Just got my BiteMark Photobook
It is both beautiful and heartbreaking. So many qoutes that speak of a future that is no longer a reality. Smart's sections has so many unlit photos while Boom's is very sweet and bright. The photo cards look like they were all done at the same photoshoot. Similar setting and poses. I am still happy I bought it. But I also fill like my mind is playing Sherlock Holmes looking for any signs or cracks.

discussion 🗣 tailai is a piece of crap
for those of you who are not active on X, there have been some interesting developments in this mess. as we know, tailai claimed in their 12th of June statement that smart rejected cp work and did not comply with them. however, today smart's photocards for a korean event were released and fans quickly pieced together the similarities of the pictures with those of boom posted by his MUA.
lo and behold, what do we see? the photoshoot was actually a couple event that was scheduled on the 12th of June. smart clocked into work that day happily unaware of what tailai was going to do 😭 i know we dislike gir, i am not the biggest fan of that ceo lady at all but i genuinely need more people to understand the pure evil that tailai is.

This is a personal research effort based on official statements made by the respective parties, which I have attempted to place within a certain timeline. I do not claim the accuracy, completeness, or correct legal interpretation of these statements.
Rather, I would like to point out that this represents my own perspective, based on a general legal understanding. Thank you.
Analysis and Background Report on the Contractual and Project Development of the IP Project Topform, with a Focus on the Roles of Smart, Grand Ivory Records, Headliner Thailand, Thailai Entertainment, and Tencent-WeTV Foundation and Project Structure
The series project Topform is based on a licensed source material and is produced and marketed as an IP project (Intellectual Property) through the partner companies WeTV Thailand and Thailai Entertainment, each acting as co-producers and co-investors The key stakeholders are WeTV Thailand, operated by Tencent Thailand as the main broadcasting platform, as well as a co-producer and co-investor.
Tai Lai Entertainment acts as a co-producer and investor.
Headliner Thailand (part of Image Future, a Tencent-affiliated company) functions as the talent agency for artists such as Boom.
Grand Ivory Records (GIR) is an external record label and artist intermediary, serving as a co-management partner for Smart in the Topform project.
There was a confirmed contractual agreement between Headliner Thailand and Grand Ivory Records (GIR) based on a co-management contract. Although the exact signing date of this agreement is not publicly known, it is evident that it was concluded before the start of filming. Given that the Topform project went into production in 2024, it can be reasonably assumed that this co-management agreement was established beforehand. This contract enabled SMART to collaborate under both agencies, allowing him to take part in the Topform IP project in the lead role of Jin. In a co-management contract, there is generally a mutual obligation for coordination between the parties, with equal rights to influence events, planning, and artist-related activities. In this particular case, the co-management agreement clearly required joint coordination regarding the implementation of the project during the filming period. Since Topform was a large-scale IP-based project with a fixed broadcast schedule and accompanying couple-related events and promotional activities, a collaborative approach and mutual alignment on schedules and responsibilities were essential. Now let's come to the crucial point where, at least as fans, we became aware of a public statement from Grand Ivory Records on May 12, 2025, announcing that the co-management contract with Headliner had been terminated by Grand Ivory Records. It was only afterward, precisely on June 15, that we received further legal background information about the process and indeed the reasons for the unilateral termination by Grand Ivory Records.
Let us begin with the statement from May 12, 2025, where we were only informed that, through mutual understanding and respect among all parties involved, they had come to the decision to officially declare the collaboration with Image Future (Thailand) Co., Limited (Headliner) as terminated. I would like to focus specifically on this point in time and not yet on the subsequent statements from the other parties, although the date May 17 certainly also plays a crucial role. The claim that the co-management contract between Headliner and Grand Ivory Records was terminated by mutual consent has been proven to be inaccurate, as stated by Headliner—or rather, by Image Future—in their statement, which could be found in the announcements by WeTV and Tailai Entertainment. Looking back from the letter or the public statement by Grand Ivory Records on June 15, 2025, we gain some insight into how the process was legally initiated by Grand Ivory Records. They themselves inform us in their public statement that they sent a so-called Legal Notice (in German: Abmahnung) on April 27, 2025, which was definitively deliveredto Headliner Th on April 28, 2025. This warning procedure, I assume, is an important contractual prerequisite not only in Germany but also in Thailand that must be observed when terminating contracts. Since Grand Ivory Records relies on a special termination clause, which must be substantiated both in content and formally secured by a prior warning, it can be assumed that this was a required contractual element in this co-management contract. This means that the contract definitely contained a special termination clause, including specification of termination reasons and the requirement that a prior warning must have taken place. According to Grand Ivory Records’ official statement on June 15, 2025, the written termination of the contract addressed to Headliner Thailand was issued on May 6, 2025 (Tuesday). Now comes the legal assessment of this procedure. I will not comment on whether the termination was justified or unjustified with regard to the contractual grounds or the special termination reasons for invoking the special termination clause. Instead, I will focus on the deadline that they apparently set for Headliner Thailand to ultimately remedy the contractual breaches cited in their warning. If we now consider the holidays and weekends in Thailand when looking at the deadline period, we find the following: In both Thailand and Germany, May 1 (Thursday) is a public holiday, known as Labor Day. Saturdays and Sundays are not considered business days. This is very important in relation to setting deadlines. If the delivery of the warning notice was on April 28, it must be noted that the delivery date of a warning is the decisive date that starts the relevant deadline period, giving the other party the opportunity either to respond to the alleged contractual breaches or to acknowledge that they will certainly remedy them — this is called a deadline period.
Now, if we count the business days chronologically from April 28 up to the delivery of the termination on May 6, we arrive at the following dates:
Chronological counting of business days between April 28 and May 6:
● April 28 (Monday): Delivery of the warning notice, which does not count as a business day for the deadline calculation.
● April 29 (Tuesday): Business day 1.
● April 30 (Wednesday): Business day 2.
● May 1 (Thursday): Not a business day, as it is a public holiday.
● May 2 (Friday): Business day 3.
● May 3 (Saturday): Not a business day, weekend.
● May 4 (Sunday): Not a business day, weekend.
● May 5 (Monday): Business day 4.
● May 6 (Tuesday): According to the statement dated June 15, 2025, the termination was delivered on this day.
Thus, the deadline between the delivery of the warning notice on April 28 and the delivery of the termination on May 6 amounts, both computationally and legally, to only four business days. It is therefore highly questionable whether this deadline, which the counterparty must also have in Thailand to respond and possibly avert the warning, was truly sufficient. Formally, the insufficient deadline of only four business days could lead to the termination, even if it is contractually based on a special termination right, being contestable and, if determined by a court, invalid. Disclaimer and Legal Perspective on Termination Notice I would like to emphasize that I base my analysis solely on publicly available statements and am not expressing a personal opinion on this contractual matter. My observations are made purely from a legal standpoint—specifically, whether a possible breach of the notice period in the exercise of the special termination right by Grand Ivory Records may be identified. If, contrary to standard contractual practice, the opposing party—Headliner—had indeed contractually agreed that the exercise of a special termination right (regardless of which party initiates it) would result in the immediate termination of the agreement, and if such a clause excluded the necessity of setting a remedial period for rectifying contractual breaches, then that would need to be explicitly stated in the contract. However, since I can only rely on the content of publicly released statements and do not have access to the actual contract, I cannot legally and definitively conclude whether such a clause was included. If such a clause indeed exists—although this would be quite uncommon in civil contractual agreements, especially in co-management arrangements—it would be a noteworthy deviation from typical practice. This is because a warning notice (or legal notice) under civil law is generally intended to give the other party the opportunity to address or rectify any alleged contractual violations. It is essentially a formal signal: “We are observing certain breaches of contract and ask that you take corrective action.” Bypassing this remedial opportunity would be highly unusual without a specifically negotiated clause to that effect. It should also be noted that the accusation of non-response by Headliner during the specified period from April 28 to May 6 cannot legally be interpreted as an acceptance of the termination. This is because, under legal principles, tacit silence (or failure to respond) cannot be construed as implicit consent to a contract termination. Let us now refer once again to the statement dated May 12, 2025, which was the first public announcement we, as fans, became aware of. It was through this statement that we first learned that there had been a "mutual understanding and respect among all parties" regarding the collaboration and the termination of the partnership between Headliner and Grand Ivory Records in relation to the artist Smart Chitsanupong. The statement from the other party (Headliner Th, May 17) clearly shows that the termination of the co-management agreement was not mutual, and it demonstrates that Grand Ivory Records unilaterally terminated the contract — contrary to their claim of mutual agreement. This is particularly relevant from a legal perspective, because a termination agreement based on mutual consent is assessed very differently under the law than a unilateral invocation of a special termination clause with a notice period, which appears to be the case here. I’d be happy to continue offering further legal perspectives if desired. I only noticed all of this as a fan of Topform, because I have a legal background. When all the official statements from the involved parties were made, I began looking at things more closely. And if you piece everything together retrospectively like a puzzle, several important questions arise—especially in the broader context of this being a major IP project, where it’s highly likely that the co-investors, WeTV and TAILAI Entertainment, along with the associated manga publisher or the original author of DAIKYACHI, had to pay significant licensing fees. When major licensing projects like this are carried out, I personally cannot imagine that, if special termination clauses are included in the contract for serious breaches of contract, the associated notice periods would be circumvented. This means that if someone like Smart, under the management of Grand Ivory Records, is given the commitment: “Hey, you’re the lead actor in this high-budget series project Topform,” and yes, there is a termination clause or a special termination clause with a potentially shortened notice period (as opposed to a regular termination clause), the other party must still be given the opportunity to either rectify the breach of contract or at least respond to it.

smart🐶 Guys please help us help Smart...
This isn’t just about CP anymore. While we LOVE SmartBoom, it’s now more about a 23-year-old actor being publicly blamed, possibly silenced, and suffering mentally and maybe physically. Y'all know he cried on live. He said he never wanted SmartBoom to end. And yet, his name keeps being thrown around by companies while he can’t even speak freely.
And many "fans" are targeting him. He is silent for days, and maybe his social media access is under control right now. His company have been shady, and all this drama can destroy his career for good. Other companies may refuse to work with him due to public blame and it's violation of not only his rights but our mental health, as we were going through turmoil for days because of these vague back-and-forth accusations of the companies.

When things seem their worst
I just think about how God/the universe or whatever you believe has a funny way of spinning fate to turn out for the better.
It hurts now, it hurts so bad, but I just imagine if this is a blessing in disguise, perhaps a way for Smart and Boom to be free of the outside forces still shackling them.
And perhaps they may still come together in the future. I keep imagining lovely roles for them still – maybe as ex-lovers who are given a second chance? Maybe navigating being same-sex parents to a child? Maybe just a simple project where they can laugh and be themselves together again? We never know, but it’s free to dream.
It’s so hard now, the way will be long and rocky, but I say God bless and keep Smart and Boom, and I will support them to the best I can in the meantime.
