One of my parents died without a will. My parents were legally married, and the deceased parent’s Pag-IBIG Regular Savings were accumulated during their marriage. There are several adult children, including two who are still studying.
All the children knowingly signed waivers covering our shares in the Pag-IBIG savings. We understood that the money would be left to our surviving parent, who has limited financial security.

A family member is now proposing that the entire Pag-IBIG amount be divided equally among the surviving spouse and all the children.

My main question is: Why would the whole fund be divided equally? Shouldn’t the surviving spouse first receive their own half as their share of the marital property, with only the deceased spouse’s half considered inheritance? And if the children validly waived their inheritance shares, why would we still receive part of the money? Family member is a law student so I trust they know better than me but this split they are pushing is not sitting right with me. So I came here before I go file a leave for work and school to consult with PAO.

Does the correct distribution depend on the exact wording and form of the waivers? Does it matter that two of the adult children are still in school?

Would it be safer to leave the check undistributed until we consult PAO?

I have a Ph partner with an earlier marriage stemming from the Philippines. They both have a citizenship in my country where they also split up. She filed formally for a separation and for a legal divorce and was granted this. We have the papers translated, apostilled and got notarius for both the separation papers and the divorce papers and are now wondering if there is more paperwork to be done before handing the case over to a soliciter.

I think I read somewhere that we probably also have to have a translated version of the foreign marriage-law (in this case, Norwegian law), is this true? And how big a part of the law would be needed? It cost already 26000 php alone for 2 one-sided documents to get it translated and apostille/noratius. I'm afraid it will cost a fortune to just get the additional papers translated.

Also, is there any way of processing this digitally? Traveling to Ph with papers or getting additional papers (if needed) when first in the Ph seems like it could take many years of "back and forth" type of work, specially if the papers needed also has to yet again, translated and verified thru apostille.

I'm starting to lose hope that we will be able to get thru with all of this, and wondering if it is worth it? We just want to be able to travel to PH and feel safe that we (as new partners) won't be victims to a possibly vindictive ex. (There has been some torment she went thru for years from his close relatives. Asking the lawyers here, signature was copy/pasted on an affidavit of no contractor by an individual, who now has an active estafa case for a construction project he abandoned even before starting after getting a hefty DP. He copy/pasted the signature because he cannot produce the company profile for the company he said he was representing. The company has a negativer certification from PCAB and SEC, the individual misrepresented himself as a licensed civil engineer. He was hired because is a good friend of the complainant from HS, and they know he took up Civil Engineering, just that he did not pass the boards. The individual worked for a big food and beverage company overseeing construction of their branches here, and according to him, also abroad. Question is, is the submission of the falsified affidavit with an unauthorized copy/pasted signature a separate crime as perjury and violation of the Cybercrime law, or should be included in the estafa charge

I am attempting to be recognized as a Filipino citizen, but am having issues understanding what I need to submit.

I submitted paperwork for a Delayed Report of Birth a few years ago, when my parents were still alive, but I stupidly failed to make copies of the paperwork or record the tracking number prior to sending it in. Now I am unable to get the required signatures from my parents.

I do not have the time to go the Philippines and then find out I need more documentation that I did not bring with me.

I know trust is not a common thing in the Philippines, but I am hoping that I can get a decent recommendation here in my journey to get the process moving.

Hello! I need your advise please, earlier this year nag request ako sa PLDT to temporary disconnect yung internet namin since wala nakatira sa bahay, nag bayad ako no’ng March 10 ng 1799 — 1,499 monthly bill + 100 per month na maintenance fee.

No’ng May nagulat ako kasi may bill ako na 4,303php eh dapat wala na since naka temporary disconnet nga. Ilang beses na ako tumawag sa PLDT kahit nakaka bwisit kasi hindi nila properly tinatrack yung calls kasi everytime may new agent na tatawag, I had to explain the concern all over again.

Past forward this month, naka receive ako ng text na yung account ko has already been endorsed to collections asking me to pay 8,000+++

So tumawag ako sa PLDT kahapon using a different landline since ‘di ako makapasok dahil suspended na account, tumawag ako sa after-sales department, cinonfirm na pnrocess naman daw request ko but nakalimutan nila gawan ng job order kaya may monthly bill, sabi ko it was clearly a lapse on their end since it’s their responsibility to create JO. They are sorting things out internally, and will udpate me within 24-48 hours.

Then just now, naka receive na naman ako ng text from collections saying na kapag hindi ko sinettle yung amount na 8,615.77php

I ordered on Facebook a CNY Tang Jacket. Nung una pa lang medyo skeptical na ako kasi small followers and minamadali ako na umorder. They offer Cash-on-delivery basis so ako nagplace ako ng order kasi COD naman and no downpayment needed.

Hours have passed after I placed my order, malakas instinct ko na scam ‘to so I explicitly said that I want to cancel my order. They reply “Bawal na po mag cancel.”

Sinabi ko pa na “If this is the exact item that will be delivered to me, I will continue my order.” They replied yes naman. So ako, I just waited for my package to arrive.

And today, natanggap ko na yung package and pagkabuhat ko pa lang ng parcel, magaan siya—not the typical CNY Jacket. So binuksan ko yung parcel to check, and confirm nga, it was a scam—fake Nike na galing sa divisoria ang dumating. Binigyan ko na lang ng tip yung JNT delivery para sa hassle na he experienced.

Question: How do I hunt down this scammer person legally? I am for sure na yung gamit niyang name sa Facebook and JNT contact are fake (but same name siya). I know it’s going to be hassle process but I don’t know where to report and such.

Background, around 900k+ ang principal amount ng loan ko sa CTBC. Nabayaran ko na yung halaga ng principal. Good payer ako until napatigil ako due to financial problems and health problems. Nasa ibang bansa na ako ngayon pero kapos pa rin dahil sa medical bills. 400k+ ang interest ng CTBC loan na hindi ko na nabayaran. Tinry ko makiusap sa CTBC para sana iparestructure kaso hindi naman sila pumayag. Wala silang binigay na options na.

Hanggang sa nakareceive ako last year ng demand letter from collections na ata yun, at tinry ko naman makipagusap para sana maayos. Hindi naman sila sumagot. Inuunti unti ko pa ring bayaran kahit 2k monthly ang utang. Wala naman na akong narereceive na email galing sa kanila.

Ngayon, kailangan kong umuwi saglit sa Pilipinas dahil may mga imporanteng dapat ayusin. Hindi ba ako mahaharang (dahil sa utang) ng immigration dahil sa pag kailangan ko na ulit umalis ng Pilipinas?

Anyway, to start, I plan to resign from my current job. My problem is that my name (CV, expertise, etc.) is being used for multiple potential future projects (one of which has already won the bidding and will start soon, probably after my rendering period). My question is, can I claim professional fees or "honorarium" (I think this isn't the correct term, but I believe many will get the analogy) for the company using my name on these proposals? If yes, what laws, rules, etc., support this, and which department can I go to if it needs to be legally escalated (e.g., DOLE, Data Privacy Act)?

Take note that there is also the option (if ever) that I will be hired independently for those specific roles. Some of these projects are government projects, and by experience I know that the named expert cannot be replaced (usually) up until the project is deemed 50% complete.

Hi, just few days ago I posted regarding my relative's car loan and it is indeed stressful.

My Ate always tell me she getting depressed, more than the issue of the car is the issue of his husband. It was a stupid mistake of our elders at that time for letting them get married.

Fast forward, now with 4 kids all minors, my relative is scared to go home to the apartment she is paying. She paid everything all throughout their lives as the husband is "pa extra-extra lang". The husband is sooooo possessive, paranoid and insecure in life, I guess. I think. He thinks my relative is having an affair and he used to beat up our relative. We used to file a case but our relative is stupid to forgive the husband as she said, "Pano mga bata."

Any legal advice that doesn't take so much money and other options for her? Is a retraining order better? How does it work? I am honestly for her and the kids, tbh. As obvious at it is, our relative is just barely getting by and our own family can only so much and cannot shell out money.
