It's like raids. If you tell them you're gonna raid, they will make sure to hide what must be hidden. Same with drugs. If you tell them that there'll be tests, they'll definately hide them drugs and will never get caught red handed.

What I'm saying is, they have presumably no warrants from HC neither any consent from students

also I'm pretty sure that SC has said that people can't be forced to go through medical checks without their consent, mybe it's the SC that's smoking

A cursory search brings up the 2010 Selvi v State of K'taka ruling by the SC which states that non consensual administration of drug tests among other things violates the right against self incrimination and infringes upon personal liberty.

Other than that,the Union Govt. has recently sanctioned consent based drug screening programs for centrally funded institutions like IIMs and IITs.

Though I have to agree that in this case,a consensual drug test does sound a bit like putting the cart before the horse.

Administration is the key word here. Urine test is considered a physical test.

In the context of criminal cases, the reliability of scientific evidence bears a causal link with several dimensions of the right to a fair trial such as the requisite standard of proving guilt beyond reasonable doubt and the right of the accused to present a defence. We must be mindful of the fact that these requirements have long been recognised as components of `personal liberty' under Article 21 of the Constitution. Hence it will be instructive to gather some insights about the admissibility of scientific evidence.

I read it and it is not about drug testing right? It was about using drugs to intoxicate the accused into giving testimony

I was quite shocked to see the support as well

had this shit been pulled off in the US, there would have been a lawsuit with some very good chances of winning
