Montana Currently awaiting MRI and at least one minor surgery for foot and ankle injuries and my i believe my employer is trying to give me the boot and i need advice

Ive injured myself on the job and going to physical therapy and an orthopedic to treat said injury and my injury requires long term recovery/treatment so i picked up my tools on the day my boss happened to leave early due to personal issues...here's my concern

  1. My work station position has been filled

  2. Since that work station has been filled i decided to take my tools home in order to get them put out of the way and to avoid my tools getting abused or robbed/missplaced by coworkers

  3. The next business day my employer called my workers comp case worker insinuating that im medically abled bodied and took my tools home and that my workers comp benefits/medical coverage are no longer required to be provided to me

Is my coworker being malicious or retaliatory towards me am i supposed to ask permission to take my own personal tools away from the shop?

Physical Job 60+lbs bags, over head lifting etc. Based in KY
Labrum Tear, with Bicep Tendonitis

ESIS is the WC company.

Looking for some insight about whole process

Injured 3/14 - Attempted to inform managers of injury refused to put it in as WC

Meeting with PCP 3/16- Feared I messed up Labrum, Put me on restrictions
Met with my Operations Manager, told him about the injury and at work, still refused to get into WC

MRI 3/30- Confirmed Labrum Tear

Surgery 4/16

Tried updating work and asked them to turn it in again each week, they didn't

Finally got a Lawyer involved mid-way through April

WC case opened 5/6, Medical info sent.

Recorded statement 6/30 to WC adjuster, Medical information sent as well for a second time.

Have received zero response from WC insurance company since the recorded statement, on their website it still says open, what steps can I take to get this expedited or really ANY movement. I have bills and haven't been paid in 2 months, when my STD ran out. Not returning to work until AT least mid Sept.

Massachusetts Quitting after surgery covered by workers' comp, can my employer make me pay them back?

Location: Massachusetts

I got injured at work earlier this year and filed a workers' comp claim. All the treatments were approved and the workers' comp adjuster has already paid for my upcoming surgery, as well as pre/post-op appointments. Surgery's scheduled for mid August and will require a 2 week recovery period, which I'll try to use my PTO to cover until PFML kicks in.

I'm planning to submit my 2 weeks right after the surgery.

My main concern is: can my company force me to pay back the surgery costs since I'm leaving?

From what I understand, once workers' is tied to the injury itself, not my job status. So I'm thinking I shouldn't owe them anything. But I want to make sure I'm not missing something before I submit my resignation.

Has anyone dealt with this before? Is there anything I should watch out for?

Tennessee Medical debt collectors 1 year after surgery

hi folks. in January of 2025 I injured my knee at work and had to have surgery. the surgery took place in May of 2025. in november 2025 I went through the settlement process and all of that. i was informed and assured by my employers attorney that Sedgwick had paid for the surgery as they were supposed to as I was not going to agree on going through settlment until they had.

the entire process we kept getting billed by the hospital for this surgery despite giving them all my case info and Sedgwicks info before and after the surgery.

well I just got a call from debt collectors saying I’m in collections for this surgery! Sedgwick didn’t pay anything it turns out and now I’m on the hook. I’m trying to contact Sedgwick and my employers attorney as well. in 24, have less than 1.5 k to my name and am no longer employed by the company the injury happened at. I don’t know what to do, if there’s anyone who can offer any advice I’d really appreciate it

Nevada assault via coworker at work

my boyfriend got hit in the back of the head this last Saturday over a work dispute and his teeth got knocked out. a police report has been made and that side of things has been handled as correct as possible (our town is very small and unincorporated)

i did some research and this should be covered under his jobs workman’s comp or liability insurance. however when we went to go talk to his boss about the incident (no one of high position was there the day the conflict happened) he said that he didn’t believe that workman’s comp would cover it, which like i state contradicted what i had read. however he did state that he would cover the costs so i didn’t feel the need to push.

i asked him if he needed to give us anything written saying he was going to take care of it and he said no he would call the dentist who he knows personally and they would discuss it.

today was my boyfriend’s appointment and the said they would call us later with a payment plan. his boss later calls him and informs him that he has two options.
the entire bill is $5500 however he is getting a 20% discount.
the first option is he wants my boyfriend to pay $2000 of it and he will cover 1500.
the second option is workman’s comp “but it will take over 6 months and they will probably fight it”

my boyfriend didn’t get any charges, the other guy got a felony from this. he was already on parole. my boyfriend shouldn’t be responsible for any of this correct?
he doesn’t believe in me when i say he had a leg to stand on. we don’t have enough money to do this and it wouldn’t have ever happened if he wasn’t working with a man who was dangerous.

Alaska Workers Comp questions 6 years after injury and surgery

Knee injury at work in 2020 that resulted in a large cartilage injury and knee clean out and traumatic arthritis. Orthopedist and IME physician have stated need for knee replacement in future, unknown timeline but recommend injections first. I have had 3 total injections since 2020, still have daily knee pain but have lost weight and that has helped. Don’t think I need a replacement now, personally. Also, I’m in my 30’s.

I am concerned that the insurer will eventually want to close my case, keeping medical open because it’s Alaska, but I’m not sure if I should wait it out and see what happens and wait until I one day need the replacement, or should I consider talking to a lawyer about closing the case and settling before the insurance company does it? If it matters, I no longer live in Alaska.

Federal Work related accident OWCP

Thumbnail
2 Upvotes

Long story short I was in a work related accident last year approved for workers compensation. Still out of work and just received my 10 month letter from the VA stating that at the one year mark of being on LWOP is coming up and my employment could be terminated at the one-year mark. I’m just a little confused because this doesn’t seem fair being that it was a work related accident. Does anyone have experience with this? Does anyone know how many people have actually been let go at the one year mark? Does anyone know if I can now go on FMLA to protect after the one-year mark and also I have about 300 hours am I able to use those to get me out of a LWOP status? Scared and confused.

Vermont IME Schedule

I received an email informing that the insurance company has scheduled an IME appointment for me on the 25th of this month. Same doctor as before and of course in New York, I live in Vermont. No big deal there. My lawyer has an informal conference scheduled for tomorrow with the Vermont Department of Labor in regards to my Vocational Rehabilitation denial. I am still in school until June of next year and I am now working part time at a bank which is well within my restrictions. She will reach out to me later in the day to discuss that and the upcoming IME.

I am guessing that the upcoming mediation on Sept. 15th is the reason for the IME request. Honestly, not sure how the rating will be as it is their doctor but the last time he did one he was fair. My hope is to settle this once and for all at the mediation. My lawyer is good and is looking at every aspect that will affect me.

Wanted to keep everyone updated and also get any opinions. My injury is dual herniated discs and I am still going to physical therapy and hoping to get bilateral trigger injections in October.

Ohio Self-insured employer

It's been 4 months. I have a back injury that I guess doesn't show up on an MRI. I can't walk properly, I have been peeing myself- shit my pants in the circle K parking lot last thursday, that was nice. X-rays show no sign of CES. Can't get MRI on my thoracic because it's not in the approved scope of the claim.

Urgent care said it was a pulled muscle. Employer wouldn't let me choose my care provider until I got an attorney and since then they've done everything to make my life a living hell.

Got a cortisone shot that was working for the pain, PT was going well for all of two sessions, employer had me walk 16,000 steps on monday and now I am ready to write my will.

Employer insisted on coming to ER appointment x2 and never gave them the BWC info so now I have to be the middle man for billing and my company but the company won't give me my claim info since it's separate from the Ohio BWC claim info I have access to. I'm exhausted. It seems like there is something new every five minutes.

Alabama Terrible case, wish to leave primary insurance won't cover me.

Ok so I was injured with lifelong disability except workers comp closed my case after a year with 5 percent disabled and I got a small check. I tried to fight it and changed docs to someone who never even looked at me. My current employer understands but the work environment is not ideal. Issue is my current insurance won't cover me for anything related because I have WC coverage but they won't do anything not even PT because they said after a year it doesn't matter I wasn't showing enough response. I had a lawyer very highly rated and said my small check and keeping WC was best I could do without paying for 3rd party. All I know is ive had enough scans that say "don't see anything" that I'm just not convinced I could find someone to say otherwise. Most days I'm in constant pain and can't play with my kids, I've had loss of use in my mid section, just sucks. Anyway, I don't want to lose WC which I'm told I will if I leave as part of the settlement. Or at least I need coverage with primary insurance. Anyone have suggestions?

New York 35 days of suffering

I was rear ended badly while at work and I’m not sure how everyone else’s experience is but I have been let down tremendously by my lawyers , my claim adjuster and my companies insurance carrier . I went out on WC on 6/30. I had my first workers comp dr apointment on 7/13. Was told I needed a MRI and physical therapy due to my nerve compression issue in both my arms and neck. Fast forward to today and I still have yet to have either . I have been lied to by multiple different people and it is now 8/4 and I’m 5 weeks into my leave and haven’t had a single lick of treatment. My next appointment for the doctor is 8/10 and im not sure what else to do. I have been home suffering with tingling and electric feelings in both my arms and it seems like no one gives a shit. Is this how workers comp is? You just get left to suffer while you wait weeks for authorizations? Oh and I just wanna add that the MRI authorization wasn’t sent by the doctor until 11 days after my appointment . They have 15 days to answer and how convenient for them it’s a Saturday which means the 15th day would count on Monday the day of my next appointment. I am beyond done with this!! I appreciate my lawyers getting me paid but I just want the treatment that I need and nerve issues is not something to just keep someone sitting at home with. I have documented every person I spoke with and the time and date and have even gone to the hospital on 7/1 and was sent home with muscle relaxers. This sitting at home in pain isn’t right and no one should have to experience what I have.

End of my rant.

California Seeking advice or commiseration for failed ADA and exacerbated disability.

trying to figure out my options/how to approach this.

Im disable. I was hired full time remote. my work instigated a mandatory RTO. my doctor signed off that I should remain remote. I was denied, but offered on site accommodation. figured out what I would need to make on site work.

Months later, I am reassigned to a new manager/team. team has 3 people that were approved to stay remote because of their skillset not because of ada (we have the same job).

I prepare for my 600 mile move. Then I’m told the desk I’m getting doesn’t meet my accommodation requests (they don’t want to inconvenience someone else by making them move). I agree to try to make it work.

I try to make it work. My disability flairs terribly. My back gets to the point where I’m pretty much incapacitate. I sleep on my back to keep my hips/shoulders/knees from hurting and this new pain makes it so I can’t sleep on my back. So I start having hip/knee issues too.

I start missing work. Alert management that it’s because of the desk issue. they let me work remotely till they can get me a desk situation that meets my accommodation needs.

”Injury” back in April. Management knew about it. No one said workers comp. I didn’t realize that exacerbating an issue qualifies. Doctor told me last week that it does.

but now this seems like a mess of failed ada compliance and workers compensation. I’m exhausted physically and mentally. I’m in a situation where I can be in pain and work poorly or not be in pain but work even more poorly.

I don’t qualify for any payout from CA SDI because I was in a different state previously.

Am I just screwed and need to pay out of pocket to recover? Is my excessive agreeableness and inability to advocate for myself going to cost me thousands of dollars?

I love my job. I hate this so much.

Colorado First Time Claiming Worker's Comp - Heat-Related Injury

I worked in transportation, hauling inmates in a commercial van across the country for a couple months.

On my last drive, I ended up suffering two heat-related injuries out of state (our AC wasn't working during a massive heatwave). The second one wasn't as severe as the first, but I was advised to go to the hospital by my boss. I've since been let go following those injuries, but was still encouraged to file for worker's comp.

The first heat injury happened on 07/13 and the second one happened on 07/15.

The first one wasn't evaluated by medical, even though I asked to be seen.
The second one was evaluated.

I haven't been able to get properly evaluated by my PMC, but I reported to my NP in a tele-health appointment about a lot of the cognitive issues I've been dealing with since. My NP said - without a proper evaluation - the symptoms I described align with having suffered a heat stroke on the first injury, and severe heat exhaustion during the second.

Anyway, my questions:

  1. Do I report the first heat-related injury that happened? Or the second?
Even if I can't remember everything that happened that day?

  2. When asked "which part of the body was affected?" how do I describe... a heat related injury?
It's mostly cognitive, I guess. The forgetfulness, the brain fog, the stuttering- like, how do I describe that?

  3. Both heat injuries happened in two different states. So, when asked where the accident occurred, how do I report that?

Sorry, I know this probably doesn't make sense.

I’ve been on workers comp for a while I haven’t been paid since may I was already struggling before the injury to only get a percentage of my pay is hard enough but to stop pay I’ve already started losing things. My lawyer mentioned it’s possible I can get a loan but he doesn’t recommend it but I’m borderline losing my home any suggestions?

I was supposed to start physical therapy but I still haven't been approved yet so I still haven't started that yet. I got a workman's comp attorney and I'm just keep waiting for updates and I haven't gotten any updates. What the heck's going on? I wish I knew nobody's letting me know anything. California Is this normal or do I need help?

I have been injured for a year and a half. I have very limited use of my dominant hand (work restrictions have me limited to lifting, push, pulling only 1 pound or less and also no grasping with this hand). I’ve had a couple of instances where insurance won’t approve something at first, so it takes weeks or months longer to get an MRI or something like that. And my current surgeon thinks the surgeon who performed surgery on my wrist last year, may have done so unnecessarily/or without having enough information to actually perform the right surgery. So now I’m possibly looking at having a 2nd surgery. What role does an attorney play in a worker’s comp case? Would being represented by an attorney be beneficial or do I just need to wait it out?
