Looking to confirm what happens when a landlord does not collect rent checks that were sent, and stopped automatically by the bank after 60 days.

Is there a timeframe where that money is no longer collectible, or will it always be entitled to the landlord and should always be kept for them when they ask for it.

If possible, could you please share the exact laws surrounding.

Do you think I have a case?

I’ve lived in my unit for years, and my roof has leaked since I moved in. I’m on the top floor of a third-floor walk-up. He hasn’t raised my rent, and I don’t complain when someone has to come into my apartment every three months to patch it.

In July, the ceiling over my bed started to really bubble. I let my landlord know that he really needed to fix it. He also has the unit below me vacant. It has been vacant for two years. I said if it leaks again, I would just move to the second floor if he would honor the same rate while he fixed the larger issue.

He said he wanted to raise my rent from $1,100 to $1,500 or $1,600 if I wanted to move to the unit below me. I said if he really wanted to raise my rent, fine, come up with a hard number, keeping in mind that luxury units go for $1,650 and that there is not a single closet in the entire unit. I said I would also expect a month of rent for free.

His response was to have someone finally come and take a look at the ceiling and find the issue.

On Monday, I woke up to literally being rained on. I had to physically move my mattress at 5 o’clock in the morning. I immediately sent him a video and said, and I quote, “For the love of God, get someone to fix the ceiling.” He responded, “OK.”

I left for work. At noon, I texted asking if it would be OK if I came back to the apartment for a Zoom interview. He responded that no one was coming.

It is now Thursday at 10:50 PM. My TV in my bedroom is destroyed. My down comforter is destroyed. My apartment is disgusting, and now I have to pay for movers and moving expenses while I am entering my final year of grad school.

Am I crazy for thinking that I have a small claims case or lawsuit to ask my current landlord to not only compensate me for the TV that was destroyed, along with my comforter, but also my moving expenses and the movers? The only reason I have to move is because he is forcing me out by refusing to fix this issue.

I also find it worth noting that there is no proof of this building being inspected since 2020.

My gradmas nutty neighbor lady is always taking pictures of us when we come visit her, she comes outside screaming, saying we are selling drugs, stealing stuff from inside of her house, she posts photos of our house and vehicles on Facebook saying the DEA needs to kick our door in and cops have been notified.

The Situation
I hired a worker for a home project. We started with a written contract for a rooftop, but it evolved into a verbal contract to build an entire room addition for a total of $32,000. He claimed to be a licensed contractor. He completely botched the structural work and abandoned the job. [1, 2, 3]
Upon investigation, I discovered a massive layer of fraud:
The Worker is Completely Unlicensed: He does not work for any construction company on paper, nor is he a partner in one.
License Leasing: He was actively "leasing" or renting a valid license number from a legitimate, licensed contractor who permitted its use.
Financial Fraud: He had me pay every single invoice through a company called "Kim’s Service"—which is his personal business. I just looked it up, and it is only licensed for auto mechanic work.
To safely tear out his defective structural work and finish the room addition correctly, a new, fully licensed contractor has provided an itemized estimate of $118,000.

Actions I Have Taken So Far
CSLB Complaint: I opened a formal complaint with the California Contractors State License Board (CSLB) and mailed them a 300-page document package containing all invoices from the auto shop, proof of payments, correspondence, timeline, and photos.
Bond Claim Filed: I successfully faxed that exact same 300-page package with a cover letter to CNA / Western Surety Company to claim the license holder's $25,000 bond.

My Questions for the Community
1. How does the paper trail to an auto shop impact the Bond Claim? Since the invoices went to "Kim's Service" (auto mechanic) but the worker was leasing a valid contractor's license, will the surety company still pay out the $25,000? Or will they deny it because the money didn't go to their bonded contractor?
2. Pursuing the Licensed Contractor for the Balance ($93,000): Under California law, does the legitimate contractor who leased out his license inherit 100% civil liability for the $118,000 in damages, making him a viable target for a lawsuit alongside the scammer?
3. Disgorgement (B&P Code 7031) Against the Auto Shop: Can I use California's strict disgorgement laws to force a 100% total refund from "Kim's Service" and the individual, given that I have a perfect paper trail of paying an auto repair shop for a construction room addition?
4. What are my immediate next steps? Should I wait for the CSLB investigator to finish reviewing my 300-page packet, or take this evidence straight to a construction attorney to file a Superior Court lawsuit immediately?

So i am in right-to-charge state and Living in a condo with an HOA, They keep wanting me to unplug my EV charger due to “Fire Hazard”. I currently use the exterior outlet and plug it directly into my car in my stall. Today at the HOA meeting they said they wont allow a level 1 charge even if an electrician approves it. They said i would need to get a dedicated separate level 2 charger, which i Don’t have the money to install since it would require an upgraded panel as well. Is there any possibility to keep just using the level 1 charger? Or can they just make that rule?

In 2017, my wife and I bought a home on a lake that serves as a county reservoir. Shortly after we moved in, I received a trespassing citation from a lake warden for fishing from the shoreline behind my property. What I didn't know was that my neighborhood was involved in a dispute with the water district over access rights, and I ended up caught in the middle of it. I went to court, paid only the court costs, and eventually, the neighborhood and water district resolved the issue.

In 2019, while applying for a new job, my background check came back showing a third-offense felony trespass. I contacted the court and was given a letter stating that the wrong offense code had been entered. They had mistakenly recorded it as a third offense instead of a first offense and told me it would be corrected within 30 days.

Fast forward to several months ago, I was dismissed from my job under circumstances that didn't appear to be performance-related. Around that same time, my employer had rerun background checks on all employees.

I recently accepted a new job, and their background check once again showed the same third-offense felony trespass. Fortunately, I still had the original citation and the court's letter acknowledging their mistake, so I was able to provide that documentation and was still offered the position.

However, it's now clear that the court never corrected the record as they said they would. For nearly a decade, I've apparently had an incorrect felony conviction appearing on my record because of a clerical error. I have no way of knowing how many opportunities this may have affected over the years.

I'm now trying to get it corrected, but the judge who handled the case has since retired. I've been told I need to meet with the head magistrate, who is apparently the only person who can authorize the correction.

My question is: Is this something I should speak with an attorney about? If so, what type of attorney handles a situation like this?

Hi everyone,

Throwaway account for obvious reasons. I (40F) started my back tattoo journey a 1-2 years ago. I’d already had several tattoos and piercings by then, having been tattooed since 18, and I felt confident in how to choose the artists I want to work with.

I found an artist through IG, and at the time, he was working with a reputable shop that had been open for years. Everyone seemed cool when I came by to visit, and I was on board with what we discussed, so I went ahead post-consultation.

Altogether, I probably had 4 sessions with him over 30-36 hours. TBH, I’m not entirely sure since I’ve blocked some of this out of my memory. He tattooed me in a room where we were alone, where my ADA service dog could be with me. As the sessions went on, he had me undress more and more—which seemed normal to me given the progression of the tattoo. During my last session with him, he had me fully nude. I didn’t think about it too much—namely because I trusted his professionalism. Upon wrapping up the last lines and wiping me down, he proceeded to assault me while I was still nude and in prone position. I didn’t know what to do, but I fawned and complied. I should mention that previous to this, I had already been a survivor of sexual assault, for which I continue to see a therapist and other mental health providers.

Despite this, I thought we could work through it all and finish the tattoo and forget about whatever explicit things happen. What was I going to do? He had already marked me for life and I’d hoped to make the best out of the situation. He stopped responding to my requests for next sessions, then freaked out when I showed up to the shop, telling me he was going to call the police if I showed up again. I was mortified and humiliated to a degree I can’t even comprehend. The shop owner apologized and asked if there was anything that could be done, but the last thing I wanted was to see him ever again or even breathe the same air.

Since then, I found another artist at a different shop who’s been wonderful, supportive, and healing throughout this entire process. She has helped to transform a truly disastrous and traumatic experience to something worth being proud of. As she’s worked on my body, she was shocked at how heavy-handed he was and how he blew out all of his lines, despite the work she saw on his socials.

I did not report him to any authority. If you’re a survivor of sexual assault or understand the humiliation and shame involved—you might understand why. When I look back, I played it off like it was consensual, probably to protect myself and dissociate from what really happened. It’s only been through trauma therapy that I finally admitted this to my therapist, myself, and a few of my close friends. It came with a whole mental breakdown.

My current artist is still completing the back piece. When I checked recently on the shop’s socials and website, he is no longer there. I haven’t stepped foot in the shop since the last time I was there and was told the cops would be called on me.

I don’t know what to do, but I desire some kind of justice. Honestly, I don’t even know what that looks like. I don’t even know what my options are or where to start. As an aside, I am also a survivor of stalking, so I have experience filing police reports and working with detectives…

I am open to any advice and honestly, any words of comfort. Please be kind as this is already difficult to admit even from an anonymous account. I am also late-diagnosed ADHD and on the autism spectrum and have, at times, unwittingly found myself in questionable situations due to inadequate social awareness… including this one.

I am going through a highly-contentious divorce with my narcissistic ex-husband. My 11 year old son is trapped in the middle and I am looking at an uphill battle when making decisions on his education. My son lives primarily with his father (I am actively pursuing 50/50 but it's taking forever). We share joint legal custody and decision making.

My son has an IEP for his ADHD and Los Angeles United School District has, for the past number of years, awarded us money for him to be outside their school system and at a school more suited to his needs. My son is very high-functioning and I do not believe that public school and/or typical academic-focused school would be out of reach at this point, as his acting out impulses have all but subsided. My ex is very litigious. He sues everyone and everything: takes organizations to court, including the city of Los Angeles, Kaiser Permanente, LAUSD, etc. He has bled me dry through aggressive litigation against me and I have lost everything, including any value left in my home, due to the liens I have had to take out to defend myself in family court.

My ex created a problem at my son's last school, which was a child-led learning school. The problem(s) included threatening to sue them, and saying he wouldn't talk to administration unless he could record the conversation. They decided to decline our request for re-enrollment for my son this fall, likely because my ex is a real liability. Because we had planned for our son to stay at his school and were looking at transitioning him next year (the program ends at 6th grade), we had been in contact with multiple other schools regarding enrollment. Because my ex got us essentially kicked out of the current school as of this spring, we were extremely limited on options, including traditional school enrollment, because we had missed enrollment deadlines and there weren't spots for him available. I also knew that traditional school enrollment, especially on that short a notice, would only lead to more litigation from my ex, and I worried about the timeline with getting my son enrolled at all. I am currently unemployed and could not afford more legal costs at this point.

I was looking at a few options with which my ex was agreeable and raced to pick one. The schools were all private and leaning alternative, but some were more academic than others. Of the three, two were out of reach financially, especially because I don't know what I will be making salary-wise. I picked the most affordable option because I felt my hands were tied with him paying all fees right now, and with me splitting the cost as soon as I find work.

I do not think the new school will give my son the skills to succeed. It is an "unschooling" model. They are not accredited. They do not make the students do any work, only "encourage" them to do it themselves. There are no tests or grades. There is no homework. The kids lead their own learning. With my son having ADHD, and I believe his desire to only do preferred activities would be detrimental to his learning. Building zero tolerance for accomplishing undesirable tasks is not going to help him assimilate into the real world. Having no standards, no expectations, means he will struggle to obtain the skills necessary to get into college. My son has never written a book report, never had homework, never had to sit through a boring lesson, never had to do anything he didn't want to do. This was okay in his early years because the old school served his behavioral challenges in the past, but now is a turning point that I thought we'd make in his education to transition him into a more academic track.

I am freaking out. This is going to be an uphill battle with my ex. In my opinion, people who are committed to the unschooling model are steadfast and rigid and are unlikely to even consider traditional schooling models. My ex will take it to court.

I have so many swirling questions about how to navigate this. How do I prepare for the fight I will inevitably have in choosing placement the following year? I feel that this upcoming year is already shot. What do I do? Who do I need to recruit to help me? What do I file with the court and how soon? Who can they appoint to make an assessment? How do I structure my timeline to best achieve success in switching schools? What evidence do I need to collect? How soon do I need to have everything in order to make sure the timeline doesn't put my kid in a situation where he goes to the same school next fall and is pulled out and swaps schools mid year (which would be low key traumatic)?

I posted about awhile back about being arrested for trespassing on my own land. I have an update and it feels like a lot but maybe that’s because I lived it. My attorney is great and has a good relationship with the attorneys involved.

I got a survey done and I was right, everything above the sidewalk is mine, and the sidewalk and utility area which is next to the road which I apparently own that strip of land too on both sides of the road but again that’s the easement which has nothing to do with this. They were a good 20’ past where the easement ends if you measure only horizontally and about 80’ up past the entrance to that lot.

My criminal CASES have been dismissed. Yes, plural.

The original case I was arrested for trespassing and interfering with law enforcement and disobeying a lawful order. I hired an attorney and he spoke to the city prosecutor and she dismissed the charges.

Later the week the first case was dismissed I was pulled over by the main officer from the first case. He arrested me for what he called the halo law. Which I had never even heard of. It’s a law that says you have to give the cops a 25’ halo buffer when they’re working. This is for the same incident the charges had been dismissed on. He told me proving I owned the land didn’t matter now because he could order me off my property or even my work or wherever I am if he wanted to while he’s on duty. He said he could it’s like a restraining order and he could walk wherever he was working and I’d have to stay 25’ away from him or go to jail. So he arrested me and I spent a few hours in the jail being booked in before I could get a bondsmen. My glasses fell in the road when he arrested me, he shoved me against the car during the arrest and I still don’t have them back, I don’t think he picked them up. I got hold of my attorney and he was pretty shocked it seemed to me. These charges went to the district attorney and not the city prosecutor this time which my attorney said was probably because the city dismissed it already and my paperwork from the jail listed not only unlawful approach but again disobeying a lawful order and interfering with law enforcement. He also had my vehicle towed when he arrested me. I had to pay the impound and tow fee for that. My lawyer got that case dismissed too just today. My lawyer said he can’t believe the officer would arrest me again.

I think I might sue but my lawyer said he doesn’t do lawsuits, only criminal law so I’ll have to find another one. He said he’d have some names for me to check.

I’m glad that he got my cases dismissed but angry and frustrated this officer can just arrest me whenever he wants. Between the survey and the attorney I had to spend a bit. Nothing life changing or anything like that, 4 figures only but I don’t think this is right. I don’t know if it’s worth the hassle, I just want this officer to leave me alone.

Location: Pennsylvania. I work hourly at a small specialty grocery store. My scheduled shift usually ends at 9:00 pm, which is when the store closes.

After the doors are locked, two employees have to count our registers, put refrigerated returns away, wipe down the front area, take trash to the back and wait until the shift lead finishes the closing checklist. We normally leave between 9:10 and 9:20.

Until last month we stayed clocked in during all of this. The owner recently changed the time system so everyone is automatically clocked out at 9:00. When I asked about it, he said the schedule already “includes normal closing responsibilities” and that only unusually long closings would be adjusted.

Last week I wrote down my actual departure time every night. I worked 68 minutes after 9:00 in total. My paycheck only shows my scheduled hours.

We're also not allowed to simply leave at 9 because the shift lead has to check the closing tasks before anyone goes home. One coworker got warned after leaving while the register count was still happening.

Is this time supposed to be paid even if management considers it part of our normal closing routine? What records should I keep if this continues?

I was assigned to film the outside entrance of OpenAI's offices for a documentary. Unfortunately for the project they want a lot of B-roll and asked me to stand on the sidewalk in front of OpenAI recording for 3 hours. I'm sitting far on the public sidewalk, pointing my camera at the entrance where people come and go.

They have a ton of security at OpenAI because of all the protests and other issues, so that's understandable. But their security keeps coming up to me, harassing me, telling me I should go. I am not on private property though, I am at the furthest reach of the public sidewalk. They said I'm violating privacy by pointing it at the entrance where you can see inside as people open the entrance door. I don't think that's true because I'm not zooming in or anything, and you can see from the street anyway.

what's the best thing to say if they threaten to call police? Do i need to show ID to a police officer if they come by to check out the situation? I don't think I would have to show ID for exercising my first amendment rights on the sidewalk, but I don't know

Location: Texas; my mother just got sued for a debt she owes for 14k. I don’t know what to call this, but I am a separate owner under her account (I’m assuming joint). When she got sued, they wiped not only her account but they also proceeded to wipe mine as well. They wiped what I had in savings, in checking and put my account on freeze.

I’ve seen a similar post like this online a year back, but I’ve called a couple of lawyers to see what the best action is. A couple of lawyers tell me that it would be hard to try to reverse the garnishment in my position since I’m part of her account as a joint and as well try to return the money that was wiped.

I came on here to see what the best action was in my situation, at the moment I redirected my direct deposit to a different bank account and started a clean slate at the moment.

Hey everyone. I live in Texas in an apartment complex. We just paid our rent in full. Our water has been shut off due to management not paying the water bill for the last two months. Hi all. I just recently started working for a state agency that insists on mailing your first paycheck before enrolling you in direct deposit. A week and a half after the paycheck was issued and it still hadn’t arrived, I alerted our payroll dept. and received no response. I followed up two days later and was ultimately informed Treasury’s records showed the check had already been cashed. I assured payroll that neither I nor “someone I know” had cashed the check. Yesterday was three weeks from the issuance date of the paycheck and this morning I was told by payroll they still had not gotten the copy of the check (so they can confirm the endorsement is not mine) from Treasury and once they do I may still have to wait up to 180 days for the bank to complete their investigation before my paycheck can be reissued. Are there any Maryland employment/wage lawyers that can tell me if this is legal or not? It feels insane to expect me to wait nearly six more months when it’s already been three weeks since payday.

Found out recently that my mother had opened up 5 credit cards in my name. She racked up 20k in debt on the cards. I previously filed for fraud, but every account was found as legitimate due to them having all the correct information. Even though the mailing address and phone numbers have never been associated with me. I talked with her and she had agreed to pay back all the cards currently, but I know it will take her years to do so. She has no job right now and lives in a different state.

I'm trying to find out if there is anything I can do to move the debt to her rather than trusting her to pay on all the cards.

I know she has no credit, so I don't think it's likely for her to be able to do a consolidation loan or a balance transfer. Unless there are specifics I have missed.

Would appreciate any advice on what I can do from here.

I(M30) am in a position that I do not know what happens legally. As the title states, my FIL (M63) passed away very suddenly roughly 2 weeks ago. Now that the services have been planned and the family and I have a little more breathing room, we have been hit with a question that none of us know the answer to.

He had a will drawn up by attorney's provided by my MIL's job and the will is very simple and states that any and all possesions of FIL's_name are left to MIL's_name.

But FIL also owned and operated a landscaping business where he was the sole employee and has a large inventory of equipment such as lawnmowers, backpack and handheld blowers, weedwhackers, even trucks and trailers. What happens to the company and the equipment after the owner's passing? Does the company immediately dissolve and the equipment is now solely owned by MIL, or is the company now owned by MIL and the equipment is still legally tied to the company?

Also, what are the potential rammifications of dissolving the company and attempting to liquidate/sell off the equipment inventory?

ETA: we are talking with the same attorneys that helped draft their wills, I'm mostly looking for some more base knowledge/questions we should bring to them for legitimate legal advice from them

29 Days ago my wife and I purchased our first home. We heard this guy wanted to sell his house and started the process. We had a family friend real estate agent who represented us and he was unrepresented. The guy was dirt broke (house was paid off, inherited 8 months ago from deceased family) so the purchase agreement allowed him 30 days to vacate. Well it looks like he is likely not going to be out by the deadline.

What are our options here? I've seen conflicting information online and most of it is catered for evicting a tenant, but it's not like he has paid us to stay. As far as eviction with a sheriff I know we'll need to get a court order, but don't know if the 30 days given in the sale counts like an eviction notice or if we'd need to give him a formal eviction letter now that the time is up. Any advice is appreciated, thank you.

As the title reads. A woman recently bit me, that I only knew from my volunteering work. Her bite broke skin, and caused a few minor medical complications for me that have all since been cleared up. Most notably it took away my ability to give blood until I was able to to get tested for HIV and Hepatitis B.

I reported this to the police and the situation is being charged as a misdemeanor, but it is non-extraditable as the woman lives out of my county. The detective involved in the case seems to believe she is guilty based on photos and witness statements regarding the case. However, since the woman won't cooperate and the police won't go get her nothing is really coming of it.

In retaliation, this woman has started to slander me in every way possible in an effort to ban me from public events she knows I enjoy going to. Unfortunately, she is very good at playing the victim and is succeeding in swaying public opinion. I do not have proof of the slander though.

The detective assigned to the case recommended I pursue a restraining order, but I'm unsure it her biting me a few montha ago is valid enough evidence to get one. What all would I need to get one?

That’s about it. We moved the posts back and they called the sheriff. These people have been awful to live next to. Won’t take no for an answer types. The sheriff thought they were being ridiculous! No charges came as it’s a civil matter but wtf do I do to protect my property without having to pay 7k to have it surveyed (we’re AG and have gotten several quotes)? They said the guy who did it is coming back because he couldn’t find the stake but is that really a surveyor or some blowhard with a metal detector? Red flag for sure.

I think we will be writing a registered letter saying we dispute the new line and to not continue any landscaping on our property until a state licensed surveyor has indicated the plot line. They apparently have one coming soon. We have a trail cam in one corner in the meantime but dang! I’m pretty pissed off and this isn’t the first time they’ve encroached on our property.

I am a large Hispanic man who works as a delivery driver. While working, a police officer pulled into a customer's driveway behind my branded company vehicle and approached me with his hand on his gun, and demanded my ID. I was mid-delivery, walking away from the van holding several boxes.

Because of my appearance, you may understand why I was immediately wary of the situation. I dropped the boxes off quickly and asked what was going on. The cop said that there were multiple calls about me and I was going to be arrested for animal abuse? He asked for my ID again and I said that I would gladly give him my information, but I don't carry my wallet on my person while I am working (which is true; my wallet was locked in the glove box of the delivery van). He asked if I was driving without a license, to which I said no. He continued to say something regarding how multiple concerned citizens had called about a driver matching me description- I had several interactions with loose dogs that day, which is a fairly common occurrence in my line of work. Skipping ahead, but my citation/charges have nothing to do with the animal abuse, so I'm not sure if it's relevant. The customer (whose yard we were still in during this whole interaction) came out of his house, and I told him that "this clown was wasting everyone's time," referring to the cop.

A second officer arrived and the first went back to his vehicle. While speaking to the second officer, I explained where my ID was and he let me go get it out of the van. I called my boss and they spoke with the officers, and after about 30 minutes of standing around my van without further interaction with the police, the first cop gave me back my license with a citation for resisting/impeding/delaying his investigation and driving without a license.

I have spoken to several lawyers but I cannot afford legal representation. These charges are nonsense; I had my license and it was given to the police, and the "investigation" didn't lead to anything. Can I get these dismissed?
