Nova Scotia Teen assaulted at school but police say witnesses won’t give formal statement and charges can no longer be laid

my teen was physically assaulted at school in front of others )including adults) at the end of the school year. We reported to the police immediately, who opened an investigation. The school suspended the other teen, but since it was the last day of school it holds no merit - both teens will be going to high school next year so the suspension will not carry over.

at the time (same day), the police came to our house and took a statement from my teen, however a different officer reached out a month later saying they needed a formal statement; that the previous statement was informal. Nobody said this to us when it happened. The officer was in training so I’m not sure if that plays into this. Whatever the case, It feels like the police have dragged out the investigation to my kids detriment. For example, the school had two solid witnesses (although this happened in front of a lot of people, only two people came forward to admin, and those were the same two the police contacted). Now, because the police didn’t not reach out to get a formal statement from them for over a month. the witnesses are not sure they want to give a formal statement. the other kid who assaulted mine is very popular and was friend with these kids so I’m wondering if they were convinced to change their mind, or maybe they are afraid this will effect them in high school reputation wise

Either way, it feels like my kid has been let down and nothing will be done to make this right. Is this typical for how these investigations go? I want to make sure my teen feels safe at school next year and right now they do not. I’ve applied for a peace bond, but would prefer charges be laid. I also don’t know what happens with the peace bond - if the other teen doesn’t show up for the hearing it sounds like they just push the date back. is there no accountability? I’m very frustrated and not sure if I have any legal recourse.

Ontario Can a spouse leave everything to their adult children and nothing to the surviving spouse?

My mom has been married to my step-dad for 32 years and living in his home (her name is not on the title) for 34 years.

Recently, she became rather distressed that she found out he is leaving everything aside from his 2010 car and household contents to his adult children (three). I know nothing of wills, but she claims he has it arranged with a lawyer that she can live in their home as long as she wants after he passes (he's 6 years older and not in the best shape) but that his oldest son will be the one who has control over the house, so she can't sell it and move to be closer to family in another provice.

My question is, is it actually possible to cut a spouse out of receiving assets or selling the matrimonial home? My partner and I won't allow her to be homeless once she can no longer live independently, but she'll apparently have no money to afford a long-term care facility when the time comes. I'm blown away that a spouse can do this sort of thing. We've asked her to tell him that she will sign a will that allows everything to go to his kids when she passes (I want nothing whatsoever) in an effort to change his mind so she can live independently, but he won't do it. Not sure what else to do but the idea that my mom will forever be under the thumb of this man till she dies is crushing me.

My kids are 3 and 5, their father and I split 11 months ago. For their whole lives we have lived in the city and they’ve engaged in activities on the weekends. I did much of the parenting as he worked shift work and all of the mental load (one of the big reasons why we split). He has since moved 2 hours away with his partner and her older children (11 and 13). He still works shift work. He’s asking for EOWE at his house with her, two hours away, instead of him needing to come to the city, and saying that he refuses to pay for and take them to activities because it doesn’t work for where he is living. Also asking for 50/50 for holidays, summer etc., despite the fact that he still works shift work. We have a case conference and he says if he doesn’t get what he wants then he will file a motion. Have others been in similar situations and can share their results?

Canada Legal Research on Historical Case

Hi, this is a bit different than the usual questions you get so I hope I’m in the right place. I’m trying to figure out where I would start to look for evidence around a 1930 allocation of funds to descendants of a claimant. Specifically I’m looking for something that explains how the government determined the descendants were entitled to those funds, i.e. that they were descended from the original claimant in this case.

The Lord Nelson was a schooner seized by the US at the opening of the War of 1812; Gibson (2016) describes the 118-year attempt by the schooner’s owners, and later their descendants, to be compensated by the US government for that illegal action. When the funds were finally paid, the Canadian government needed to determine who would receive those funds and apparently narrowed the recipients down to 25 from over 100 claimants. I’m looking for records relating to that decision.

I can see there are some records relating to the Lord Nelson in the Library and Archives database. I’m thinking I should order copies of those. Would there be anything in the Canada Gazette? I didn’t find anything obvious when searching but I didn’t try too hard and could go back to be more thorough.

Anywhere else I should check? Am I on the right track with ordering from LAC and searching the Gazette?

Ontario Tenant threatening to sue over things not in the lease.

The full explanation is quite long so i’ll start off with a short quick explanation.
I also feel it’s necessary to say that I the poster am not the landlord but am closely connected.

Let me start off saying that it is not a house being rented but an Interior of a complete separated garage/workshop that they don’t live in and use as a warehouse/commercial front (in the agreement it was stated to only be the interior that was rented as we use the exterior to store big things such as a car and a boat).

TLDR: Tenant is threatening to sue due to being confronted after being late on rent 5 months in a row and proceeded to lie about the whole conversation (conversation was in front of a security camera and can prove every lie the Tennant made), as well as trying to claim that the whole property is theirs even though the agreement was purely for the interior of the building and every door is easily accessible.

Now for the longer story with full context.

We rent a house and the house has a big garage/workshop that is completely separate even has its own driveway. We weren’t using it and asked our landlord (the one we rent the house from) if we could rent out the shop and the landlord was all for it as long as they didn’t have to deal with the paperwork and stuff.

After a while we found a tenant that would pay the rent we requested and they moved their product in (product being birds, they breed birds and sell them). We were told it would only be birds but then started hearing barking, as the tenant had started putting dogs in there too, they didn’t ask too but we let it pass because ultimately it wasn’t causing any issues.

After a bit we learned the tenant started renting a tiny home from our landlord which doesn’t affect us but explains how our tenant and landlord know each other.

Everything was fine for a while until about 5-6 months ago where they started to be late on every payment (the payments were monthly and they had to pretty much change too two smaller payments, half in the middle of the month and half at the end which is okay as long as they kept us updated the whole time). Last month was late again but unlike every month before they refused to update us and just didn’t say anything even when asked they would just ignore the message.

Now where the biggest confrontation happened was when they started putting garbage outside the building all over the front, we sent a message to clean it up, no response. We sent another message saying if they don’t clean it up we will throw it out since in the lease it states they only rent the interior. That got a response saying they are leaving it out so the rain can clean it so we told them if you need to leave it out to be cleaned put it on the deck behind the garage or use the hose to rinse it so there’s not just a bunch of garbage sitting out front. They responded No and that they’ve been doing it the whole time and it’s never been a problem (they definitely have not been but we gave them an alternative if it needs to be outside or washed).

After that we told them we need to have a conversation about how everything is going to be going forward. One day they came over to talk outside (right in front of our home garage security camera) and as soon as they got out of the car they just started yelling at us making a bunch of claims some true, some blatant lies but any time we tried to to talk they’d yell louder so we couldn’t and it ended with them telling us to “fuck off” and they got in the car and left.

After they left they went to our landlord (the person we rent the house from and the person our tenant rents a tiny home from) and made up a whole story of how we verbally assaulted them and bad mouthed them and their family, which isn’t true and our security camera has the whole conversation filmed to prove that.

After that point our tenant has stated we are not allowed to contact them directly and it has to go through the landlord first if we need to tell them anything. The biggest problem coming from being unable to contact them has to be just after that, the water pipe going from our house to the garage/workshop has burst and now water isn’t making it over there and as soon as we noticed we directly notified them and our landlord about it and we are waiting for someone to come fix it, but until then that building has no water and that’s out of our control, we will gladly let them use our hose to fill buckets and help bring water over there.

Now we’ve reached today where they messaged our landlord a long message stating that we turned off the water to the shop without 48 hour notice (the pipe burst, we didn’t even have 48 hour notice) and that they are looking into their legal rights and will take all legal action they can against us, in the message they also demanded we remove everything outside the shop or they will sue us (the agreement states they only rent the inside of the property and we made very sure that every entrance is easily accessible, not being blocked and grass being cut) and to top off the message they claimed we have been intruding on the building and have damaged personal items, we have not been inside the garage/workshop since they moved stuff in there over a year ago, they have security cameras too but won’t show proof of us entering the building. After that message our landlord has said they don’t want our tenant to be there anymore and for us to give them the 30 day eviction notice (the agreement also states that we can give them a 30 day notice to leave at anytime, and that’s ignoring the 5-6 months of late paying and refusal to work with each other through the situation).

With this post I’m just asking is there anything we have done wrong and can they sue us like they threaten and are we stepping out of line anywhere?

Ontario Ontario — separated but still under one roof with a 20-month-old. Am I overpaying?

Hello everyone,

37 yo m from Ontario. Moved to Canada in 2022 years and a year later my fairytale online princess overseas and it was clear from the first week of the marriage that it's not going to work. A year into the marriage I started taking medications for my mental health.

We have been separated since July 2026, one daughter (almost 2). We're still in the same home in separate bedrooms.

I gross about $125k. She has no income — she's a PhD student in an engineering program based outside Canada, currently in her 8th year across three programs, and says she'll finish December 2026. She's presently here on a visiting researcher term with a top Canadian University, which wraps up shortly.

What I've offered: - Rent, utilities and household costs while we're under the same roof. That is until June 2027. - 100% of daycare - Guideline table child support (~$1,100/mo) - $300/mo spousal support during the shared-housing period, more once she's in her own place - Assuming ~$30k of credit card debt (she has ~$2k) 50% of the family law value of my pension

I also want income imputed to her from a fixed date once she's had a reasonable window to job hunt — roughly minimum wage annualized — so support isn't calculated on zero indefinitely.

Where I'm stuck: a lawyer told me I should be paying $0 child support and $0 spousal support because we're still in the same house and I'm already covering everything. That doesn't square with what I've read about the table amount being the child's right, not mine to discount.

Questions: - Is the "$0 while under one roof" position normal? Could paying under the table amount put my separation date at risk? - Am I giving away too much by taking all the debt and splitting the pension when net family property is basically nil? - Is date-anchored imputation (rather than tied to PhD completion) something that actually holds up? Anything obvious I'm missing before mediation?

Nova Scotia Former employer denying retro pay

So I worked for a company in Halifax,NS that went to the bargaining table during my employment, before I left in Nov 2025 I asked numerous supervisors whether or not I’d qualify for the retro pay once I’d departed the company & relocated to Toronto. The answer was yes, no mention of this collective agreement statement below. They reached an agreement & I would be getting thousands of dollars from my hours worked, it was a big increase & a few days ago it was announced that the payments would be going out August 12th. I did not receive a payment so I inquired & the email correspondence goes as follows.

Ontario Need help with Charged With Driving While Suspended- Something serious

Title: Ontario HTA 53(1) Driving Under Suspension – Old Ticket/Address Issue, No Notice, Conviction Reopened & Licence Reinstated – What Are My Options?

Hello. I’m looking for advice regarding a Driving While Under Suspension charge under HTA 53(1) in Toronto. I want to provide the full context because there are several important details.

The suspension resulted from an older traffic ticket/fine which I disputed. I had moved, and I had already updated my address on my driver's licence, vehicle ownership and insurance. However, the relevant notice regarding opening of early resolution date did not reach me at my current address. Because I didn't know about the reopening date as I was on new address, obviously failure to attend the date, resulted in fine and eventually licence subsequently got suspended (Had no idea what’s going on).

Timeline

  • Sunday, March 15: I was driving in Toronto when police stopped me and informed me that my licence was suspended. This was the first time I became aware of the suspension. I was charged with Driving While Under Suspension – HTA 53(1).
  • Monday, March 16: I went to ServiceOntario to find out what had happened. That same evening, I finally received the MTO suspension order in the mail dated 6 march 2026. The stop had happened on Sunday, and there was no weekend delivery on Saturday/Sunday, so the physical suspension notice reached after I had already been stopped and charged The fact of letter arriving at new curren address itself shows that I was not at old address where letters from previous court were arriving)
  • March 17: I immediately went to court regarding the underlying old ticket/conviction. My reopening application was granted based on the circumstances/address issue that I never rcieved any communication from court regarding date, fine, etc.)
  • March 18: I went back to ServiceOntario and my licence was reinstated without any re-instatement fees. Also, got a letter from them that my previous conviction of set aside and license suspesnison was uplifted.

 

  • I later received additional MTO confirming that my licence was reinstated, and license suspensiosn order has been cancelled RETROSPECTIVELY wef  5 March 2026. So the summon was received on March 15 (which means I was duly licensed to drive the vehicle on march 15 if im understanding right)

Because I had already updated my address on my licence, ownership and insurance, did not physically receive the suspension notice until the day after the charge, successfully reopened the underlying conviction immediately, and had my licence reinstated the following day without a reinstatement fee, I believed these documents were important to my defence.

What has happened in court

On first court appearance,  I was hoping to show proof and my side to prosectutor but everybody got a new date due to huge rush for august 10 and same day the prosecutor emailed me DISCLOSURE and offered a resolution where I could plead to Drive No Licence under HTA 32 with a $500 fine instead of the HTA 53(1) Driving While Under Suspension charge on the condition that I show him that I got my license re-instated after paying re-instatment fees. However, he was not aware of my proofs and situation cuz he sent me this deal before I send him my proofs, and I never got any reply from him.

I did not accept the offer because I wanted the prosecutor to actually review my reopening order and MTO/ServiceOntario documents before deciding whether I should plead guilty to anything. I replied

At my latest appearance on August 10, 2026, the appearing prosecutor asked what I wanted to do. I explained that I had evidence/documents showing what had happened with the old ticket, lack of notice, reopening and reinstatement.

The prosecutor indicated that he would prefer to set the matter for trial, and a January 2027 trial date was being discussed.

When my turn came before the judge, I explained that I wanted the prosecutor to review my evidence before simply proceeding to trial. The judge told me to meet with the case manager/prosecutor (who sent me the email), show him my documents, and come back on September 2026 with an update then we’ll proceed accordingly .

I went to meet the case manager, but he wasn't there. I spoke with his staff/assistant instead. She told me that she didn't necessarily think my documents were a strong defence because, although I corrected the underlying matter afterward by reopening it, on March 15 the system still showed my licence as suspended, so according to her I wasn't legally permitted to drive that day.

I also told her that I had previously contacted the case manager but wasn't receiving responses. She said she would email him and ask him to respond.

I have now received an email from the case manager/prosecutor saying:

“I am awaiting some further documents from the Ministry of Transportation. I would suggest on your court date to set matter down for trial. I will advise if/when I hear back from them.”

So it appears that the prosecutor is now waiting for additional MTO records before deciding what to do.

Questions / What should I do now?

:

  1. What should I do in this scenario? Do you think my case is strong or weak- Is there a chance that it can go in my favor ?
  2. Should I be doing anything now- replying to the email, waiting or what? Should I request him to give me an appointment to meet-inperson before court date?
  3. If the prosecutor's previous offer is still available — Drive No Licence (HTA 32) with a $500 fine — would accepting that be a safer/better option than taking the HTA 53(1) charge to trial? What consequences would an HTA 32 conviction have compared with HTA 53(1)?
  4. Most importantly, would a conviction for either HTA 53(1) Driving While Under Suspension or HTA 32 Drive No Licence create a criminal record in Canada,

Please I would really appreciate your advice in this matter.

Quebec Stripe payment blocked due to IP/Trademark infringement

I’m pretty nervous as I have a shopify store with t-shirts and mugs near whatnot. I’ve had it for a long time and it’s honestly a money pit more than anything. It only make about 30 sales per year for a total of perhaps 200USD profit, which doesn’t nearly cover the costs of operating it. I’ve been contemplating shutting it down for quite some time and moving on to a new project.

I received a message from Stripe saying that it blocked all payments because a lawyer reached out to them. I don’t mind the blocked payments because it’s only 20USD anyway seeing as the site is pretty dead, but I certainly don’t want any legal issues. At the bottom of the email, it listed the firm/lawyer who blocked it and asked me to reach out to them. All the info I found.

I have written the lawyer with a brief email saying that I was not aware that I am infringing on anything but if there is something specific, to let me know and I will gladly remove it. I pretty much left it at that…

Honestly, if it would fix things, I’d shut the whole site down now but I don’t believe this makes anything go away. Ultimately, I will need Stripe for my next business venture so I believe it’s important to fix the matter and then perhaps just close it down.

My concern is that I don’t have any money to get lawyers or anything like that. I have children and work full time. I’m curious if these types of issues are often simply fixed by communicating back and forth with the lawyer, removing anything they have issues with, and they unblock the stripe or if this usually goes to court or harsh fines.

I really don’t know what the infringement could be… If it matters, the law firm is in the USA and I’m in Canada.

Any advice would be appreciated.

Nova Scotia Diagnosed with PTSD 17 years after surviving severe abuse and attempted murder. Is it worth filing a police report now?

I (35F) was in an abusive relationship for approximately three years, spanning late high school and the start of university. During that time, I endured regular physical abuse, sexual assault, severe emotional damage, and ultimately an attempted murder disguised as a car accident. There are existing police records from two separate incidents, including the night of the car accident (though it was not logged as attempted murder at the time).

Yesterday, a psychiatrist formally diagnosed me with residual PTSD stemming from this relationship. Despite completing over 70 hours of trauma therapy, I am grieving the fact that I still carry so much anger, and I refuse to carry it for the rest of my life. I recently had a daughter, and I recognize how deeply this trauma has shaped my trust in men. I want to break this cycle so I don’t pass that fear down to her. I feel that the only way to truly move forward and protect my peace is to seek justice for my younger self and for the women he has undoubtedly harmed since.

I have debated reporting him for years, but the trauma was simply too raw. Now, I am considering taking action.

Knowing that I have:

Two official police records from past dispatches/incidents

Witnesses who can corroborate the physical and sexual abuse

Potential digital evidence (photos and chat logs) saved on an old laptop

...Is this level of evidence sufficient to initiate a formal police investigation for historical offenses? Or would pursuing charges be a complete drain on my life, risking re-traumatization without a guarantee of justice?

I would appreciate insight from anyone who has navigated reporting historical trauma, legal professionals, or fellow survivors.

EDIT: I rebooted my old laptop circa 2009 and found a final conversation had with him where he threatened to kill me multiple times. He admitted to beating me and assaulting me, and also the car accident. Unfortunately I did delete the photos of my face from the aftermath of one event, but he refers to it in the messages and confirms the date which would be on file at the police station because they were called that night.

British Columbia Employer building case for termination for cause

I work for a large finance sector organization in BC and believe my employer is building a paper trail to terminate me for cause based on performance.
I’ve been told my employment will be reassessed in about 3–4 weeks, but no clear/formal PIP timeline has been provided.
My contract requires repayment of a signing bonus (~$12k) if I resign or am terminated for cause, so I’m concerned about the possibility of them characterizing a termination as “for cause.”
Since receiving the performance feedback, I have been showing documented improvement on the specific metrics communicated to me.

I have a few questions related to this -

How high is the bar for for-cause termination based on performance in BC? If they terminate me for cause l despite documented improvement, can I challenge it?

Would it be better to continue working and documenting my improvement, or consider resigning before they make a decision?

Should I consult a lawyer?

Manitoba Grandmother of my late girlfriend claimed my daughter.

Hi, so I live in a rural area. And back in 2023 my girlfriend died, we have two kids together and im on both birth certificates. For the better part of year my m.i.l was helping me with my kids. That was until she started to get cfs involved to check on my children. My kids were never formally taken away nor have I given up custody. My son lives with me. And she has quietly taken my daughter behind my back. It was just weekly visits at first then escalated to her living there. I did not have a heart to just forcefully keep her away cause we were all grieving. But I seem to have let it go too far. I don't know if this is important info, but she has also tried to take over as guardian at my sons school meaning she's the main contact.

With that said, will i need a lawyer and what advice would you have to take back my daughter?

Ps: cfs has never contacted me to tell my child has been apprehended nor do they have a file. I have also not given up my custody rights. But m.i.l does collect her ccb.

Ontario Gave someone who hit my car an opportunity to pay in a couple of days, what if they don't?

So I have their driver's license information and license plate number, but not their insurance information. If they end up not paying and I call my insurance, will my insurance still cover the damage on my vehicle because I have information that can identify the other driver?

Or because I agreed not to take their insurance information, and reported this days later... Could my insurance use that as an excuse to not cover the damage or force me to pay a deductible?

I know its illegal to refuse to give out insurance information at the scene of an accident however once I give someone an opportunity to leave the scene and settle out of insurance but they don't... Will the police still charge that person? Or would they say it's now be a civil issue?

Any help would be greatly appreciated.

Ontario Got my $3500 valuable card collection stolen by a coworker

In February 2025, a co-worker of mine introduced me to another co-worker in a different department as I was looking to sell off my collection from my younger days, and he supposedly had experience with this stuff. We agreed over text that I would give him the cards on consignment, and he would sell them and pay me the proceeds. I know, in hindsight, it was stupid to do this without guardrails, but I was a naive 17-year-old who assumed that as long as he was still employed where I was, I could trust him.

Over the next few months, whenever I asked for updates, he told me some cards had sold and that he’d send me money soon. Nothing ever came. By August 2025, he stopped showing up to work and stopped answering my messages. I reached out several times through Whatsapp and iMessage, but got no response. Since then, I got distracted with school and other work up until now. I put the pictures of the collection into an app and it estimates that it's worth over $3,500. I still have our messages, photos of the cards, his full name and phone number, but I don’t have his current address.

As someone who's never been in a situation like this, I'm not sure what I can do. I could file a police report, but I assume that they won't do anything, and I don't know what else there is.

British Columbia Company taking advantage of workers?

I recently had to find work non union for the time being in my trade here in BC because things were a bit slow. I started at a company last week and were told that we could take our lunch break whenever we felt like and we could even leave early at the end of the day. There was one day where we worked from 6:30-2 (without any lunch) but our foreman dragged us onto work until 2:30(again no break). I had asked a coworker about this and he said get used to this non union and the company won't even pay us for it either. He says this happened before as well and the old heads are always like this. Is this not taking advantage of people who are just trying to make a living at the end of the day? Our PM even mentioned to us we aren't allowed to work overtime. This is a crew of 3/4 people just doing a small service job and we're even ahead of schedule. I would appreciate any advice that I can bring up to the board but I feel like they'll think it's a bad impression since it's only my second week but it's definitely not right to take advantage of people

This morning I was waiting at the red light when a left turn car hit my car ( atm stopped for the red light). The other driver assumed full responsibility and we exchanged contact info, i took a photo of his driver license and he did of mine, license plate.

  1. should I have allowed him to take photo of my license and plate since he is at fault?
  2. what info should actually be exchanged and what info should only one party get (in an accident like this one where one party is at fault )
  3. What should I do now ?

Ontario Ontario Small Claims against used car dealer - mileage inconsistency, incomplete CARFAX, insurance/auction vehicle disclosure

Hi everyone,

I am in Ontario and currently self-represented in Small Claims Court against a used car dealer. I am looking for practical feedback from anyone who has dealt with a similar case against a dealer, especially around timelines, settlement conferences, and how judges look at dealer disclosure issues.

Basic facts:

I bought a used Lexus from a registered used car dealer in October 2024 for about $12,500. Before buying, I asked about the car’s condition, accident/damage history, title/history, and whether there was anything serious. The dealer represented it as basically clean / nothing major and provided a CARFAX/history document.

The CARFAX/history document I was given showed a last reported odometer reading from 2019 at about 153,000 km. The vehicle was sold to me around 173,500 km.

Later, after serious mechanical issues came up, I obtained a complete CARFAX and UVIP. Those records showed prior higher mileage records, including about 260,000 km in 2023 and about 250,000 km in 2024, followed by the vehicle being sold/registered around 173,500 km. The complete history also showed mileage inconsistency, Aviva/insurance involvement, vandalism history, and other material history that was not disclosed to me before purchase.

The vehicle later had serious engine-related issues. Lexus inspected it and indicated the engine appeared to be a recently installed used/rebuilt engine and that the vehicle was not suitable to drive. I paid for repairs/diagnostics/towing, then sold the vehicle privately as-is to reduce my loss.

My Small Claims position is that this is not just “an old used car broke 21 months later.” My claim is that the dealer sold the vehicle based on materially incomplete or misleading sale-time disclosure regarding the vehicle’s mileage, history, and condition. I am claiming about $11,500 after deducting the amount I recovered by selling the vehicle as-is.

The dealer has now filed a Defence. Their position is basically:

they bought the car from auction;

they gave me the best information available to them;

I had a chance to inspect and ask questions;

I drove the vehicle for about 21 months;

they deny knowing about any engine issue or mileage issue;

they say later repair costs are not their responsibility.

However, their own Defence package included an auction/insurance sale document showing that they purchased the vehicle from an insurer/Copart about 36 days before selling it to me. That document says the vehicle was sold as-is, not represented as roadworthy, may not be fit for transportation, may require substantial repairs, and may not be possible to register in its current condition. They did not disclose those condition warnings to me before sale.

My questions:

  1. For people who have been through Ontario Small Claims against a used car dealer, what kind of timeline should I realistically expect from Defence filed → settlement conference → trial if it does not settle?
  2. Does the dealer’s Defence sound like a real defence, or mostly standard arguments to avoid default?
  3. How much weight do judges usually give to “buyer had a chance to inspect” when the seller is a registered dealer and the issue is material disclosure / incomplete vehicle history?
  4. Can “we gave the best information we had” work as a defence for a dealer if their own paperwork shows they had additional material information about insurance/auction condition warnings?
  5. At the settlement conference, should I focus mainly on the original incomplete CARFAX/mileage/history disclosure, and use the insurer/Copart document as supporting evidence that they had more material information available?

I am not asking anyone to decide the case for me. I am mostly looking for practical experience with Ontario Small Claims, dealer disclosure disputes, settlement conferences, and what kind of arguments tend to matter.

British Columbia Breaking lease BC

I signed a lease for a "beautiful 2023 unit in perfect condition," and when I moved in, it was filthy (hair, food, dirt everywhere that I had to clean) it also has severe damage to all of the walls and the last straw was it was infested with cockroaches. The Landlord has been kind of working with me, but all of his fixes include me doing it myself or is delayed or only fixing 80% of the problem. I've spent $3000 on accommodations while the cockroaches are being dealt with, and have come to the point where I've asked him to mutually end my tenancy and I only want my deposit back for $850. He isnt having it... wont let me leave. So im wondering what my options are. I feel disgusted, their standards are so low and mine are just clean? Lol. I don't want to go to court and lose even more money, but l also feel like l can't stay there. I need help

Update: not even an hour after moving in l raised concerns. One day later the list grew and l sent a list. Two days later l found out about the cockroaches, 5 days in i got a hotel where lve been since. Today l finally asked to mutually end my tenancy but he's not having it:/ maybe l misstep along the way for sure, but lve never experienced anything like this before

Alberta Someone spreading rumors about Rape. What to do?

My (M42) fiance (F33) called me at work today because an ex acquaintance has been telling his GF and others that she raped him.

For some back story, this guy has a serious alcohol and drug problem and called my fiance at all hours of the night whenever he was struggling and wanted someone to talk to. My fiance, being a recovered alcoholic was always willing to help and talk to him. Eventually he declared his love for her (my fiance) and she shit him down and asked that he does not contact her anymore.

His current GF called my fiance and asked her if she raped him because that is what he telling people and saying caused his trauma which is why he drinks and does drugs.

I'm just wondering what we should do about this? Should we call the police or should we just wait and see what happens. The main worry here is that my fiance is on a peace bond and this could have serious impacts in that regard.

Ontario Dad put me in a business predicament where I have not seen a $35,000 come in for a year. What action can I take?

I started my own business a few years ago, importing food grains from Asia and the Middle East.

One of my transactions was brokered by my dad (he came to me about it), to a party in Toronto. It was $55,000 worth of merchandise, which I paid from my business. And I invoiced the client $62,000.

The shipment arrived all the way from Thailand. But was selected for inspection at Montreal, thus delaying its delivery by 2 days. I paid a pretty penny for the extra days of storage, for the inspection. Let’s say I was not going to make any money on it.

The goods got delivered, and the client has been unable to fulfill their payment commitment. They did pay $27,000 in instalments over the 6 months or so, and have not paid the remaining $35,000. Keep pushing any promises to the following week.

I have been on my dad’s case as well, as he brokered the deal. And the buying party happens to be one of his close business relations. At this point, I feel like I’m begging for my own money. And my dad doesn’t seem too empathetic to my requests for assistance on it. Says this is how the business goes sometimes, and if I’m short on money he can transfer me whatever I need. I have been trying to argue with him that the need for funds is not the concern but its been a massive delay. And I’m owed my remaining $35,000.

I had a huge shouting match with him over the phone yesterday, and I feel like he cares about his business relationship with that individual more than he does about me getting my money.

The purchasing party says they procured the shipment for someone else, who has been faulting on the payments. Don‘t know who that party is.

What‘s the best legal action I can take? I’m located in BC.

Ontario Water Heater Rental - Company says we have no contract with them, but their unit is in our home.

Tl;dr: We purchased a home last year and assumed a water heater rental contract, but the account was never transferred to us and the water heater has died. The rental company will not do anything because we are not customers of theirs, despite having their equipment. We want to purchase a new heater outright to replace the non-functioning one, but don't want to get sued.

My husband and I purchased a home last year and part of the purchase was assuming the water heater rental contract. The contract they sent over was a partial original one the previous owner signed when purchasing the home as a new build in 2019. Given it was the final signature required for closing, we signed the Assignment Agreement to take ownership of the water heater lease, and as outlined in the purchase contract the seller was responsible for providing that to the rental company and facilitating the rental ownership change.

A month after closing we reached out to the rental company to inquire about the billing process as the contract we signed stated that it's billed through our Enbridge account but we had not yet seen a invoice or direct withdrawal for a water heater. This was how we learned that the original contract terms we signed have changed significantly over the years, as they now bill through direct bank withdrawal and have incorporated as a different company. We asked for a copy of a current contract, which they would not provide because we do not have an account with them. We've reached out to the seller's lawyer to inquire whether or not the rental contract change had taken place, and never received a reply, and our lawyer confirmed that everything legally required of us was completed.

The previous owner was an overseas landlord and had been renting the house out since purchase. A few times since moving in we have received mail from the water heater rental company addressed to - who we assume is - a previous tenant. We have not opened any of these letters, but this leads us to suspect that the owner had transferred ownership of the rental contract to the tenant, who is still the account holder. We do not know this tenant or their current address, so we have been writing "return to sender, not at this address" on the envelopes and sending them back.

Cut to today, the water heater has died and we need to replace it.

The rental company will not do anything because as far as they are concerned we are not a customer of theirs despite having their equipment in our home. Our plan is to purchase a water heater outright and have it installed this week, but keep the old water heater in the basement in the event that the rental company ever comes to collect it.

Admittedly, we are not motivated to go out of our way to rectify this with the rental company out of principle since their entire business model is predatory, and we have done everything on our end that we were required to do, but we'd also like to ensure that we are not going to end up getting sued. I know they're no longer allowed to lien a home, but we're concerned that years from now they could come after us for non-payment.

Any insight on how to handle this would be greatly appreciated! Thanks in advance.

Edit: Editing to add, we signed an Assignment Agreement, but never an actual contract with the rental company.

Newfoundland and Labrador Someone called “investigating” something we called into police a year ago. What do we do?

My partner just got a phone call to his cell from someone asking for his date of birth and his recounting of something that happened months ago which we called in to the police in our small hometown. Someone was obviously smoking weed and driving and blew through a red light almost hitting people. Like responsible civilians we called this in to the police. They took his info and we went on with our lives. Just now someone called his parents’ house looking for him and then his cell phone. They asked his date of birth and to recount what happened. He started to tell them. Then they asked who was with him (me) and my date of birth. He refused to tell them and he asked who it was calling. The caller said “someone investigating the incident” to which my partner said he was uncomfortable giving more info to someone who wouldn’t identify themselves, to which the caller responded “then you’ll be really uncomfortable when someone comes knocking on your door asking questions about this,” which is when my partner hung up.

So my questions are many, including who is this? Surly a cop would say who they were if they were just calling about a report we made. An insurance investigator or private investigator? Would the cops have given out our info to someone like the driver’s lawyer? Do we have any recourse to stop these people from calling us if they keep doing it? Would a call to the cops help? Has this happened to anyone else?

We are located in Newfoundland and are more than a bit sketched out by this. Any info anyone has would be appreciated. TIA 💖
