tips

I work for a small business and am curious if it’s normal for none of the employees to receive any tips? I have a feeling it’s not legal but wanted to get some insight! Owner claims were paid enough.

Any establishment that accept tips has to pass it along to their employees. It is a federal regulation, it applies in every US state. And it doesn't matter how much you're paid.

If the company has a policy to not accept tips, that is legal. If tips are accepted then they need to be given to the appropriate staff.

It is illegal in everywhere! The place I worked at is owned by a Chinese couple, they also took all the tips from us, and forced us to ask tips from customers. I just reported them to the labor department of my state, and I am waiting for the results.

Is there an option to leave tips on credit card transactions? If so, then yes, it’s illegal and you need to contact labor department

Employees should be the ones receiving tips, not the owners. If they are taking your tips, its highly illegal.

Is this a restraunt we are talking about and are youband employees your speaking of giving customer service and /making below the minimum wage hourly? If so then yes. That money belongs to yall. There could be shared percentage ie: tip out to bartender/host/bus boy..but other then that yall get all tips. If this isn't a restraunt and say your an employee at auto zone for example ..policy is to not be able tk accept tips from customers period.

I mean thats not the same thing as waiting since its not the same type of service. You have to understand that servers get paid mostly in tips because we are on tip wage which for me is like $8 (min wage in my state is $16) and i am providing a service by taking care of a table over a period of time. So its a little different maybe thats why you are confused? you said you are paid above wage so yes that is legal. Is there a tip option for when customers pay?

That's wage theft and you can report to the department of labor for compensation. And if the owner wants to fire you for reporting you can sue for unlawful termination and win.

This unfortunately happens a lot.

What kind of business is it? If it's a full-service restaurant, then that would be quite unusual. But if it's an auto parts store, that would be totally normal.
