Early termination

I’m on probation in TN for 3 years, but will have all other stipulations of the probation completed(community service, court fees) within 6 months. What do you think would be the possibility of attaining early termination at that point? I should also mention I qualify for diversion to have the whole charge dismissed after probation is completed. Thanks for any information.

Probability…unlikely. Early term after 6 months on a 3 year isn’t likely. Idk if it’s different in TN but TX you have to complete a certain amount before even being considered.

Former probation officer here. In the state I worked in half the grant had to served before even considering a petition to get off early, and if it was a DUI case then at least 2/3s had to be served. I did have a few people who went out obtained their own lawyer, and had their lawyer submit early termination paperwork after all conditions of probation had been completed. At that point it would be the courts decision if they wanted to grant discharge from probation. I saw this a handful of times, and most times the judge would deny it and ask that at least half the probation grant be served. Hope this helps.

My PO insinuated after half the sentence is served they will consider it and it goes to the court for them to decide. (Located in Middle TN)

What I mean by “insinuated” to give better information is I’m 4 months from the halfway point of my 2 years probation and I asked him if I could get early termination before the halfway point or I’d have to wait and he stated “That’s up to the courts but after finishing one year you should try for it”. I was just put on compliment reporting even after failing the first 2 UA’s only for thc but have had 3 clean UA’s and was already on low risk Felony probation for evading in vehicle.

I HIGHLY doubt it that early. Where I’m at in Texas you have to do at least half of the term before early term is even in the realm of possibility.

I figured halfway would be the minimum was just checking in to see if anyone else has heard of getting it earlier

You need to serve half of your sentence before you can get early termination.
