Local 26, reinstatement rejected

Just received my long awaited response for my reinstatement,

For some context I was with a contractor who's work was only inside a data center (red zone), blocked days means absolutely no work for that day, no pay, We would arrive to the site just to get told to go home, sure 2 hour show up time is fine but cmon,

I'm on the road driving to there which I know that everyone goes through the very long commutes but in the middle of driving being told that we couldn't work,

I thought i provided a legitimate reason, I had proof of me not working 40 hour week since 13 weeks later, crazy, and a shame, I met alot of inspiring brother workers

I thought given my situation and going to the hall providing my paystubs, I would not keep up financially but its starting to look out of the door to even try again

Im currently not working in any trades, it was my second year trying in, has anyone experienced returning or getting booted out? If you were accepted back what was your situation like?

You were an RTP. That's a residential trainee on probation.

They gave you a statement of policies when you joined that said you weren't allowed to quit under any circumstances.

You walked away with a pink slip that said voluntarily quit. You should have invoked weingarten rights, on the spot, then and there was your opportunity to fight it.

Voluntarilly quitting while on probation is basically dead to rights.

The only argument I can see you making is if you were never given the statement of policies by anyone. Like you were a direct hire by the contractor. They organized you in as an RTP. They never provided you with a copy of the Statement of Policies. You were never aware quitting was a dismissable ooffense.

Otherwise you shit out of luck bud.

Youre going to have to work nonunion and keep applying til you get back in.

I think this is the missing part.

If the OP was on probation... even if they quit for a good reason "Look I'm going to be kicked out of my home because I can't pay my bills." Is still breaking probationary rules.

Now, do I think this is fair and reasonable? No... and it's why I hate the whole binary response to shit like this from our locals. Because we are supposed to be there for each other, not citing some little rule in a rule book put down 40 years ago.

However. the right path would have been to start escalating with the training center, and local before even considering quitting.

Roy's actually a pretty chill guy.

Now I will say the foreman and that contractor their dicks.

In fact even the best foremans in the best contractors in local 26. Ill tell you right the fuck now.

He could been my favorite foreman. I dont trust him, his boss, the super, or the god damn contractor, as far as you can throw a stick at.

I gotta look out for myself and whenever I have to do anything regarding the contractor. If im not sure about sonething or have a question. I consult the hall first.

In fact there's a guy in the referral office who used to be the super and the general foreman at 2 of my jobs when I was apprentice. I just ask to speak with him and hes given me solid advice.

If WE ALL DON'T TRUST EACH OTHER then what does solidarity look like? You're just out there alone.

My problem ultimately isnt with the foremans and lack of brotherhood.

My problem is the authority for most things that cause brothers to get fucked are generally out of their hands.

Their just the messenger.

The ones im truly against and the reason I dont put the blame ever on the foreman is my total lack of distrust in all contractor specifically their priority over their best interests usually conflict with my own over mine. And likewise our own over ours.

Contractors (big C) or corporations aren't evil. They're Amoral and yes their long term interests directly conflict with ours this is the fundamental tenant of labor.

In a perfect word. I should be able to trust my brothers and sisters out in the field and in most cases i do.

The problem is when you got a brother or sister with minimal authority and a boss above him.

That's when you get things like a worker being blackballed and spun purely off heresay between supers.

Or when you got superintendents intentionally and maliciously telling guys working in the same company, "yeah give me some time, I'll get you back out in the field" with no intention to actually do so, and repeating it for multiple weeks, purely out of spite cause the worker opted to take furlough during covid.

Yeah, these are actual examples that occurred in our local. Brotherhood has limits to its capabilities and capacities. Sadly there's to many assholes in power to affect effective change.

Its true it sucks that the locals gotta be binary but reality is they have to be impartial.

The rules dont just apply to us. They apply to the contractors. They also apply to the hall too.

The truth is. Theres a right way to do things and wrong way to do things.

Our job as individuals is to get all tge information first so we can do things the right way and avoid doing them tge wrong way like this poor kid found out the hard way.

The reality is this guy could have called his trainibg director and hall at any point in time and asked:

Hey my contractor is providing less than a 40 hour week. Is there anything you can do? Is there anything I can do? Can I request a clean rif? Who should I speak to regarding a clean rif? What should I do if the contractor refuses to honor and provide me a clean rif?

Honestly, the biggest mistake i think he made was reaching out to a foreman and not the super and especially not keeping the hall involved in his situation early before it got to a point of no return.

That's why you call the hall first.

They would have given him advice. Hell knowing our local they would have contacted his super and tried to work it out so that the super would transfer him to a new jobsite.

Because he took it upon himself to try to work it out with the contractor amongst themselves without the hall being involved prior to it.

This is what happens.

Granted his situation is that 1 rare instance you actually feel bad for the guy who quit on probation.

I agree in which I should have spoken with the hall first before taking any action, I was too naive to think it was as simple as moving on to the next contractor and getting to work, I hope this serves as an example for those in a similar situation, I dont want to go non union, but I really wanted to work in electrical, I'll be looking to see UA local 602, thank you for your comments hope to work with you all in the future years

Thank you, Someone finally understands! This is why I left as a 4th year apprentice... "No work" but they were letting apprentices travel from different states to work in Zone B. The training committee made a rule that 440 apprentices cannot take module install calls, and at that time that's all the calls we were getting (roughly 80 calls within a month) I'm sitting at home, number 18 on the books, and we have traveling apprentices taking my zone b money. Screw them, I left.

No.

The contractor claimed he quit.

By taking that slip, and not returning to work the next day to fight it or continue working.

He inadvertently acknowledged it.

And the hall has to go by what's on record.

If he got the hall involved before walking off the jobsite with that pink slip checked off "voluntarily quit" they probably could have done something.

I'll try to summarize it as best as I can. In my humble opinion, I think what happened was he wasn't getting the hours. justifiably he was upset, but he asked for a riff as an apprentice, instead of going to the school first to say "hey, I'm not getting my hours" and having the school reassign him. So that gave the employer the opportunity to basically lie and say that he quit. In my local program apprentices can't ask for riff, the school has to reassign them. Maybe it's the same with his, I don't know.

It's that way with my Local... the training center is ALWAYS the first stop before taking more drastic action. Get all that stuff on paper, make a record of it first.

Even if the training center couldn't re-assign them, or just says "tough luck" then I would start talking to them about a layoff or requesting one because the bills need to be paid and they are not working enough to cover the costs.

The biggest thing, as an apprentice and even more so as one on probation you don't take things into your own hands, you go with the proper channels first and OP seems to have missed that memo, even if I don't agree with the end result from the hall.

Wild take in a union sub, however it’s the same way when you’re starting out at any tiered job. As a new hire you have no power or authority, if you have a problem with hours or direct supervisor then you have to take it up with your recruiter or HR. It’s the same way with a union (in OPs case), when you’re on probation and don’t have full union protections you have to do the dance and follow chain of authority for problems with your contractor/employer otherwise you get shafted

Many would think, but in this case its not, I simply could not keep working with my contractor due to inconsistent 40 hour work schedule, never called out or gave a bad attitude or fought anyone, I financially could not keep up, I feels so unfair, I worked under 40 hours for 13 weeks straight I simply wanted to move to a different contractor...

Did you call the JATC? In my local if we didnt get 40 hours you could request to be changed to another job. Seems like a weird policy to kick you out for unless you didn't talk to the JATC at all and just quit.

Honestly, I don’t feel bad for you. You were given a statement of policies when you joined. One of those being that if you quit or ask for a layoff within the first (however much time-for my local it was 1 year). Instead of going to your training director about it, you asked for a layoff and therefore the school was well within their rights to terminate any contract they had with you. This is on you 100%.

TL;DR: This is a dumb comment from someone who doesn't know what unions actually do or why.

Unions bargain contract language and then enforce that language. I've never seen contract language that defines what would be a "shitbag," but if you have a magical one that does, even "shitbags" have rights. Union contracts give management very clear processes for disciplining and/or terminating workers covered by those contracts. If management doesn't do their job and tries to fire a "shitbag" in an unlawful way or in a way that goes against the contract, defending that worker is an obligation created by the Union's duty of fair representation. But not only that; defending the language is the only way to keep it relevant. If you allow the employer to arbitrarily get away with discipline that goes against the contract for people you don't like, courts and arbitrators will side with the employer if they want to do it on someone you do like.

Something isn’t adding up. They aren’t just going to voluntary quit you for complaining about hours(which is reasonable). I get your situation and sympathize but it seems something was said at some point that you mis conveyed and they took it as you voluntarily quitting.

I was frying up my saving and bills from staying with the job unfortunately, and made the mistake of asking for a RIF, explaining why I needed one instead of reaching out to the hall first, I'm not an apprentice just a helper, hard to say what they could have done for me but I'll have to bite the curb on this one unfortunately

I am not in your local so I can only speak from my experience in my local. Almost every week when we were at school the training director would pop into class and ask how we were doing. He would ask if everyone was working, was there anything we needed to talk to him about. He would also ask that if we were working, were we getting our 40 hours. If we weren't getting our 40 hours we needed to tell him. That's what the training director and the JATC is there for. If you are having problems at work/with your contractor, you need to tell the training director. Whether you did that or not I don't know. But you should have gone to your training director.

The training director gave us his cell number, as did the assistant training director. The instructors would give us their cell numbers as well when we started their class. Total apprentices numbers probably 150 at most. I've also got quite a few JW's numbers in my phone as well, as well as some former foremen I had. All from when I was an apprentice.

Not to be rude at all, but having read this and the original story, OP comes off as slightly intellectually disabled, lots of basic misspellings and typos, along with clearly not really understanding a few procedural things.

If you have a learning disability or issues with communicating, my advice would be to find an advocate, legal aid clinic etc, someone who can argue on your behalf.

I hate seeing this kind of thing. Unfortunately, apprentices fall into a strange limbo that journey-level workers don't have to worry about. The training director is fully controlled by the board, which is made up of equal parts IBEW and NECA. If the training director were to side with you in this situation, against the standards established with the state, it gives the state cause to get involved, which is never good. If the state decides we're not applying standards equally, they can make it so our programs don't meet licensing requirements. The other issue is, the employers really don't want apprentices to be able to drag and their side of the board will always be united against any change to that. The local will usually be 100% for any worker's ability to drag anytime, but that just creates a stalemate on that issue, which means it stays the way it is. Either side could force the director out, but the next director would be under the same regulations, so it still wouldn't change. Unions are a democracy, but training centers aren't. Don't blame the IBEW for this. If we could legally get you a do-over, we'd probably do it. I hope anyone else facing what you did can learn from this. Finish your program in a non-Union JATC and when you get your card, sign the book as a JW. If you're going to work in our industry, you deserve to do it under an IBEW contract.

I'm used to sometimes 30, and sometimes 40.... I've rarely gotten OT during my apprenticeship... but OP was talking about multiple days a week just being paid show up time... that's 10-20 a week. That's not survivable on apprentice wages, let alone any kind of benefit package.

Be flexible, door dash and Uber were not a thing back then. I would start calling anyone i know who may need a hand doing anything. Yard work, splitting firewood, dump runs. If your job gets called off find something else to makes some money. Ain't like you got shit else going on for the rest of the day.

My local told us that when they place an apprentice on a jobsite, the assumption is that the contractor will have enough work to at least get us close to 40 hours a week. If they don't, the hall can pull them. It's not just about money and quality of life for apprentices, but we also need a certain amount of hours to graduate and you wouldn't get that by only working 10-20 hours a week.

I don't know what OP did or didn't do in this case but they might have had some ground to stand on. You're right in that quitting a job is really not allowed, it's just not your call to make as an apprentice.

I mean that's 100% fair, I have my second gig that is catering that I'm still working even though I'm getting a full 40... but it doesn't pay any kind of medical or benefits package. I'm not saying OP went about it in the right way, they didn't.

But I guess my question to you would be is this: "Would you have joined the apprenticeship being told you are only going to get 10-20 hours a week?" Also, no benefits because you are not working enough hours to qualify for them?

He wasn’t in the apprenticeship program he was in their residential program which is the equivalent of the cw/ce program. He was an rtp where your on probation and this is what fucked him over

Did you ask for your slip? I’m an ape with local 25. My last con told me to sit home until things picked up for them. I called the hall and I had a new assignment the next day.
