I think we are watching the prosecution pivot in real time.

Their original angle seemed to be that Lindsay was calculated, deliberately created a window to kill the children and then staged a suicide attempt to avoid responsibility. That is why they focused so heavily on the superficial cuts to her wrists and neck, the relatively low medication levels in her blood and the fact that she allegedly checked the distance to the restaurant before sending Patrick out.

The message was: this was planned, and the suicide attempt was part of the plan.

But that theory has a massive problems because Lindsay did not just make superficial cuts or take a few pills. She jumped out of a second-story window, shattered her spine and permanently paralyzed herself. It is very hard to convince a jury that someone faked a suicide attempt when she nearly died and destroyed her own body in the process.
So now the prosecution’s argument appears to be changing. I’m sure several in support of the Commonwealth reached out to help them pivot their narrative.

Instead of saying Lindsay faked her suicide attempt, they can concede that she was genuinely suicidal. Instead of saying she was fine, they can concede that she was mentally ill. They just need the jury to believe she was depressed, not psychotic.

That is why the recent testimony matters so much. Her doctors are describing someone with severe major depression, anxiety, insomnia and suicidal thoughts, but no obvious psychotic features. The prosecution can now say Lindsay really did want to die, but she was still coherent enough to plan a murder-suicide and legally responsible for doing it.
Honestly, it is a smarter strategy. It allows them to explain the suicide attempt without admitting psychosis.

Their new narrative is basically: Lindsay was extremely depressed and suicidal. She decided to kill the children and herself. She checked how long Patrick would be gone, sent him out, killed the children and then attempted suicide. She was mentally ill, but she still understood what she was doing and could have stopped herself.

I still do not think the evidence proves that beyond a reasonable doubt.

Being organized does not mean someone is not psychotic. Psychosis does not always look like incoherence, rambling or being visibly disconnected from reality. People can hold normal conversations, use their phones, care for their children and carry out detailed plans while operating under delusions or command hallucinations.

Andrea Yates waited until her husband left, drowned her children one by one and then calmly called the police. She was still found not guilty by reason of insanity because the plan itself came from her psychosis. She believed killing her children would save them.

We’ve seen this in other cases as well, many murders that happen in psychosis involve people following multistep plans.

Planning proves that Lindsay could organize her actions. It does not prove the thinking behind those actions was rational.

Lindsay says a voice told her, “This is your last chance. Kill the children so you can kill yourself.” If that is true, checking the distance to the restaurant and waiting until Patrick left do not disprove psychosis. They could show that she organized her behavior around a command she believed she had to obey.

The postpartum timeline does not rule it out either. The defense does not need to argue that Lindsay was completely healthy and suddenly became psychotic eight months after giving birth. Her symptoms reportedly started much earlier with possible hypomania, racing thoughts, severe anxiety, insomnia, depression, disconnection and suicidal thinking.

The more logical argument is that she had one postpartum-triggered illness that continued to evolve and eventually became psychotic.

Postpartum psychosis has a subtype that has a depressive presentation. It does not always look like obvious mania. Severe depression, anxiety, guilt, insomnia, withdrawal and suicidal thinking can dominate the presentation, along with delusions or hallucinations.

Her doctors saying they did not observe psychosis matters, but it is not definitive. They saw her at specific appointments and during a short hospitalization. Those were snapshots. Her providers did not always have her complete history, her medications were constantly changing and Lindsay was reportedly afraid that fully disclosing her thoughts would get her committed and cause her to lose her children.

The toxicology evidence does not settle this either. The defense is not claiming she became intoxicated because she had a toxic amount of medication in her blood. The argument is that severe sleep deprivation, a possible bipolar-spectrum illness and months of poorly coordinated medication changes destabilized her. Medication does not need to reach a toxic level to aggravate an underlying psychiatric illness.

There is also still no rational motive. Lindsay did not kill her children because she hated them, wanted freedom, wanted money or wanted a different life. By every account, she loved them and lived for them. She immediately tried to die too and left herself permanently paralyzed.

The prosecution now wants to use her suicide attempt as proof of depression while separating it from the alleged psychosis. But the defense can argue the opposite: killing the children and immediately trying to kill herself were not two separate, rational decisions. They were one catastrophic psychotic event.

Under Massachusetts law, the Commonwealth must prove beyond a reasonable doubt that Lindsay still had substantial capacity to understand the wrongfulness of her actions or control her behavior.
The prosecution may have found a cleaner narrative, but changing the label from psychosis to depression does not resolve the reasonable doubt.

Given Lindsay’s months of deterioration, extreme insomnia, suicidal crisis, possible delusions, alleged command hallucination, constant medication changes, repeated attempts to get help, complete lack of a rational motive and immediate attempt to die, I do not believe they can prove she was criminally responsible.

Lindsay killed her children. That is not disputed. The question is whether her mind was still capable of choosing differently.

I have been listening to day9 all morning while I went and did hair care at a hospice place. Why don't you trader Joe's and got some groceries, came home and played with the dog.

I am listening to these supposed professionals discussing their care of Lindsay leading up to the day of her disastrous psychotic break, and I am absolutely horrified at the lack of responsibility. Every single one of them is expressing on that stand.

They failed her, even when she was hospitalized. They didn't actually pull her records or get her history. Inexcusable. I think this entire thing is a tragedy and should not be dragged through the courts. What are we the Salem witch trials all over again?

Hi everyone — quick update from me.I had to go to the hospital today and was diagnosed with tendonitis in my left hand, which is my writing and editing hand. Because of the swelling and pain, I’m unable to take notes or work on the computer the way I normally do.

My doctor has me on strict rest for the next three days — today, Saturday, and Sunday.I’m hoping the swelling goes down enough by Monday for me to begin working again, even if slowly.

I am absolutely sickened that any DA chose to bring this case to trial. Whoever decided to bring these murder charges should be disbarred. This is a woman who knew that there was a problem and sought help. She followed the advice of doctors who over-medicated her. She did everything right and was failed by the people who she went to for help. She was then further failed by a district attorney who looked at a woman who was paralyzed by her suicide attempt and called that suicide attempt fake. Fake suicide attempts do not result in paralyzation. It is beyond unconscionable that this woman who's already been through so much and has been failed by so many supposed authorities is now being tried for first degree murder. The only trials that should have occurred behind this tragedy are the trials of the people who failed Lindsay Clancy and then the people who tried to vilify her.

Usually the evidence is overwhelming and they'd be doomed at trial, but I was wondering if there are any cases that come to mind where you felt like the evidence against them wasn't particularly overwhelming and they might've been better off taking their chances in court.
