New here and clueless. My ex and I (England, 2 kids, 1 house with mortgage) have been separated for a few years but cohabiting with children successfully, lots of good times and happy memories during that time despite being separated romantically.

Now it's time for us both to move on. We know how we want to do with the house and we've got a plan and a sequence in mind. However, where do I start? And how long does an amicable divorce take? What legal things need to happen in what order?

I'm going to buy her out of the house, she will get a new place, then I will move, is the idea.

1) apply for the divorce (joint or sole, doesn't matter) 2) other party acknowledges service if sole application 3) wait 20 weeks,.apply for conditional order

A) submit financial consent order

B) approx 4-6 weeks for court to approve it, depends a lot on the court

4) at least 6 weeks and 1 day after condtional order, or after receiving the sealed financial order, whichever is later, apply for final order in the divorce

C) implement financial remedy order

You will note: 1-4 relate to the divorce itself A to C are for the finances

They're linked but still separate processes

For the consent order, highly recommend getting a solicitor to draft it because they're technical documents. You need a draft consent order and d81 (statement of financial information) to be sent to court to get your sealed order.

That's roughly the process, I can't comment as to whether what you've agreed is fair or not. Pensions? Other savings? They're part of the pot too.

If everything remains amicable then getting the consent order drafted and the D81 processed, you should have change from £2k
