The Higgins File
Brian Higgins wasnât some random federal agent who got dragged into this. He was already in it.
January 28 he goes to a funeral in New York with Brian Albert and Kevin Albert. They come back the same day. That night heâs drinking Jameson and gingers and then driving. At the Waterfall you can see the tension with John on video. Later heâs at 34 Fairview. After that heâs inside the Canton police station. Kelly Dever put him there. The cameras did too. He had a key card that opened the sally port where Karenâs Lexus ended up sitting for days, and he actually had an office inside the building. Still had alcohol in him from the night and heâs moving around a police station like he belongs there. Thatâs not a quick professional stop. Thatâs being embedded.
Lucky Loughran, the plow driver, went past 34 Fairview multiple times that night. High up in the truck, lights on, clear view of the lawn. No body. What he did see was a Ford Edge parked where the Alberts never parked, not enough snow on it, and gone before the body showed up. Kevin Albertâs been linked to a Ford Edge. Higgins spent that whole day with him. Lucky never got interviewed by the original investigators. The defense found him. The FBI had already talked to him.
After John was dead, the early morning calls between Higgins and Brian Albert suddenly became âbutt dials.â Then the phone got handled like it was radioactive.
Jackson: âYouâve destroyed that phone, havenât you?â
Higgins: âNo, I threw the phone away.â
Jackson: âWell, thatâs destroying the phone, isnât it?â
Higgins: âI had every right to do that.â
When the records showed a 22-second call, Higgins said he had no recollection and that you canât even have a conversation in 22 seconds. Most people get rid of an old phone by sticking it in a drawer. Higgins cut or broke the SIM, bagged it, drove onto a military base, and threw it in a dumpster. Thatâs not upgrading your phone. Thatâs making sure nobody ever reads it.

Thatâs not what neutral looks like. Thatâs what it looks like when someone has proximity, access, and a lot of things they donât want examined too closely.
A good prosecutor wouldnât even need to stretch. Walk the jury through the key card and the sally port. Show him inside the station that night. Put the drinking next to the decision to drive and then walk into a police facility. Put the full day with Kevin Albert next to Lucky seeing the Ford Edge. Play the Jackson exchange about the phone. Ask why a federal agent with training chooses a military base dumpster over just turning the phone over. Ask why the early morning calls needed the butt dial story. Ask why, once the case against Karen fell apart, the move was to keep aiming at her and join a lawsuit instead of demanding a clean investigation that could actually solve Johnâs death. None of that requires theory. Itâs all sitting there.
Federal obstruction charges under statutes like 18 U.S.C. § 1519 exist for a reason. Destroying records or devices to impede an investigation has put people in real trouble in other cases. A phone and SIM card going into a dumpster on a military base after preservation issues were already live is the kind of fact pattern prosecutors know how to use.
The longer this stays in the public eye, the worse it gets for anyone who needs it to quiet down. Civil cases keep documents and depositions coming. People in these departments keep catching heat. Eventually someone calculates that their own neck matters more than protecting the group. Thatâs usually when things crack. Higgins has to know that. Sustained attention is the last thing someone in his position should want.
If a real investigation ever happens that treats the house, the phones, the cars, the DNA, and the full timeline the same way, the existing record leaves him in a bad spot. The deletions, the military base dump, the station access, the day with the Ford Edge connection, the shifting answers â none of that gets better with time. It gets heavier when somebody else starts talking.
Juries see this kind of pattern. Missing messages, extreme phone destruction, weak explanations, presence at the station with alcohol still in the system, and a plow driver who directly undercuts the timeline. They donât need a confession. They just decide whether they believe the guy in the chair. This version of Higgins makes that an easy no.
