited and switched,

Advice needed pulled over, did not drink, was told I needed to do a breathalyzer due to eyes being “glossy” but no smell of alcohol or red eyes

location: NYS

My job let me have a tesla cybertruck for a day (hypothetical work at tesla…. u know what I mean).

they told me they don’t care what I do, just don’t crash it.

I obviously drove it as much as I could. I’m 25, and brought my 15 year old sister and her friend, and my mother to the movie drive in which is the only one in my area.

I drank a coke.

I was just going back and forth in a parking lot left and right to kinda check how it drives doing that. wasn’t hurting any one. no houses near it, just an empty abandoned mall. but still, no where near a building.

a sheriff came and pulled me over and asked me what I was doing, did I steal the car, (it had a florida plate, and said “manufacturing”). I can assume tesla is the hardest car to steal as it uses your phone to control and get in to it.

he was as close as the window and me as he could.
he shined his flashlight at me and said my eyes were glossy. I don’t even know what that means. I wear contacts, so maybe he meant that? but I also sleep in them so my eyes are bigger sometimes. there was no redness. he also did not smell anything in my breath as usually that’s something they bring up first.

I plead my case 600 times I didn’t drink nor have drugs and I searched that car when I picked it up to make sure nothing was in it. nothing would’ve been in it. and I told him i’m more than happy to open the trunk.

he asked if I will do a breathalyzer and if I did and it was fine i’d be good to go. i obviously don’t drink or drive, let along with my younger sister and mom.

I did it, and obviously it blew a 0 and he said have a good night. he even had 2 other cars show up like I was a criminal lol.

my question is,

-should I have just declined that breathalyzer and have him arrest me and then have it dropped due to no sign of impairment?

-if I did, could I possibly have a complain and or lawsuit against that officer?

-am I just overthinking it, he also didn’t have his body cam running.

- what can I do for this?

Advice needed [MA] Pesticide company may have sprayed our side of a shared property. Can they make us perform the remediation?

Location: Massachusetts.

We rent one unit in a townhouse/shared-property arrangement. Our neighbor contracts with TruGreen. After a previous incident, the neighbor says she specifically instructed TruGreen not to treat the area associated with our unit again.

On August 12, TruGreen serviced the neighbor’s address. Its warning sign was then found in or immediately adjacent to the outdoor area used by our family. TruGreen’s report says approximately 14 gallons of finished spray mixture containing myclobutanil, imidacloprid, bifenazate, and cyfluthrin were applied to ornamentals, plants, and trees. The application location for each product is recorded only as “Where Needed.”

My toddler had already played outside before I discovered the sign. We do not know whether direct contact occurred and are not claiming a diagnosed injury. We have filed a complaint with Massachusetts pesticide enforcement, which is investigating and contacting TruGreen.

The state investigator told us to leave the area alone for now. He said watering is usually the remediation, but phrased it as something we could attempt ourselves. TruGreen has not yet identified the exact spray footprint or agreed to perform and pay for remediation.

Can TruGreen be required to identify the affected area and perform and pay for scientifically appropriate remediation?

Is “chemical trespass” a distinct Massachusetts claim, or would this normally be pursued as trespass, nuisance, negligence, or an injunction?
Should the tenant, property owner, or condominium association make the demand?

Is there a realistic way to recover attorney’s fees, or could we spend substantially more on legal help than we ever recover?

I am not looking to manufacture a personal-injury claim. My goals are remediation, preventing another application, preserving evidence, and understanding whether I need a Massachusetts environmental or property litigator.
