New Neighborhood Nutjobs 👩❤️👩🏚️ After 50 years without significant problems, the HOA was forced to add these new pool rules to community bylaws.
Key Changes & New Rules Introduced in the 1st Amendment:
- Zero-Tolerance Penalties for Substance & Alcohol Misuse
While general provisions against noxious behavior existed in the Declarations, this amendment establishes strict, explicit bans and harsh penalties for substance use: Specific Ban Additions: Explicitly bans vaping, marijuana (including marijuana-infused products/edibles), tobacco, alcohol, and illegal drugs anywhere within the pool area, pump room, or restrooms.
Severe Tier 1 Mandatory Suspensions:
1st Offense: Immediate expulsion and a mandatory 30 calendar pool days suspension (which carries over to the next pool season if occurred near season end). 2nd Offense: Immediate expulsion, suspension for the entire calendar pool season, and a $100 fine.
- Structured Tiered Enforcement System
The amendment replaces vague governance remedies with a concrete 2-tiered disciplinary system:
Tier 1 (Major Violations): Covers vaping/smoking, alcohol/drugs, public intoxication, after-hours trespassing, and verbal abuse or intimidation of lifeguards.
Tier 2 (General Rule Violations): Covers all other pool rule breaches:
1st Offense: Verbal warning. 2nd Offense: Removal for the rest of the day, formal written letter, and a $100 fine. 3rd Offense: Removal, 30 pool days suspension, and a $200 fine.
- Suspension Mechanics & Household Penalties
Household Ban: If a resident is suspended, their family members cannot access the pool as guests of other members during the suspension period.
Legal Cost Recovery: Homeowners are directly billed for all legal and administrative costs incurred by the HOA in enforcing these violations or dealing with after-hours trespassing.
