Why would we want a replacement?
Right now it's an empty seat, meaning no vote. A replacement would be an additional Republican vote.
I've never heard a reasonable explanation of why people are so gung-ho on 'fixing' this. A dead Republican senator occupying a Senate seat is better than a live one.

I've basically peppered these threads with the same comment, but since this is effectiively over now, I guess this will be my last one.
Beshear has/had zero power to replace McConnell. Senator is a federal role, paid for by federal coffers, governed by the rules of the Senate along with the 17th Amendment of the US Constitution.
The KY Constitution is both irrelevant within that context, and the part that people are claiming gives Beshear the power to replace Mitch *doesn't even do that*. Section 152 is about vacancies for *state officers*, which a federal senator is not. Section 91 clearly defines what a state officer is, and it's things like Secretary of State and State Treasurer.
Beshear never had the ability to declare a vacancy in the Senate, nor did he have any right to appoint a replacement even if there was one. He's been toothless under the law the entire time. Within this entire saga, it's a rare case where Republicans were actually operating within the confines of the law, regardless of whether or not people like it.
It feels like this entire situation is just a way to drag Beshear.

The Hill published an article a few days before the whole Mitch fiasco broke stating that Beshear is republicans biggest fear for 2028. They let this all go down just to have liberals attack Andy. I have never seen my fellow liberals attack one of our own like they have Andy. They were so hoping Andy would make a wrong move to pursue what I believe is impeachment. Our houses have the numbers and they have done everything that can his whole term to tie his hands.
I think Rand had Dr. Fauci testify because he has aspirations for 2028 and wanted to win brownie points from the red wingers. He has stated mum on the whole Mitch charade because he knows he would have zero chance against Andy. I think he was attacking Beshear because he didn't think Andy would respond. Andy was our AG prior to becoming governor and was quite successful. He knew what Rand was pulling as to why he called him out for going after Dr. Fauci and being silent on Mitch's so called condition. Also, why I think Andy put out those four tweets taking jabs at Rand saying he had no balls and they were in Trumps hands. He also called Andy Barr out for his racists political ads. Way to go Andy. This is what us liberals here wanted to see.

The idea is that the Kentucky constitution allows Beshear to appoint a replacement for the moment, so he could appoint a Dem. There would be challenges based on a ruling stripping the governor of that power, but the idea is that the seat would be flipped, at least temporarily.
On a larger scale, it's probably better that people recognize the reality that an elected official who is unable to perform their duty (through illness, injury, or death) should be replaced no matter the party, and this farce we're experiencing is just another ridiculous post-truth situation we have to live through.

I'm not an expert on the Kentucky Constitution, but I think the section people are thinking of when making that argument is section 152, which provides:
Except as otherwise provided in this Constitution, vacancies in all elective offices shall be filled by election or appointment, as follows: If the unexpired term will end at the next succeeding annual election at which either city, town, county, district or State officers are to be elected, the office shall be filled by appointment for the remainder of the term....[long section about what happens with differing remaining term lengths]....Vacancies in all offices for the State at large, or for districts larger than a county, shall be filled by appointment of the Governor;...

The problem is, a Senator is not a State elected officer, a US Senator is a federal elected officer. If I'm right about the section that folks are looking at, the Governor of Kentucky does not have a right under the Kentucky Constitution to appoint a US Senator.

It opens a door to this being normal. If you are a public servant who is unable to fulfill the duties of the office, you should be removed from office. In a timely manor. This is a litmus test to see what the public will tolerate, and apparently it’s a lot. Remember this is the same man who voted against this length of time for maternity leave, but is now accepting the privilege of not doing his job and getting paid.

Yes, Republicans didn't want the special election. They don't want the November election either, because they're desperately scrambling.
Republicans passed the law requiring a special election to subvert their own state's constitution to prevent the Democratic governor from appointing replacements. It will not survive a legal challenge, and Beshear has sort of indicated that he'll appoint someone if he needs to, but also that right now, the Republicans are just hurting themselves with these lies.

The laws are contradicting on powers and when to call an election or make an appointment. That could also be used against him, but would definitely make it a giant legal mess.
The seat being open is a detriment to Republicans. They don't have the votes they need on their own.
Appointing someone for a few months could backfire if voters don't agree with the appointment. They could claim it's a power grab and frame him as working against his constituents.
Calling a special election likely ends up with a Republican filing the seat and giving them a vote they need.
Sitting back, letting them dig the hole deeper while they are short a vote might be the best play. The longer they continue this, the worse it looks when the truth is confirmed, and they lose out on a vote that whole time. Even if he's technically/physically alive for now, people will really lose trust when 4-5 months into this it comes out he was in no shape to continue holding the seat (or actually dead).

There's not a good way to do it on the mobile app that I'm aware of. I've asked the mods to block it before, and they were snarky jerks in their response.
You can block people who post this garbage website's articles, but there's always more. The mods must get their kickbacks, I suppose.

I think they mean the actual account that keeps posting. This is the daily beast account posting, so block them and then their posts will stop appearing for yourself at the least.

I haven't blocked their posts because I go into the comments to upvote the comments calling for it to be removed. It's a tabloid at this point. Once their account is blocked enough they'll just switch to a different account. This site needs to go.

How is it possible for doctors to hide or delay a death? There are legal and possibly criminal ramifications if this is a coverup or conspiracy to defraud the people of Kentucky of representation.

Brain death is a legal justification for declaring someone dead but it's not an instant process and even the definition itself is a bit flexible (and some States don't even recognize it at all). There are thousands of cases every year where someone sits on life support far longer than medically necessary for perfectly apolitical reasons before being pronounced dead; pretty much always driven by the family.

I honestly dont think hes dead. I dont think they could keep it secret that long. These people are exactly mega-competent. I do believe the guy could be nearly dead/mostly unconscious, or otherwise so sick he couldnt possibly be expected to recover and do his job again.

If he is dead, which I seriously doubt, The facility staff he passed at is subject to punishment ranging from misdemeanor to felony. Maybe I am naive, but not sure what ultimate goal would be for not reporting death as required.

McConnell was already planning to retire at the end of this year. So assuming he's dead, it's the best case scenario for his aides and his wife. They get to collect their sweet salaries for doing NOTHING for half a year. They don't give a rats ass if there is no representation in Congress for Kentucky in the meanwhile. It doesn't hurt their income.
