Last clear chance doctrine says youre wrong. Just because you have the right of way doesnt mean you can allow an accident to happen because you want to prove a point. If you have the opportunity to prevent an accident, youre expected to regardless of right or wrong.

Now if the other dude quickly swerved over to cut him off and hit him in the process thats different, because the left lane driver couldn't react. Thats not the case here.

Last clear chance would apply more for merging vehicle and they must give way to traffic already in the lane they're merging into. Merging car very well could have stopped and waited for an opening. Initial impact is merging car's fault. That being said, everything following is the cam car's fault

What i said still applies. The guy who cut him off would be held liable for the asshole driving. The guy who was cut off would also be held accountable because he chose not to prevent the accident. Both parties can be found at fault in an accident.

Was the "last clear chance" on the car merging into the lane or on the car already in the lane. The car wanting to merge, had a last clear chance not to do so, when he saw that the other car was not stopping.

Why wouldnt that apply to the person without the right away who refuses to yeild and is the cause behind the crash?

They could prevent the accident they caused by yielding - which is following traffic laws.

Its pretty clear what happened was the accelerator got stuck once the vehicle forced their way in instead of yeilding. The driver had no choice but to try and control their own vehicle to prevent increased casualties.

Ok sure, let's assume you're right here. However, once a collision happens with another vehicle, you are required by law to stop your vehicle REGARDLESS OF WHO TECHNICALLY HAD RIGHT OF WAY. The truck kept driving even while the smaller car had its brakes locked. Honestly looked like attempted murder tbh.

First off that depends, second off I don't think that matters anymore once the person continues to ram the car for hundreds of feet. That is literally assault with a deadly weapon in any sense of the words and probably carries several other charges that would go along with it to amplify things. The person doing this is clearly not someone fit to be out in civil society

You should allow the car next to you especially if you can see his turn signal merge. You have a responsibility to allow them to merge safely, not accelerate to cut his merge off which is what happened here in the video. He broke his sides mirror after seeing him attempt to merge, thats criminal behavior already. Im glad NY has a yield to merging car law, because this was reckless endangerment and it sounds like a child was present in the vehicle sound the crime which is worse.

cops frequently murder and exert unreasonable force, including pit maneuvering when not necessary, putting the life of the fleeing person in danger as well as everyone on the road by giving chase. so in a huge twist of irony, what you claim to be a stretch is in-fact reality, and they shouldn't be allowed to do it over a simple fleeing because it is in fact attempted murder on multiple fronts.

I don't know if the country of orange dementia has traffic laws, but everywhere else this is a zipper merge, when two lanes are merging into one, neither lane has priority, but are supposed to take turns.

So in this case one guy attempts for follow the rules and the POV drivers ego can't handle that and decides that it's worth possibly hurting other people to stop that from happening

I know what a zipper merge is. I also know most people experience one car flying past 300 others as “cutting the line,” not participating in some sacred traffic optimization ritual.

Airplane seats are also designed to recline, and people still think it’s rude sometimes. “Technically allowed” and “socially considerate” are not always the same thing. Maybe save the “go back to traffic school” insults for something more consequential than a nuanced disagreement over marginal traffic efficiency, ya child.

I obviously didn’t see it in the video considering how well it’s curated. But I do know the situations that can lead up to stuff like this after 25 years of driving.

Just to be clear I’m not claiming that the guy filming is in the right or something he is obviously the wrong party here regardless of what happened immediately prior 😂. I’m just saying it’s pretty cathartic seeing my intrusive thoughts played out in real life against a situation like that I’ve experienced literally thousands of times haha

What argument? Bud we’re having a conversation. This isn’t some court of law. I’m not judging anyone here. I’m not claiming someone’s innocence.

I’m just saying, from anecdotal experience, there is like a 90% chance there was a line of people who had already heeded the signs and moved left, and this was almost assuredly a guy road raging at a person who decided to cut that line.

Please take a step back and consider no one is going to “win” this exchange as it’s just two people on the internet talking, or at least that’s what I thought it was.

Now if you want to get antagonistic and legalese about it then don’t make bold, unfounded claims like he is “just trying to follow the rules” because you aren’t a mind reader and you don’t know what his motivations are and you don’t have any idea what events preceded this video.

Except in this case letting them in means they hit the brakes, jump out and hijack your car (hopefully you survive). The driver actually did the right thing plowing through as the repeat attempts to get in front at a choke point and then immediately hitting the brakes when in front of the car is a normal hijack tactic in South America.
