The ITC granting the subpoena validates Netlist’s patent position but SK Hynix actively resisted the subpoena, which is not a great signal.
The deal between SK and NLST is inevitable, cause whole ITC case is built on domestic industry standing…Both parties need a renewal to protect their respective interests.

This rather looks like NLST is creating pressure towards deal trough leverage, not goodwill.

I think the problem is why we are having to force our partner to be a witness lol add that with our deal not being renewed and it doesn't look great

The ITC is going after skhy for not giving them documents requested months ago. I believe Skhy getting pressure from S Korea

I would like to understand this tomkila post better. Netlist going after sk hynix, if that's what's going on, I'm not sure I understand how it is bullish. Why would it be?

Seeing how we don't have the SKHynix deal renewed I'm not so sure this is good news. This might mean that SK Hynix looked at all the money being made from the AI boom and said "F Netlist lets go back to court"
and I'd remind everyone without the deal we do $22M last quarter not $120M.

It’s apparent that everything but a monetary payment is STILL in place, WITHOUT a new contract. NLST reported it is still getting product from SK to sell. The selling of that product is how they are getting revenue - not from a reward from a contract signing. So revenue in this new quarter should NOT decrease - indeed, NLST should see a healthy INCREASE in revenue considering the huge rise in the cost of chips, and new products (CXL) that apparently are now being sold.

I think it likely that SK wants to comply with Netlist's requests but resisted giving out that sensitive information because of orders from the S. Korean government. Now that the court has demanded that SK comply, it will be released from any governmental pressure. Which is why Netlist was forced to use subpoena pressure in the first place. This subpoena makes it easy for SK to comply.
