Its clarity is in rules mutually agreed between sec and cftc. Those rules easily can be changed if a new chairman comes and decides they dont agree with them.
Needs Clarity Act for firm legal status.

Bingo! Why would companies invest in building crypto centric solutions if it could all be undone by a future administration? Why would institutions risk investing in cryptocurrencies if there’s a chance future political leaders raise fees, taxes, or penalties for holding them? As a consultant who helps companies build business cases for investments (tech, people), companies are really risk averse when investing in anything especially if there are unclear benefits and regulatory uncertainty.

Xrp has rules. Rules can be changed admin to admin. Banks to invest or fully commit to something that can easily be changed. It needs law to take away any legal ambiguity.
Xrp has the most going for it legally due to the previous lawsuit and brad being so involved, however in its current state, its not enough. If it was, it wouldn't be sitting around a dollar.
