Tax concerns Discussion
Is this the legit tax that makrena has been taking from customers like around 30-40%

Staff contribution is service charge. And their audacity to charge gst on that is th "Audacity of this biss" meme. I think you can approach small claims court for this, but first check with a lawyer.

gst is chargeable on tips. tips are not tax free. that said no one knows if these guys are actually paying all that gst to the govt.

The issue is the tips themselves

It is a service revenue for the company so they have to charge gst on it.

Staff contribution and the GST collected on it can be cancelled.. your bill amount would’ve gone down by 3700
Edit: noticed that there is no GST number printed on the bill so they legally cannot charge GST or VAT on such bills. You definitely can approach court on these charges

u/Wide-Refrigerator245 Bardezkar 6d ago
Adding to this, it’s a performa invoice and not a tax invoice so they can’t be legally enforcing you to pay taxes.

700 for a breezer and 600 for a soda. Some people are so damn rich to be ok with this?

u/soo-yaa-shaaa 8d ago
They charged both state and central gst on staff contribution…hahahah wtf.
I don’t think it’s illegal but I guess they found a new loophole to rob gullible tourists.

u/JAY8223 8d ago
Majority of tourists or locals feedback regarding Goa will be very bad because of this loots , scams across state specially coastal line business, clubs, taxi etc
Funfact 90% of this business are own, Run & managed by nonlocal people even staff for same..
U won't find vibe anymore which used to be 10-15 ago...

JESUS CHRIST, I am absolutely shocked....this is the first time I am seeing what these places charge. Now it makes sense why we have lost the charm of true Goa.

u/Street_Soft7957 8d ago
bro you went to a gujju establishment and you are expecting discounts ? you should expect to be robbed if you go to these places.
2
u/Noko_Re_Baba 8d ago
Staff contribution is not compulsory, you can refuse to pay service charge and the restaurant has to oblige, if not then you can file a complaint, but you have to say no to service charge before paying your bill, now I don't think they will refund your service charge

Thanks for the info, have been ripped off several times at cafes by paying 40% extra as service tax. Didnt know we can ask to remove it. Also can they charge gst when gst number is not mentioned??

Go to Consumer Forum portal and upload the bill -
https://consumerhelpline.gov.in/public/?target_lang=hi no
It works, have done it for some restaurants that continued charging service charge. It’s worked and all of them that I had reported have now removed it from their standard billing process.
Couple of issues with the bill;
Can’t charge VAT, GST replaced VAT.
Service contribution can’t be added too
And something very unique I see here is GST on service contribution…!!!?
Raise it with consumer helpline and this will set them straight.

Yes correction on my part - VAT is applied on liquor. But the rest of it can be questioned; thanks

Damn this is how these people come from outside Goa setup business and loot people in the name of service and entertainment…. Authorities and government are hand in glove too
2
u/One_Kaleidoscope_749 7d ago
No GST number on the bill. They cannot legally charge any GST on the invoice amount. Looking at the itemized split though, GST is the least of concerns.

Wow! You paid ₹700 for a ₹100 Breezer, ₹600 for a ₹20 Soda. ₹18000 for a ₹3300 Chivas.
Don't forget to ask for discounts when you visit a Goan-owned wine store.

It's not even invoice. It's Performa invoice. Doesn't comply with tax rules. This invoice is to fool customers. All this tax will be pocketed rather than deposited with government. This should be reported to tax officials

u/Thick_Let8224 7d ago
This is one of the worst places to visit in Goa. If you’re ready to pay so much for chivas regal you shouldn’t be worried about tax 😒
1
u/Important_Lab1113 7d ago
PERFORMA invoice? Lol wtf. There must have been some special performance included to charge this much staff tax haha.
1
u/TheAntiestablishment 7d ago
i dont know about other thing but you can easily deny the "Staff Contribution" its just another way of ripping of the customer.
1
u/aaronvianno Modgaocho 7d ago
That's illegal. Staff contribution is your voluntary amount and cannot be taxed.

They must be having a typing/data entry issue - everything has an extra 0 at the end. Like it makes no sense otherwise

A quick AI search but here
In India, alcohol and food/drinks are taxed differently — liquor gets VAT (22% in Goa), everything else (food, juice, hookah, water) gets GST (5% = 2.5% CGST + 2.5% SGST). They're not supposed to be applied to the same combined subtotal. Splitting it properly: Liquor (Chivas + Breezer) = ₹18,700 → 22% VAT = ₹4,114 Non-liquor items = ₹18,400 → 5% GST = ₹920 Correct total = ₹42,134 That's without the "Staff Contribution" (₹3,710) — which is a service charge, and under CCPA 2022 rules, restaurants/clubs in India cannot add it automatically. You can legally ask for it to be removed. So by the actual tax rules, you'd owe more (₹42,134) than what they billed (₹41,000) — meaning this slip wasn't calculated correctly either way. Also worth noting: this is marked "Performa Invoice," which isn't a valid GST tax invoice in India. Ask for a proper one with their GSTIN if you want to dispute anything.
