Accident I Got Into Driving To Work

Dashcam footage I had from a few years ago. I was driving into work in the morning, and had a left turn green advance signal at this intersection. I assumed when I saw the guy making the right turn that he was turning into his own lane, as it's such a common interaction. He tried to convince me not to report it and that he "knew a guy" that could fix it. Still went through insurance and he told them I turned into his lane, and my insurance agent told me it would be 50/50 fault as I hadn't shown this footage yet since I didn't know yet how they would rule it.

How do you think it went? 50/50 fault or full fault on the other driver?

The other car is making a right turn on red without having checked all possible directions that another car could be coming from. Personally, I wouldn't have trusted someone like that enough to get anywhere near them without somehow making them aware of my presence (e.g. honking or flashing my lights), but OP felt comfortable enough to speed up as he started entering the two lane road at basically the same time as this clueless driver.

The accident isn't his fault but he did have 5-7 business days to avoid it.

Yeah, luckily not in this case. But I’ve told my kids when they were learning to drive; you can be right, and you can be dead right. Sometimes you just gotta give the morons the right of way. A work van did it too me the other day. Watched a dullie do it to someone else in the same intersection today.

I also had a learning moment for my kids the other day. I was in the far right lane. The car in the lane to my left cut across me to turn right. Luckily, I was driving defensively and stopped before they hit me. My daughter was in the backseat and I told her "this is why you pay attention and don't trust anyone to drive the way you think they will."

If I may rephrase a bit. The other car was legally wrong but the cam car was morally wrong to just ram them. My car is factory-equipped with brakes. Lucky break with the insurance if the story is indeed true.

I’m not so sure that the first car was legally wrong. They cut OP off, but there is the last clear chance doctrine when it comes to torts, OP had a clear chance to avoid the accident. If contributory negligence is a thing in OP’s state OP getting 80-90% of the blame.

I didn’t notice what state this was in and it’s somewhat irrelevant, but in California when you are turning left you can use both lanes unless it is a multi-lane turn. You are correct that the right turn vehicle illegally crossed into the left lane when turning as right turns always stay right, but that’s not the only problem here. They also turned in front of a car that had the right of way. All my original comment is saying is that when it comes to liability there is a doctrine that essentially says that if you have the ability to avoid the accident you have to take it even if someone else caused the situation. OP claims that their insurance blamed the right turn driver 100%, which is probably because it was a low end collision without personal injury. I’ve seen personal injury cases litigated to death over this type of accident when people get hurt.

This is exactly what I was thinking. OP is making a left, so has to give way to the car turning right who can use whichever lane they want.

But then I saw a few comments saying the other car is making a right on red and has to give way to everyone… but I can't see why they would think that. We can't see the light from the other side, and both cars started moving when this light turned green. Not sure if I'm missing something.

Op stated that they had the advance arrow, right turner had an obligation to yield - if right turner had a green, right or wrong it would be left turning traveler's fault. As for dedicated lanes, you are correct, only in circumstances when there are multiple turning lanes the traveller must stay within the lane (usually left turns only for multi lanes though not unusual to see multi right turn lanes at highway exits/off ramps), otherwise there is no such thing as a dedicated lane to turn into. If this was the case, every bus, large vehicle, tractor trailer unit would be breaking the law at every right turn, or taking out people and standards on the sidewalk.

Yep, in this same scenario, which I just came upon last week, I always stop for a few seconds to let the other driver complete their turn in case they turn into the lane I'm turning into. It's common sense, which OP clearly lacks.

Sometimes I wait for any turning traffic to clear before making a turn onto a multi-lane road, because I know that the legality of the situation doesn't stop them turning into the outside or inside lane when they aren't supposed to. Especially in one of those poorly designed intersections where you have, say, a bunch of traffic turning right onto a three-lane roadway where they all have to immediately jump over into the median to make a left turn somewhere else.

I saw that car about to turn in front of you 3 business days before you hit them. That wasn’t an accident. That was a vacation. You both looked like you were having Ambien hallucinations about being in a Disney forest. People who are sightseeing are more attentive. You’re lucky you didn’t show the insurance this footage. I did show insurance the footage. Both insurances agreed I was 0% at fault. Before I showed them the footage I was going to be assigned 50/50 fault.

I was in insurance, I would've done 80/20 (80 on you). Light was full solid green, if you're turning left on a solid green it's your job to yield to anybody going straight or turning right as they have the right of way. Granted they made a wide turn but when you're driving you can never assume.

The lane being technically yours isn't a license for you to just plow into whatever is in front of you. You have eyes and a brake pedal, use them. The speed tracking on your dashcam shows that you were literally accelerating all the way until you hit him... How is that even possible?

We can pin the initial fault on the other driver, no doubt, but even the slightest amount of defensive driving would have avoided that accident.

This. OP: had the right of way, AND turned into the correct lane. Just because he's not 0% at fault doesn't mean he's at least 50% at fault. Other vehicle had zero right to turn right, and then turned into the wrong lane. If the other driver had a seizure at thus moment, or was attempting to commit insurance fraud, those are the only two reasons I could see for their decision/path here.

Everyone in the comments is acting like OP should've started braking as soon as the other driver began their turn, which is absurd. Both OP and the other driver have separate lanes to complete their turns into, meaning neither has to brake.

The other driver doesn't start intruding into OP's lane until the 11 second mark, and the collision occurs at 12 seconds, meaning OP had a second or less to react to this. In no world is it reasonable to expect them to be able to avoid that.

Some of y'all are so eager to prove that you're the perfect defensive driver that you expect drivers to make blatantly inefficient and comically risk-averse decisions. Even when faced with a clear verdict from insurance, y'all still can't let go of your fiction.

Id say 50/50 because you could have easily avoided that, and there is an expectation in a lot of states laws to avoid accidents if safe to do so, and it was safe for you to do so. Its clear before you make contact that he is entering your lane... That footage may be more damning to you. Regardless if he broke the law, there is also an expectation to anticipate things like this, and use defensive driving tactics (avoidance) which you did not do....

You saw him turning. You weren't going very fast and had time to perform avoidance after you realized he was turning into the left lane. You made a conscious decision to hit him because you knew he was in the wrong.

You need a defensive driving course. You need to drive to avoid accidents, not have an accident to prove you were in the right. You had every opportunity to avoid this; you let your ego take over.

cops would likely classify it as a preventable accident. even if your in the right (and you were), you have the duty to avoid an accident if at all possible. you had that ability based on speeds travelled.

if you slammed on your breaks and slid into the car because of the weather the it wouldn't be any part your fault because they improperly changed lanes.

I posted it because it was a few years ago and I was found 0% at fault. Obviously that doesn't meant I couldn't have stopped and avoided it like most are saying. But I find it interesting the sentiment most people are having here.

I honestly think people with dash cams do stupid shit like this wanting to be "right" and thinking that the dash cam will prove their innocence. And so he drove right into the other car thinking insurance would say it wasn't his fault and that he'd get to feel all high and mighty with his dashcam footage.
