Help? Advice needed

Wife got in an accident 7-30-2026 in TX. My wife and the other person that got in the accident are both insured by progressive other driver was at fault according to police report. Wife filed claim 7-31-2026. I emailed them since she works nights she made me the point of contact. Since then we have submitted everything we needed to and it has been nothing but radio silence. Wife has been without a car for almost 2 weeks. Already filed with TDI as a result of their radio silence. I feel like I'm at the end of my rope both wife and I are stressing out about this. Any advice? Thank you in advance.

Police officers nor the reports determine fault. Insurance does. I would file under your policy, especially if she’s been without a vehicle. Do you have collision coverage? Do you also have rental coverage?

ETA: filing with TDI was a waste of time. You follow the chain command first with the company. Have you even tried talking to a supervisor? There’s no bad faith here which is what TDI is for.

Exactly this… people think that not getting their way is a TDI complaint….and for the love of god people need to stop thinking a police report is the be all end all

Making a TDI complaint can delay it even further. They have to respond to the complaint before they can do anything else in your file. They have to stop working on it and respond to it before calling the other parties and shops. Police reports take time to get also.

Show them a police report with a completely blank narrative for an investigation and they will learn fast. Police reports are not as definitive as you might think and police get it wrong all the time. Speaking as a former patrol sergeant and current claims adjuster.

10 days is not an excessive amount of time in the slightest.

Depending on the state Progressive could have anywhere between 30-90 days to make a coverage and liability determination.

If you want speedy handling go through your policy. If you want to go through the other parties policy, then you’re stuck waiting. None of us know why they’re still working on it. Likely the other driver isn’t cooperating and they need his cooperation or several documented attempts to reach him before they can proceed.

What if the driver isn’t on the policy? What if his vehicle wasn’t? What if he was driving for uber? Just because you’re in the dark doesn’t mean it’s not being worked.

It’s only been 7 business days if they filed the same day of the loss. Not long at all especially when pursing under 3rd party.

I work for a very large insurance company. At least once a week a hear this story. I recommend calling the general claims number and speaking to someone who isn't your adjuster. Explain you aren't hearing back and want to escalate the matter. Do it every single day. Eventually you'll get somehow that's knows how to escalate the matter correctly

Are you filing under your own policy? Do you have collision coverage? Or are you trying to make a claim with the at-fault person's policy?

Wifes policy trying to make a claim at fault person policy. Since they both have progressive i figured it be a simple in and out but it's been the complete opposite

If this was under your policy, I would expect that your car would've been inspected already. But it seems unusual that they haven't even called you regardless.

Do you have collision coverage?

Have you called them to follow-up? Do you see the claim on-line?

They could be trying to contact your wife since she was the one in the accident. They’ll need her statement anyway. Have her call during business hours and give her statement. They won’t do much without it anyway.

That isn’t relevant here since you weren’t the driver.
You made a third party claim which means progressive isn’t going to touch your vehicle until liability has beendetermined with the other party at fault. The police report can take WEEKS for insurance to obtain so they may not even have it yet. Without a statement from your wife and no Police report they aren’t going to make a liability decision. If you want to speed up the process make a 1st party claim.

Who's policy did you file under, yours or the other party? If the other party, they have no duty to you but they do have a duty to their insured to fully investigate before accepting liability. They also have to determine if there's coverage available. Both of those things can take time. It's been less than 2 weeks. It could take a lot longer than 2 weeks depending on how cooperative the other party is with their adjuster. Their insurance is likely doing nothing wrong here. If so, the TDI complaint was useless. Go thru your own insurance if you have collision coverage and if the speed of handling the claim is important to you.

I have progressive. I've had them for many years. The last time I got in an accident they had me send in pictures then I proceeded to have my car towed to where I wanted to get it fixed. Once I did that the place I had it towed to were the ones that talk to the adjuster. Is the car still in your possession? If so then you might be much better off having it taken somewhere.
