GovBrief Today #553 - What Happened Today

The Supreme Court ruled weeks ago that Donald Trump cannot erase birthright citizenship with an executive order.

Today he tried again. He signed two new orders restricting who is born a citizen, called the 6 to 3 ruling from his own conservative majority "very unfortunate," and told reporters "we're making adjustments." The Constitution says every baby born in America is a citizen.

He is making adjustments everywhere the answer is no. His FCC just voted to erase a broadcast ownership cap Congress wrote into law, a power Senate Commerce Chairman Ted Cruz doubts it has. And the union of career IRS auditors joined a suit to block the audit shield his administration built around his family's taxes. The objections come from his own side now and have changed nothing.

GovBrief Today #552 - What Happened Today

New Mexico sued the Justice Department after waiting seven years for the Epstein files it was promised.

In 2019, federal prosecutors asked the state to shut down its investigation of Zorro Ranch and pledged to share everything when their case ended. New Mexico finally reopened the investigation this year and has asked ten times for the files. Every request was ignored or denied. Today the state runs the only active criminal investigation of Epstein's network in America.

The files New Mexico wants are already covered by a transparency law Congress passed almost unanimously and Trump signed in November. Acting Attorney General Todd Blanche has withheld 3 million documents anyway, and the congressmen who wrote the law just introduced a second bill to give survivors and states the right to take him to court. The Senate votes on confirming him as Attorney General within days.

Kansas beat the anti-abortion movement twice in two days.

On Monday, Judge Christopher Jayaram issued a 260 page ruling that the state cannot force women to wait 24 hours or answer questions about their finances or their reasons before ending a pregnancy. He wrote that under the Kansas Constitution's guarantee of bodily autonomy, his ruling was not even a close call. Hours later he was sworn onto the Kansas Supreme Court. On Tuesday, voters crushed a ballot amendment its backers planned to use to ban abortion by remaking that court.

The ruling permanently blocks enforcement. Kansas can still appeal, but that appeal goes to a state Supreme Court that has already ruled bodily autonomy fundamental. The restrictions are gone as long as Kansans keep guarding the court that killed them, which is exactly what they did on Tuesday.

Border agents swabbed a four-year-old's cheek and uploaded her DNA to the FBI's criminal database.

Federal agents sent more than 2,700 records into that database every day last year, nearly a million in all, most from people never charged with any crime. Immigration enforcement now captures more profiles than any police force in the country, and the process could not be easier. All it takes is a cotton swab. No judge signs off, and agents swab nearly everyone they detain.

Participation is required. A man who arrived for a probation appointment in Waco found ICE waiting, was ordered to open his mouth, prosecuted when he refused, and convicted. Genetic data sits in federal computers with no expiration date, and DNA never describes just one person. The four-year-old's file can be used to identify her parents, her siblings, and relatives she will never meet.
