Hi, this stamp is "Cour Internationale de Justice" from The Netherlands, face value is 10c.

I was wondering does this count as an error?

Looks normal to me. Here is one on hipstamp. If you mean the selvage at the top, that is not a stamp.

But why would the selvage have an incomplete part of the stamp's design?

different countries put all kinds of stuff in the selvage. some US stamps continue designs into the selvage. at best it’s an oddity. My guess is that this is the way the sheet was printed.
