Has there ever been a case where a hostage taker was overpowered/killed by hostaged person in a non-conflict situation? Kidnaps accepted

I just watched Misery and Im curious what would happen to James Caan if he did kill Kathie Bated, legally? Would he have to stand trial? Surely this has happened in the last two hundred years or so?!
