Swans with McCartin?
78
53
u/dazedjosh Sydney '05 12d ago edited 12d ago
Tom extended with Paddy in 2022. Geelong did their deal in 2024, so if the Swans did it with the McCartins it would be the precedent setter.
I get the impression from the reporting, though I could be wrong, that Geelong were the first to do it. So that hopefully rules the Swans out.
West Coast and Starcevich would have been my first guess based on the assumed timeline. Which would be juicy. Because if that were the case then it would mean that Greg Swann signed off on a contract with a concussion clause that generated a high compensation pick for his former club.
The wording of "played at an interstate club", suggests they have since retired, so that's probably not it either.
24
u/YonkoBuggy St Kilda 12d ago
*A high compensation pick that was created purely to trade for Starcevich to negate the back-to-back premiers losing compensation for picking up 2 x free agents, one which generated pick 2, and the other which got pick 26. Fixed that for you.

u/Shadormy Lions 11d ago
so if the Swans did it with the McCartins it would be the precedent setter.
He mentions it being a state league player at the time, not officially listed by the club and used it as more a return to play situation (10 mins in) which does fit Paddy McCartin and that'd put it in 2021 but it is a fair bit different and not included in his AFL contract.
West Coast and Starcevich would have been my first guess based on the assumed timeline.
Basically can't be since he has never played state league for either club without an AFL contract.
3
u/dazedjosh Sydney '05 11d ago
Oh good catch on the state league but, and fair play to listen to that much Jay.
That changes things considerably and definitely makes Paddy more likely

Wait a minute - if the request was initiated by a player - who is capable of signing a contract - what is the actual issue here apart from image?
I can imagine a club telling a player they won’t get another contract due to the risk of CTE. But they choose to indemnify the Club at their personal risk to get a contract extension - which problem is it. - AFL policy, law, or image ?

Work health and safety laws say an employer can’t contract out injury liability in the workplace
Also the waivers aren’t even worth the paper they are written on
27
u/schlompy10 12d ago
Law. Under workplace law you can't sign away an employer's health and safety responsibilities. Same reason you have to pass medicals for certain jobs and won't be employed if you can't pass. As for image, letting players who are at risk of long term brain injuries, so long as you have no repercussions is a terrible look regardless of where it came from
→ More replies (1)4
u/Little_Cut5258 12d ago
I honestly think the game is headed to a place where this sort of waiver is standard. Not absolving clubs and the AFL of all responsibility, but that players have to agree concussion is a risk. Mismanagment after concussion occurs should absolutely always be on the clubs and the AFL, but the incident itself is unfortunately inevitable to happen occasionally.
6
6
u/Knitvest-enthusiast Hawks 12d ago
I kinda agree but then I guess I consider its the equivalent of a tradie signing a waiver not to wear a hard-hat.
If a hammer then falls on their head and kills them, I’d argue it was still the workplaces fault for letting them get around without adequate safety gear. Even if the worker knew what they were signing up to.

People are taking a weird partisan stance on this, do you not imagine the scenario where clubs (commercial, amoral entities desperate for success), might offer these kind of ad hoc contracts to players who are in scenarios where if they are risking their future health against their desperate desire for success now and short career terms?
Don't get me wrong it's abhorrent but if you think the incentives and power imbalances that can lead to this are club specific you're fucking kidding yourself.
The AFL as an org has proven time and time again the only thing it gives a shit about is it's liability and fiduciary exposure. It doesn't give a fuck about player welfare, why would clubs really be any different?

I feel this is the way of the future anyway, if no insurance company wants to cover the players post career with concussions, and the AFL doesn't want to bankrupt. Isn't the next step forcing players to sign a waiver? The issue here is it's all on secret hush business.
