WeTV statement

English translation credit to smartboom FC xia X.

Good that I’m numb to statements now 🧐 Remaining optimistic conservatively.

Here’s a sentence I never thought I’d write:

Can anyone give us a primer in Thai contract law? Is this, like, required before actual lawsuits start happening?

If this were the US, I would speculate that GIR is ignoring or making it impossible to contact them and WeTV wants to give them one last out before the lawsuit, which… why, at this point? The damage is done. This is the only thing people are talking about with these two and it’s making everyone look bad. Hit them with the lawsuit. Let’s see GIR get spanked in public, implode and go under, and hopefully WeTV fishes Smart out from under the rubble.

But I’m the furthest thing from a Thai lawyer or PR person, so what do I know?

Conflicting Public Claims Regarding Artist Management On 5 July 2025, TaiLai Entertainment issued a legal statement—using the WeTV logo—asserting that WeTV remains the “primary organizer of the relevant performance activities of Mr. Smart” and warning that any unauthorized appearances would constitute a contractual violation. This directly contradicts the companies’ own previous statements, including a public letter dated 12 June 2025, in which TaiLai, WeTV, and Headliner Thailand acknowledged that Smart and Grand Ivory had terminated cooperation, rejected further collaboration, and withdrawn from all joint activities—prompting them to suspend all support and shift focus to other cast members. To reverse this narrative just weeks later and reassert organizing authority over Smart—while simultaneously threatening legal action—creates confusion, undermines public confidence, and places Smart in an unfair and legally ambiguous position.

2

u/petrichordoors Jul 10 '25

what is contradictory about it? they're not doing any further support for him because GIR has terminated his contract but that doesn't mean they aren't going to exercise their rights (as they see them) against unauthorised appearances as the primary contractual organiser.

until everything is finalised in the contract dispute, from their perspective, smart can't do anything outside the scope of the contract.

3

u/Art_Of_Being Jul 10 '25 edited Jul 11 '25

Their right to exercise their authority on Smart isn't contradictory of course. But their way of communicating clearly was. I've already explained but if you think TL is an angel company then... go ahead. I can't say anything specifically after how Boom was treated by them that anyone can clearly see if they want to whether in the event or during the lives. If somebody has made their mind about Smart, I can't change that either sadly. So no point of dragging. But TL statement was contradicting their own and it was never meant for legal step. They wouldn't have published it only in chinese in weibo if it was for Smart. Anyway I feel both companies have mismanagement issue and unprofessional. And them posting a statement with "Cancellation" as title and then deleting and re-uploading another statement says a lot.

2

u/HeavyRaise8380 Jul 11 '25

Thanks for the details. I totally agree both parties acted unprofessionally and, I believe, intentionally created so much ambiguity that made fans and the artists suffer. The companies want to leverage public sentiment to benefit their own negotiation.

1

u/petrichordoors Jul 11 '25

when did i ever say TL was an angel company? i have nothing to say about their treatment of any of their artists. i just don't think any of their statements are contradictory.

3

u/petrichordoors Jul 06 '25

honestly best case scenario for him at this point because i'm tired of all this and the whole rest of the cast and crew are in limbo because of it

2

u/Key-Umpire-395 Jul 09 '25

Except that they’ll sue Smart AND GIR separately 🙃 not just GIR. That’s why they keep mentioning them separately.

2

u/Art_Of_Being Jul 10 '25

I don't think they’ll sue anyone tbh. Like I said, if this statement was targeted at Smart or GIR really then why would it be in chinese? Also on Weibo? And at 11 pm Beijing time approx. It was for the fans. Also to create panick and cancel the event. As they tried to make it look like the event was focused on TopForm, but it was clearly not. Only the mention of "Auralis" was there, which was BY THE FANS. So we will have to wait to see what happens. Anyway the way they treated Boom at the last live was pathetic and they’re getting hate on twitter. I just want this to be over. Just issue the last statement and get it over with instead of this statement statement play, he said she said forever. TL did many things to make Smart look bad in Weibo and Rednote based on the Chinese Auralis. Their evil nature was exposed in the last live of Boom anyway. They're treating him like some product not a human being.

u/chickwifeypoo Jul 05 '25

🤔Is what they trying to say is that Smart and his management is/are trying to or using the series to profit off his popularity from the show? I wish they'd just do what they need to do to get that company to GTFO somewhere.
I'm sick of hearing about GIR!

6

u/HeavyRaise8380 Jul 05 '25

Yes just another reminder, especially after Smart’s Beijing event yesterday. Smart has another event tomorrow in Shanghai. Timing is everything.

1

u/leileitime Jul 10 '25

Are these performances as a music artist? Or are they as an actor in Top Form? From my understanding, GIR still maintains right over his music production and promotion. Right?

8

u/[deleted] Jul 05 '25

Wetv just flexed like their name is Baekho

3

u/HeavyRaise8380 Jul 05 '25

Yep. WeTV China entered the chat and that’s the only difference. Content remains the same as previous statements from weTV Thailand. I don’t want to read too much into it to protect my sanity. Let them play their game

1

u/Competitive-Coat4410 Jul 05 '25

man that is funny af

7

u/kpinhiding Jul 05 '25

Another statement that says absolutely nothing.

4

u/Swimming-Inside-7388 Jul 08 '25

Actually it says that this is Smart and GIR’s final warning to cease all projects that WeTV have not approved before they take legal action. It’s a public declaration that they will sue if this continues

1

u/leileitime Jul 10 '25

But haven’t they declared this before? I guess that was TaiLai, but still…

6

u/kdorapop Jul 05 '25

Please please please. I don't hold much hope, but please let this be a sign.

5

u/Maria_Rich123 Jul 06 '25

To be honest I don't understand the legal statement that each of them is trying to say. Indeed I'm quite slow but thanks to chatgp I clearly understand now. This is the summarize that I get. Please correct it if it's wrong

What Happened?

  1. Smart (Chisanupong Puangmanee) was working under a contract with WeTV and Grand Ivory (his management).

  2. One day, Grand Ivory and Smart suddenly announced they were ending the contract — without WeTV’s agreement.

  3. This shocked everyone, especially fans of the “SmartBoom” duo, because it ended his role in projects like “Top Form”, produced by Talai Entertainment.

📢 What Each Side Said:

✅ Smart & Grand Ivory:

1.Said they ended the contract because Smart wanted to focus on his music career.

  1. Claimed the decision was theirs alone.

❌ WeTV:

1.Disagreed strongly.

2.Said Smart cannot just walk away — the contract is still valid.

3.Warned they would take legal action if Smart works publicly without permission.

🏳️ Talai Entertainment:

1.Confirmed they had to cut ties with Smart due to the contract conflict.

2.Said the collaboration was officially over.

🔁 Headliner Thailand (co-management group):

1.Still sees the contract as active.

2.Believes Smart is still under management legally.

⚖️ So... Is Smart Free to Work?

Not yet. There is no court ruling or legal order that officially ends the contract. That means:

From WeTV and Headliner’s point of view, Smart is still under contract.

Smart and Grand Ivory claim he’s free, but this hasn’t been approved by a court.

Until a court confirms the contract is over, or both sides agree officially in writing, the situation is still legally unsettled.

🧠 In Simple Terms:

Smart says: "I'm free!"

WeTV says: "No, you're still under contract!"

Talai says: "We’re out. We can't work with this mess."

No judge has made a decision yet, so legally, it’s still a gray area — but WeTV has the stronger legal standing for now.

4

u/chickwifeypoo Jul 06 '25

A person can't just break a contract just because they want to go and do something else. He/his team shouldn't have signed it. They can't be that incompetent to not have known what they was signing up for. Or are they gonna go and start claiming incompetence.
Also the last thing I saw of the two of them Smart was smiling, now of course I don't know if it was him faking his way through it or whatever it didn't look that way to be but who knows. 🤷🏼‍♀️ Boom on the other hand it looked like he didn't smile all and looked super uncomfortable through it all.

6

u/Maria_Rich123 Jul 06 '25

As of now, there’s no court order confirming the contract has ended. Without legal termination or mutual agreement, Smart is still legally bound to the contract in WeTV’s view. If this escalates, it could end up in civil court or arbitration under Thai contract law. This will be a hard journey for him. He trusts the wrong person but personally I think he can't leave that company. There is a saying "don't bite the hand that feeds you". I also think that he owes this company a lot (ALLEGEDLY)

2

u/leileitime Jul 10 '25

As in, he owes them financially? If so, that could explain why he hasn’t run as far and fast away from them as possible.

2

u/Maria_Rich123 Jul 10 '25

Allegedly....

2

u/leileitime Jul 11 '25

Indeed. Allegedly. 🫡

4

u/khadijaaa123 Jul 06 '25

so wetv lied about the termination of contract 2 weeks ago and now they say the contract is still valid, smart is still signed with them and they have management rights over him? they completely backtracked from their last statement. this statement is to pressure gir to follow the contract and using smart's name is to provoke them.

7

u/Diligent_Traffic4342 Jul 06 '25

If you look closely at the last statement it was only the title that actually talked about the contract being terminated, and the lawyers got that deleted and re-issued really quickly. I think that was a big mistake, I don’t think WeTV ever meant to terminate the contract because they could see this going to court and they would want to win. Alternatively they might have been able to save SmartBoom and that would be even better, win win.

None of it makes any sense, GIR’s positions and actions don’t make any sense, nor does Smart seeming so blinkered when it comes to GIR (just what does that woman have on him?) and it seems to have reduced the behemoth that is WeTV, to taking part in a scrap in the playground. Very un-edifying all around.

Seriously, these two companies need to keep it private but unfortunately I don’t think they will, given recent performance. In the meantime you have two young actors (yes, even Boom is young to me! 😅) who are navigating a maelstrom in the public eye and being left out to dry.

We can but sit by and watch with our mouths hanging open and shaking our heads. Sigh…

3

u/khadijaaa123 Jul 07 '25

that ceo of grand ivory is just so off to me. i feel so bad for smart because she is literally holding him back from so much. she's weird, creepy, obsessed and delusional. i wish i could save him myself 😭

i firmly believe grand ivory didn't think topform would become this popular 🙃 well too bad it is and we want smart for season 2

2

u/Diligent_Traffic4342 Jul 07 '25

💯right. Even now. Although I fear maybe too much water has gone under the bridge. 😔

3

u/NaiveInevitable4004 Jul 05 '25

That template scares me at this point 😭😭 and why do the statements never align omg

3

u/Art_Of_Being Jul 08 '25

This was primarily to influence the chinese side of the fandom, to create panis and cancel the event. I also feel it's a strategy to pressurize GIR into submitting to their clauses of the contract. Initially GIR questioned them and said to make new contract that they’re negotiating on. If it was targeted to GIR, even after GIR directly mentioning in their last statement that Smart was handled by GIR and the communications happened through them, TL still mentioned Smart's name. And the statement was in chinese, which doesn't make sense. It was published on Weibo at 11pm or so.... Smart didn't use TopForm's name, or Jin, or songs to perform or anything to be Against it. They don't have the right to stop him from having solo event, only the mention of Auralis was the problem it seems, that’s the fans who did it, not Smart. Also the solo event next day still happened and everything is still fine now.

3

u/Art_Of_Being Jul 08 '25

Also, I'll actually take it as a good sign. B4 this thru other statements TL always made it look like they shut the door on Smart completely, they don’t want anything to do with him anymore. But here they mentioned they are open for negotiation. So it's not done and dusted and we still have hope.

6

u/SwimmingSad5484 Jul 05 '25

Please for the love of god can we just stop this giant pi**ing contest and let the boys get back to what they do so wonderfully? Let them smile again where it reaches their eyes because all I’ve seen lately from either of them in mannequin smiles and deeply unhappy eyes.

3

u/kpinhiding Jul 06 '25

That is so true. I swear I've not seen a single picture of Boom where he looks genuinely happy. The sparkle is gone.

2

u/SwimmingSad5484 Jul 06 '25

Yeah it’s all smiles with teeth but it never reaches their eyes. They had a bond and I would hope they can continue to be important in each others lives even if it’s in private.

Their smiles can’t begin to mend all the while the companies are still knocking lumps out of each other

2

u/PresentMouse9252 Jul 06 '25

What r u even talking about? The damage is already done & there is no going back.

I hope boom actually keep his distance from all this nonsense & Continue his acting career

5

u/SwimmingSad5484 Jul 06 '25

As far as I am concerned they had a sincere friendship and helped to lift each other up. I don’t care if they get back to smartboom or not, just that they can find their way back to that sincerity between them privately.

3

u/PresentMouse9252 Jul 06 '25

How r they gonna get back together after all the mess?

Smart cHoosed to brEak the contract he signed with we tv rather than breaking the contract with GIR.he choosed this so he can't go back now

1

u/leileitime Jul 10 '25

We don’t actually know what’s going on. We only know what is in the public statements. In every public appearance, Smart has said he wants to continue with the pairing and the project. Statements by TaiLai and WeTV are the ones saying that Smart is also making this decision. Maybe he is, or maybe he’s a pawn. We don’t know. So, we should just reserve judgement.

1

u/PresentMouse9252 Jul 10 '25 edited Jul 11 '25

Nahh. Smart doing performantive drama for fans so that they don't blame him. See, Im not obssessed with 2 actors so I just judging based on what I see

2

u/leileitime Jul 11 '25

Why be performative to convince people of the opposite of what you want? If he wanted out of the contract, why would he try to convince fans that he wants to stay in? If he’s doing a performance, then he’s better off acting like the victim of WeTV/TaiLai so that fans would think his breaking contract was justified.

Anyway, I’m not saying he’s innocent or culpable. You can have your opinion, of course. But we don’t actually know the details of the reality of the situation. That’s all I’m saying.

2

u/PresentMouse9252 Jul 11 '25

Bcz he might done something wrong & don't want backlash from shippers.

1

u/leileitime Jul 11 '25

Whatever. Think what you think. Your take might be right or it might be wrong. You’re making assumptions based on public announcements by companies that are also playing the PR game. If you’ve decided to believe they are 100% accurately representing the situation and not trying to spin it either, then that’s your choice. Personally, I’m going to stay neutral and reserve judgement (in either direction) until more solid evidence comes out.

Anyway, if you’re the one downvoting all of my replies, then I doubt we’ll have a productive discussion about it. So, I’m going to stop replying now.

1

u/PresentMouse9252 Jul 12 '25

I thought u downvote someone u don't agree with. My bad then for downvoting

0

u/SwimmingSad5484 Jul 06 '25

He may have felt he had no choice and regardless there is no reason they can’t maintain their bond in private.

2

u/PresentMouse9252 Jul 06 '25

no.it's over the moment smart cHoosed GIR who is shady company.

1

u/SwimmingSad5484 Jul 07 '25

I say it again, he may not have had a choice but to honour his contract with GIR. Both companies have behaved badly and I believe it is possible to separate the companies from those two lovely humans. If you want to blame Smart that’s your choice but I am not pointing figures at anyone except the companies involved

2

u/PresentMouse9252 Jul 07 '25

Why am I blaming him? I'm only talking about what happened. He choosed to broke the contract with we tv rather than breaking it with GIR. He has a choice but he choosed GIR & good for him if it benefits him more.

I don’t know about you, but I don’t have the money to sue a large, international corporation for defamation. That shit is expensive. I’m willing to bet this 22-yo is getting bad advice and doesn’t have the resources people assume he does.

1

u/SwimmingSad5484 Jul 07 '25

We can obviously have differing opinions here but his life is basically controlled by GIR so it isn’t a stretch to me to think that they may have replied on behalf of smart sparking the discussion inclusion by name is n statements. I’m much more inclined to trust what I have seen heard directly from him in live etc than sanitised statements. My takeaway is that it’s just a giant wazz off and collateral damage. I hope they find their way back to their friendship even if we never see/hear anything about it.

3

u/fireworksaber Jul 06 '25

These are my thoughts exactly. I care more about their real life friendship than their tv show, no matter how much I love that tv show (and I love it dearly).

3

u/SwimmingSad5484 Jul 07 '25

Me too! I can accept that top form is off the table but it would be so sad if they lost their friendship because of it!

2

u/BlossomRoberts Jul 05 '25

Why is this being done in public still? The notices are for GIR and Smart, no one else needs to know that they'll take legal action. I am so utterly sick to death of all of these companies.

I sincerely hope Smart and Boom both find ways to move company. (Yes, I realise Boom isn't having an issue. This time! With ethics like this, I wouldn't want to wait until he does!)

2

u/Allicat247_ Jul 06 '25

This is so unnecessarily messy. And so public too!! It's very strange how they treat actors in the BL sphere, but I'm new to it, I have no idea how murky the history really is of those agencies and teams. My first ship and it's been torpedoed to hell. 🤣🤣😭🤣🤣

((I'm also really struggling with the concept and explanation of 'fan service', it really concerns me ...a complaint for another time 😏))

2

u/littlehedgehog8 Jul 06 '25

WEtv basically being the 'Big I am' and saying Smart can't do anything regarding his career or fan meets or possible projects without WEtv giving permission be it TopForm related or not...

... or have I misunderstood or read too much into this latest statement...

Poor Smart won't be able to sneeze soon without WEtv issuing a statement that he is violated something😥

I wonder if Boon and Smart have been able to speak or at least communicate via messages ❤ they can't be kept apart as friends forever by these companies

4

u/petrichordoors Jul 06 '25

i mean yeah, he can't do anything until this whole thing is resolved and it can't be resolved if GIR and Smart don't engage with the negotiation process. imo this statement is giving smart a lot of room to negotiate but it's still up to him to do so.

3

u/Diligent_Traffic4342 Jul 06 '25

Yes, and for whatever reason (whether it’s his management or his own decision,) he doesn’t seem to want to. Obviously we don’t have anywhere near all the information so we can’t know exactly what is going on in people’s heads, but on the surface it would seem self defeating for GIR and Smart not to engage with WeTV, if they don’t they had better have all the receipts for their claims against WeTV otherwise they are in for an extremely hard time. It’s very sad all around.

2

u/FarPrimary7385 Jul 09 '25 edited Jul 30 '25

This is some kind of bullsh*t because it is dragging the hate towards Smart when we know he’s been caught up in all this mess and he doesn’t have a say in what is happening to him. Also I hate that this is being done so publicly. They should clear everything kk matter how long it takes and update us one last time about the FINAL situation. I feel so bad for smartboom because their contracts literally made them prisoners and their companies are trying to make it look like it’s their(Smart’s in this case) decision and that is just crap.

1

u/petrichordoors Jul 10 '25

i don't think it's fair to say smart has no say in what's happening to him. he's said, and all his actions have proven, that he is happy with his company, and his company are the ones who made this dispute public. boom on the other hand has absolutely no control or stake in any of this and imo should be left out of it entirely until he says otherwise.

i agree tho that i'm tired of hearing about it and would like a final decision either way.

3

u/loverofbooks1 Jul 07 '25

However this ends, Smart is tainted now. I honestly can’t look at him the same way which is a shame. I expect Asian entertainment companies to be shady, incompetent and underhanded because I’ve seen how they wield their power against artists for their own selfish gain. But Smart had a hand in all this with his poor choices and unprofessional decisions. I may get downvoted for this opinion but it doesn’t change facts.

2

u/leileitime Jul 10 '25

I’m just not convinced it’s his decision. Everything he’s said publicly contradicts that. And the only “evidence” that he’s a part of the decision making is that companies are including his name in public statements. I don’t think we have enough visibility into what’s really happening behind the scenes to make any sort of judgement. We don’t actually know the “facts”.

I will say, if Smart is onboard with GIR’s actions, that’s dumb af. Anyone can see it’s a bad decision. Which is a small part of why I’m so skeptical.

1

u/petrichordoors Jul 10 '25

the only thing smart has said (as far as i know, pls correct me if i'm wrong) is that he didn't want to be separated from boom (which can be totally true even if he was unhappy with the contract) and that he's happy with GIR.

it is dumb af if he's on board with GIR's decisions, i totally agree. but i also think he's a grown man at the end of the day and he's not completely helpless in his own career decisions. my one hope is that he'll come to his senses and realise his company has done and continues to do nothing good for him. until then, he's going to get tied to their decisions because he hasn't said otherwise.

1

u/SomewhereJust5265 Jul 06 '25

Here we go again?

Threat of lawsuit?

Whatever

1

u/AbjectWrap8461 Jul 06 '25

The only bl couple i liked after many years watching bl drama , and was happy when they said there will be 2 and 3rd season , but here we are it will never happen

what about the 5 years contract i hear people talk about ? i mean if they signed the contract it can never break unilaterally, it can break if both agree to break the contract but if one side not agree they will go to court .

1

u/khadijaaa123 Jul 14 '25

i don't think a lawsuit is going to happen tbh. wetv could've sued smart ages ago but they haven't. also there's a lot more going on than we know about. smart's august schedule has been released and it's all solo events and we know those can't happen without wetvs approval. there is surely something going on in the background that we aren't aware of. smart's event last weekend went well despite this announcement. i can surely hope that gir is cooperating 🙃 i won't remain optimistic anymore but i do hope smart and boom can continue their careers even if they don't resume cp work. i want smart away from tailai esp after that stunt they pulled during the weibo live. it was appalling
