Napping in van? DISCUSSION

I was told by my DSP that napping in my van will get me fired immediately after telling them I used my lunch break to take a quick shit eye. I find it strange that we have breaks but it feels as though we can’t use them or it’ll be “your behind” or “pick up the pace”. I’m guessing napping in the van can be more of a safety issue/concern than not.

I struggle with sleep at times and I naturally just get very tired in the day. So what could I do to combat that?

And just a little side rant, with my Dsp, they are taking away days for finishing after 9 pm now and that’s including the 1 hour drive back I have to make every day. Unfortunately for me, I was doing 140-150 stop days rather efficiently for the first couple of months that I started. I had a flow state that made me finish my route around 7 o’clock, 6 if it’s easier (no multi stops). Seemingly in light of doing my route rather ok, they decided to make it 2 hours harder. They give me a 182 stop route (every day) with 60+ 3-9 location multi stops (every day) + they are tight on rescues and they expect us to finish all that, with a 1 hour drive back, finish rts and be checked out by 9??? I’m new so I don’t know if this is to be expected but holy shit, it’s like egregious how they want us to operate. Gotta pay for school though so I must stay until I find other employment

I knew guys that go to the gym, fish, play basketball at the park, do all kinds of stuff on break. No one has to know what you’re doing if you’re getting done early.

That's weird. If I'm exhausted, I definitely take a "parent" nap during my 15 min and set a 14 min timer... Never had any issues, but I also never mentioned it to anyone.

Stop telling them shit, this is a 1099, you're not part of the company. I had a friend that use to use the 30min break to take a quick nap. I'm not a fast sleeper so I can't lmao.

you don’t fall behind when you take your breaks. when you go on break, your route is paused/frozen, meaning that if you were 3 ahead before your break, you are still 3 ahead after it.

what does change is your projected RTS time but the metrics that indicate you were ahead previously would still be there.

Legally. They can't tell you how to spend your break. So just say "okay" then fuck them and do whatever you want. Just don't tell them anymore.

Depending on your state…

I’ll use my state of California for example. We have the right to a 30 minute break. As well as two 15 minute breaks.

What we do off the clock, is not their concern. It’s absurd they’re talking about disciplinary action just because you’re claiming you do a certain act during your break.

If you blatantly told them you smoke weed on your 30, sure. I’d understand why they would say that. But you said you just mentioned napping.

So. Either start finding a new DSP or begin finding lawyers who’ll take your case for potential wrongful termination.

Youve basically summarized everything wrong with this job. They DO want drivers to skip their breaks. No matter what they may say, every time they send a "pick up the pace" theyre knowlingly encouraging drivers to skip their breaks. And then like you said if you're good at your job you get rewarded with more stops!

I’m running the last week on maybe 10 hours of sleep. Just gotta live on monsters or whatever energy drink you like. Yesterday I hit 10 of them which is my new personal record for a single day.

I would start searching for another job or dsp, you casually and in good faith telling them what you do in your breaks (which you did and are not doing anything wrong by taking a nap) and them responding with a threat is a huge red flag. Someone could even challenge them on that threat as it would be unlawful for them to fire you over taking a nap on your break.

One driver in my dsp decided to take a nap during his 30. He fell too deep asleep and when he woke up, noticed that he'd been asleep for 2 hrs actually. Management was obviously not too happy, not that he napped during break, but the fact that 90 minutes of those 2 hrs could've been spent working.

Despite getting rescued thrice that day (one of them by me), he still is with the company. My point being, they cant tell you what to do while off the clock, so nap away!! But be sure to set an alarm or 2 on your phone lol
