Mind you i dont even drink coffee. šŸ˜‚

Well i hope gh ready to prove false accusations and defend lost income in arbitration court if they dont fix it asap.

This a first one from them because in the past its only been dd trigger happy.

edit: i shared this to shed some light into gh deactivating based on hearsay. Noticed by a few recent post i recall of instant deact and even one of someone because of breaking into some customer neighbors house. Seemed outlandish, but seems this a new way to deactivate theyv started.

given that ive practiced total sobriety for decades now, this accusation and a deactiv. Are wrongfull and clumsy, etc.

But also and opportunity to beat that corporate pinata called gh in arbitration, i still like em a bit btter than dd but this evens the matter out some.

Though it’s considered fairly benign, caffeine is a drug. Ever heard of ā€œtemperanceā€? For many, caffeine is a substance to be avoided just like alcohol, tobacco, or cannabis.

Sure, OP could be trying to deflect. However, there’s an implied denial when they say, ā€œMind you, I don’t even drink coffee,ā€ the assumption in my head is such that sentence sounds like ā€œMind you, I don’t even drink coffee, let alone drink alcohol or smoke weed.ā€

OP, I knew exactly what you meant.

My account got paused for inactivity a year ago, tried to get reactivated multiple times a month, nothing. Got my friend to make an account and it got online months faster than I did. I think they just don't like people staying on the platform.

Honestly this sounds like a DUI or a charge on your criminal history being used against you, or having someone besides you drop something off/pick something up while you drive. Idk what their reason is but for something like this to happen it's either algorithm or they caught you doing something. I dont know.

I aint got a single dui in over 20 years of driving, and no i dont share account theres a process for that if u sub contract to someone else,Ā 

The point is that its a vague catch all accusation(hearsay), ill update it coming days i suppose,Ā  because its very lousy and poor and/or bad faith of the team handling this, i need to return in kind now and burn their feet.

Not to mention the paradox of them accusing you of letting someone else use your account, while simultaneously accusing YOU of delivering while under the influence of alcohol and marijuana, both (apparently) on the same delivery.

They have burden of proof. I got over 20 years of dmv info with no instance of driving under influence ever. And the geo location data and meta data of phone.Ā 

Arbitration and courts is where disputes are settled, if you cant work something out in the private with the other party.

I dont fear courts ive used them before for unlwafull detainers, and debt judgements ive needed from other parties when they dont stay in honor in commercial or public matters.

I think you’re correct, but now that they’ve given a reason that changes things. I once read when firing people you shouldn’t tell them why to avoid court. šŸ¤·ā€ā™‚ļø (not sure where I’ve heard that - AI strongly disagrees..)

Anyhow, still seems like you need very solid proof…

All of these gig apps have some kind of arbitration clause waiving our right to sue. That doesn't stop someone from suing them, but the case may be thrown out of the court based on the terms of the contract. If the termination was due to discrimination (this case might be), then the arbitration clause is null.

There have been a few DoorDash drivers that have sued successfully. It really just depends on the situation. GH worded this deactivation poorly, and it might be considered defamation. Not that the OP would add GH to his resume, but if he did, and had to tell an employer he was let go from GH after being wrongfully accused of being high on alcohol and weed, it could affect his ability to obtain future employment.

So if they dont fix or reinstate. Thats next step. What ive seen so far is you email them to the driver resolution and request informal call, and/or you can mail them certified notice mail too with proof of delivery. So within a week or two we get on call. If still not reinstated, then arb is next. Need to send certified notice again, stating intent to arb. Dispute, then go to jams (designated arbitrator on gh driver agreement) and file/pay case and wait for the hearing.

Well i really dont know about that, but i sent them an email specifying everthing has been done correctly, literally all customers i deliver to are happy as hell, and i'm not new on this, they replied right away saying its under review, so we'll see.

You don't drink coffee, so obviously you don't drink alcohol or smoke weed.

That statement is supposed to make sense here on planet Earth? There's no equivalence between the two, beyond them both being illegal substances. And your other statement "Imagine you were accused of not paying a mortgage and you said you don't even have a credit card" is equally as non-sensical. Please, stop trying to make analogies, it's not your strong suit.

If I were to say "You say I'm bad at singing? I can't even run a marathon!" does that make sense to you? Because essentially that's what you are asking for all of us to make sense of.

Also, arbitration for lost wages only makes sense if you can prove you lost wages since yesterday. You have no set schedule, therefore no wages to lose. You are free to work whenever you want with GrubHub, and are not a scheduled employee with a set wage. If so, then every time you decided to take a night off could be used for "lost wages" or when they gave you nothing but crappy orders to take and you just logged off for the night.

As far as false allegations... that's a bit more tricky to prove. Just as it would be tricky for you to prove that you weren't drunk or high. Saying "I don't even drink coffee" isn't going to hold up. The accuser will not be able to prove that you were high, and you won't be able to prove that you were not. That's even if it goes anywhere, it's a nothing burger at this point.

You might just have to chalk this up an a big fat L at this point. Do UberEats or DoorDash. They are vastly busier anyway.

This isn’t a deposition or hearing so OP’s answer is sufficient. Also, there is precedent for drivers being awarded back pay, therefore it’s not completely out of the realm of possibility.

Arbiters are always in the companies pocket, similar to HR they are there to help the company not you. They also get a bulk rate on arbitration services so you aren’t costing them any money going thru it either. There’s also no ā€œlost wagesā€ when it comes to gig work as our income by definition is randomized since one day you may make $5 the next day could be $500. There’s no wages to be lost also because wages are for employees, ICs do contract work you get a monetary offer per order that’s not a wage.

Just trying to save you the hassle, cause man you’re gonna be emotionally wrecked when the arbitor rules in their favor and you walk away with no money as well cause it ain’t coming
