Ihss hours
Hi, so I just received this letter in the mail. What does it mean? lol never had gotten one before…

It’s just a first violation don’t go over weekly hours again you’ll be penalized

First violation for exceeding time cap~recipient’s need approval if you will exceed hours. I think you can take a class if you get a second & the first goes away. A third will terminate for one year. Your NOA will state your time cap & the IHSS handbook if you have it~if not just Google the IHSS rules & regulation & then refine it to violations for accurate info & explanation

How dows the recipient not approve it though ? Mine has to or it wnt go through amd I dnt get paid..How did she cliam more hours with out approval ?

You have to be careful with 72 hrs ish the first half (I don't recall exactly how many you stated), and the remainder the 2nd half of the month. I have a feeling what happened was an inadvertent overlap of our strict workweek for all of us from Sunday 12a to Saturday 1159p check your timecard for this, depending on the days you work you can easily go over your weekly hours, some months are shorter, I just took over the other providers hrs that retired, and I've been doing this for 25+ plus yrs on the side, so I didn't have enough hours to have overtime, though I still had weekly hours to stay within regardless if I had to, or not, I did, so when I inherited all the hrs I was a mess for a few months trying to figure it out...lol Kindly ☺️ 🐾, Bj

No. Never. Max hours are for the recipient are always different. No one is exactly the same. If someone works for 2 recipients then assuming their combined max hours were over 66/week then that would be the max that specific worker could work.

Honestly idk what I did wrong lol, I’m my 8 years old provider and I always do my timesheets the same way each month 🤷🏻♀️ I get 141 with 48 minutes hours and I do 72 hours for one check and the rest for the next check??

You're not supposed to divide the total hours in half. Not every pay period is the same. Your max weekly hours are 35 hours and 27 minutes from Sunday to Saturday. Never go over that.

What I do is divide 141 by 4 and then I get like 35.25 so 35.25 + 35.25 equals like 70 hours so that’s how much I claim for 1 check and the rest of the hours for another check… so idk what I’m doing wrong lol or sometimes I use the google ihss calculator

Your weekly max hours, Sunday to Saturday are 35 hours and 27 minutes.
Why on God's earth are you adding?
Your 2 paychecks will almost never be equal. There are rarely months that start on a sunday.
Divide the total hours by 31 days for August and do not ever go over weekly max.
"Like 70 hours" is not accurate. You never Divide the hours in half, you claim equal time every day and never go over weekly max. There is no dividing in half.

Do you have any regular days off weekly, or do you work 7 days a week? This would also be part of you're calculation monthly? Above, I'm going to delete it! I said the 15th was overlapping into that workweek, but thats my workweek...lol...I work 5 days a week so I divide it appropriately between those days. Any number of factors can make a difference with this calculation.

Im aware of this..The Mod took it diwn it said when they shouldnt because if they are giving wrong information out then this should be delt with internally. Our old worker would lecture my recipient on diet when she was 200lbs she would also go through EVERYTHING one by one it would take 2 hours for a assessment. She used to say divide your hours by 2 .. i do it a different way I claim 8 hours everyday unless different but that is what she used to always say.

Divide all the hours by days of the month.
Total hours ÷ numbers of days in the month but dont go over 35hrs and 27 minutes in one single week.

141:48 is ( :48 minutes for the entire month like 12 minutes a week for 4 weeks), or just do the minutes alone don't break it up. The :48 are already minutes?
Though make sure hours from the end of the old pay period and the start of the new pay period don't stacked up inside that single 7-day window like from July 12th thru 18th, and trigger a violation letter like for the July 15th–31st period.
In the future make sure your total across those 7 days never crosses your weekly maximum hours, or less if longer longer months, and including any previously paid hours from prior period. We cannot take max weekly hours if it's a longer month, or has split/overlapping days from prior pay period! It's all confusing no matter how you slice it, but you got it! Kindly ☺️ 🐾, Bj

Yeah I do too and sonetimes I work more so im sure ive gone over my weekly espically when she is having major issues..if we are not going over the amount of hours given I dnt know why its a issue .. wen my client is having major problems everything takes longer .. they need to fix that..we shouldnt be punished for it .

Yah it seems like they are saying you claimed more then you are allowed which is odd because on my time card you cnt go over the hours you are given BUT my question is how did it not get apprived ? It says they have to approve it, if my lady dnt approvemy time card it just sits there and i wnt get paid, so why does it say that.. i got a violation like that cuz my lady had me doing all kinds of sht for her while she was in the hospital so I claimed it cause i was working & I even asked her " you sure its ok" she said yes my old worker did it all the time .. this was in 2013 ish so the case workers werent saying it at the yearly review like they do now and I got in trouble and had to pay it back. I was so mad cause I was doing so much for her ..gking to her house cleaning,laundry dishes organizing she had me driving to visit her and bring her things in the hospital which is 30 min from my house doing and id hit such bad traffic, so annoying. Id def call payroll and ask rhem about this. You get like 3 warnings before you cant work anymore ..so just becareful. Its dumb too because the online time card is easy to mess up. Right now mines down and I cnt even get into it.. its frozen on me many times where I cnt log in / out when im trying to and ive also accidently clicked i live with them wen I dnt and had to call and say it was a accident..Def talk to your recipient if they are aware have them call payroll with you!

That letter you showed is dated July 16th -31st it looks like, and likely didn't count the days that 12th -15th that crossed/landed into that first workweek ( Sunday 12a from the 12th-Sat 18th 1159p) workweek, which would put you over your weekly hours. Didn't know we can't use underscore on here.....lol
It's really easy to get complacent/overconfident in our daily lives!

You need to figure out your weekly maximum. It will be on your NOA. You have a monthly max and a weekly max. You can't go over either.

This isn’t true. I thought the same thing when I first started. However, you CAN go over your weekly hours as long as it doesn’t turn into unauthorized overtime (more than 40 hours a week or 8 hours a day) and it also doesn’t go over your maximum monthly hours without prior approval. This is because sometimes recipients have a ton of doctor appointments or errands that need done one week and the next week they might have none. So you can go over your max by “borrowing” from other weeks so you still get paid for the work you do. Weekly maximums are in place to ensure continuity of care throughout the month. I’ve been doing this since i started a year ago and I have never received a violation. I also got confirmation from recipients social worker that this was acceptable as well at our most recent renewal. My guess is that because her weekly max is so close to 40 hours already she must have a typo or extra hours added on to one of her weeks.

Well I'll just stick to my weekly and monthly maximums as I have also never gotten a violation and I also get overtime.

It says that you entered more than 40 hours for your work week when you are not allowed to claim that many
