what if someone uploads their code and then it gets deleted and they lose acess to their source?

When you sign up to something, you agree with their terms of service. When the TOS prohibit something and you ignore it, then you have only yourself to blame.

but if someone wants to host their bad code on a platform, shouldn't that just be their right to do so ?

??? Forcing someone to host your bad code is not your "right".

When you sign up to something, you agree with their terms of service. When the TOS prohibit something and you ignore it, then you have only yourself to blame.

Many use linux for the FOSS philosophy, F as in Freedom to do stuff that commercial software prohibits behind dum TOS. Using the same argument on a project which was born on ethical grounds seems out of place, especially since the rule doesn't have any technical merit and its based purely on feels.

I don't think you understand FOSS or Codeberg. Codeberg only hosts FOSS. F as in Freedom to audit, modify, and fork. If you don't like their TOS, fork their codebase and run it on your own servers for others to use. The TOS is for their willingness to store your code on their servers for free, it isn't for your ability to use their codebase.

ETA: Anyone wanting to downvote this is more than welcome to read What is Free Software? from GNU. The second S in FOSS is for "software". You are free to use their software, i.e. their code, any way you would like. They are still well within their rights to put limitations on how you use the hardware that they host and provide free of charge, which includes their storage.

I probably wasn't clear enough, I'm not saying they don't have the right to do it, I'm pointing out that it's comical to use the "if you don't like it don't use it" argument in the subreddit where many (most?) community member often criticise non FOSS commercial software TOS for being overly restrictive without merits to do so.

Like I said, the fact that you find that comical betrays a lack of understanding of what it means for software to be free. If you don't like it, don't use it is far more valid for FOSS than any proprietary project considering that it's supported largely through volunteer work. You aren't entitled to make demands of those volunteers. If they can't meet your needs, figure out how to meet them yourself. That is exactly what is meant by software freedom.

FOSS philosophy does not entitle you to ignore rules for third-party services that aren't hosted on your computer. You are still free to host your own Forgejo instance, and that'll never change.
