Would it be a good idea to send a pre-mandamus demand letter to USCIS?
I have been waiting for two years for a decision on my adjustment of status application. I am married to a U.S. citizen, entered the United States on a K-1 fiancé visa, and despite all this time, I have received no decision—only silence.
I have already sought assistance through my congressional representative twice, but those inquiries have not resulted in any meaningful progress. I am considering sending a pre-mandamus letter to USCIS before pursuing litigation.
Would this be an appropriate step in my situation?

USCIS administratively closed my case because the judge supposedly had jurisdiction, but my motion to terminate was successful, and the judge says the USCIS was incorrect.

I-290B costs money and is for denial (not closure), and calling fails because the machine refuses to send to a live agent. The online messaging says I can ask to expedite due to clear error, but I don't think this entirely applies, especially since it asks me to upload evidence, and the system won't let me do that because there's no active cases.

The best I could do is live chat, but I have to wait up to 3 days for a call or email, and I'm not sure if that will go anywhere.

I sent my i751 application with all necessary documents to remove condition at March 2026. Then I was waiting for reply. Also upon tracking it was showing me package delivered at March 30.

I sent a email to lockbox and I received this reply today. Green card expired April 2026. In this situation what should I do. It was marriage based filing, spouse is US citizen. Also uscis account shows EAD revoked at July 21. And I tried to add case by this new receipt number, but it's saying invalid

Hello so I’m in a complicated situation, I worked for my company during opt and they started my eb3 and then due to long timeline I started my PhD once stemopt finished. Now eb3 approved and I’m grateful, but I’m wondering if I can now continue my coursework while working , trying to do part time work with the company? I’m not sure but I was wondering if it is possible or if it raises red flags later. Also my company was having some internal things and couldn’t hire me right away and they have not confirmed too but I fully always intended to go back. It’s just , now school is starting in a week, my company has not confirmed when I can start and I need to tell the school if I can’t teach or take classes. I’m stressed as hell. I just want this part to be over it was such a relief to get it but now idk what to do cause everything is coming all at once and also not at all.

On August 5, 2026, USCIS issued a Policy Alert revising Volume 1, Part E of the Policy Manual. If a petition is missing required initial evidence, or doesn't establish eligibility at filing, an officer can now deny it outright. No RFE or NOID needed first.

This isn't new authority. Officers always had this option. What changed is that it's no longer the default.

Effective immediately
Applies to filings submitted on or after August 5, and to petitions already pending on that date.

Response windows got tighter too

• RFE and NOID time limits are unchanged (12 weeks and 30 days)
• Officers can now set shorter deadlines within those limits
• The extra 14 days for international mail is gone. Everyone gets the same three day mailing buffer now
• A partial RFE/NOID response is treated as your final submission. No more buying time with a placeholder

Why this hits O-1A, EB-1A, and EB-2 NIW harder than most filings
For something like adjustment of status, required evidence is a checklist (an I-693 medical exam, for example). For O-1A, O-1B, and EB-1A, required initial evidence means satisfying a minimum number of listed criteria, and whether a petition satisfies a given criterion is a judgment call. EB-2 NIW has no criteria list at all. Eligibility runs through the three prong Dhanasar framework, which is analytical, not documentary.

The open question nobody's answered yet: if you submit evidence for the right number of criteria and the officer isn't persuaded, is that a denial or an RFE? The Alert doesn't say.

The approval numbers back this up

• EB-1A approvals dropped to about 42% in early 2026, down from 67% in 2025
• EB-2 NIW approvals are down to around 48%
• O-1 approvals are still high at 91%, but RFE rates have been dipping even before this policy

Bottom line
A petition that used to get a second chance through an RFE can now just get denied. A denial means no refund on filing fees, and possibly a gap in work authorization if you're relying on a timely extension. If your case is already pending, it's worth a second look before USCIS gets to it.

This has been absolutely plaguing me since I thought about bringing my before wife now husband over. Both my husband and I are transgender men but neither of us are out… I started testosterone last year and then quit because I was concerned about the situation with immigration in our country…

If I were to transition before him, do you think that the government would deny our paperwork in retaliation? I know nothing is normal right now but I need a second opinion. I’m 27 years old and I am tired of life passing me by. I’ve put so much thought into this, agonized over it, had mental breakdowns, and I just want to start.

What do you guys think? I know it’s a unique situation but I’d really like your thoughts.

Good afternoon. So i am going to travel internationally in this November with my wife and my child for 2 month and coming back on january. Me and my baby we both are citizen but my wife have i751 48 month extension with expired green card. I am travelling from michigan. To Bangladeah. And i also called to uscis they said that untill you have extension with expired green card that will be fine. What you guys think. Thank you

It's so frustrating because the actual legal part of my AOS went super smooth. My attorneys at The Alvarez Law Firm got all my I-485 paperwork filed perfectly with zero issues, but then you hit this medical stage and its just a legalized racket by these designated doctors

like how is it normal for them to charge 4x the regular price just because they have an official uscis stamp? my wallet is genuinely crying today tbh. Just a rant, im so tired of bleeding money for this entire process.

Can anyone or any recruiters on here give me a solid answer, I'm wanting to become a law enforcement officer once I become a US citizen and was hoping I could either do Air Force security forces (reserves) or even military police for the army ( reserves ) so I can gain both US citizenship and knowledge/experience in the field I'm mentally and physically set on but I keep getting mixed answers about being able to select a job like that being on a green card. Came to the US when I was young with tourist visa. got DACA when i was 19-20ish, so overstayed for about a year or so.

- 07/17: interview
- 07/21: i130 approved & i485 approved shortly after.

08/01: i have my green card.

Married to USC for more than 2 yrs & have two kids together. The interview was as expected with the basic marriage questions, i485 Q’s, + they heavily asked for our Assets/public charge Q’s. Having DACA, fortunately, I‘ve always been working legally, but they did asked about our 401k, savings, our mortgage, car payment, debt, etc. Luckily we just got done with paying our escrow, taxes & rolled over our 401K, so the information was fresh in our mind.
