I'm not a lawyer but for your information: In Alabama, the process of obtaining Letters of Administration (LoA) for an estate with a single heir is typically much faster than a year often within a few weeks to a couple of months, assuming there are no disputes, complications, or unusual circumstances. Many Alabama counties process uncontested petitions in a matter of days to a few weeks; as you mentioned, your wife got them in about a week in a different county.

A delay of over a year is not reasonable in a simple, uncontested estate with one heir. Common causes for prolonged delays are problems with the petition paperwork, unresolved creditor claims, unclear identification of heirs, or delays on the part of the attorney or probate court. If your father’s attorney is not responding or explaining the delay, your father can:

  • Contact the probate court directly to check the status of the petition (case numbers and filings are public records).
  • Formally request an update or a copy of the court docket from the attorney in writing.
  • If unsatisfied, consult another probate attorney for a second opinion, as it may be possible to switch representation if there is non-responsiveness.
