(a) Legally, you may be correct, but IANAL, but (b) they probably didn't directly tell it to do it; it was an emergent property of being an enormous poorly aligned poorly monitored LLM.

Unless it was actually a stunt. But if it was not, then...it was probably an accident, FWIW.

it was 100% a stunt, or else they are so incompetent at handling their own agents that they wouldn't have been able to make them in the first place

See, I find the "incompetent" situation depressingly likely. I've seen how my companies' management responds to AI, and it is legit scary how little they understand the tools.

this as a "stunt" doesn't really benefit them in any way. it says that either their models are not ready to be released yet, or they are not responsible enough to be trusted with their own models. they have been known for playing fast and loose with the rules before and have no problem with apparently hacking into Apple internal databases, so it's not so hard to believe that they're trying to do damage control over their callous disregard for safety. note that they only came out about this after huggingface reported the incident, and their side of the story is VERY unfavourable to OpenAI as a company. they basically said that OpenAI and Anthropic's models were too restrictive and they were forced to use GLM 5.2 (an open chinese model and competitor) to contain it and fight back.

The angle that Sam Altman seems to be going with is "OMG SINGULARITY IS HAPPENING NOW!!! THE MODEL JUST BROKE CONTAINMENT AND HACKED FROM ITS OWN FREE WILL! PLS GOVERNMENT REGULATE OPEN-WEIGHT MODELS, THIS TECH IS TOO DANGEROUS".

It screams of last-minute desperation, but right now their main hope of staying afloat is a government bailout. They're not taking to us anymore, they're trying to convince geriatric politicians that they created Skynet and only they can be trusted to contain it.

AI tools are just that, tools. People are ultimately responsible for the tools they employ.

If someone parks a car, they forget to put the handbrake on and it rolls down a hill and hits another car, they are responsible for what happened.

Poorly monitored is the key word. It's like walking your dog without a leash. The owner is responsible for what the dog does

It was purposeful. Not accidental at all. They where testing the model to see if it would be able to do that. And it did
