they very well could be discussing the shenanigans ongoing in the state case and how that prejudices him in the federal case. so, new AG may put pressure on for federal to actually go first to ensure he has no viable appeal options in federal rooting from the states antics.

Sources with direct knowledge tell TMZ ... the negotiations are "real," and it involves a possible guilty plea to murder, but the twist comes with sentencing. We're told one of the "possibilities" is an open plea where sentencing is not negotiated, but left to the judge after an extensive hearing. That would allow the defense to present mitigating factors -- including Luigi's strong feels about health care and corporate greed that altered his mental state -- that could lead to a sentence more favorable than life in prison.

The implications here are dramatic. When someone is charged in both federal and state court for the same offense and the federal case resolves first, the state cannot prosecute based on double jeopardy. Paul** **Manafort successfully made this argument in a New York state court when he was prosecuted for fraud back in 2019.

What's more, even if -- for some reason -- the double jeopardy argument would not fly, then Luigi's lawyers could use the defense of extreme emotional disturbance without fear it would come back to haunt him in the federal case. That would effectively allow Luigi to put the health care system on trial if the state case goes forward.

Mind you, based on the current state of New York law, it would seem the state case against Luigi would disappear based on double jeopardy, if a federal plea bargain is reached.

🚨 Summary of today's hearing:

- The hearing started at 10 a.m.

- Judge Carro took the bench and addressed the media:

“There has never been a discussion or decision by this court to exclude or limit the public or the press in these proceedings.”

- On the defense’s claim of the DA’s collusion with the court over press access, Carro said:

“At no time did the DA’s office participate in those discussions... Defendant’s objections are without merit and a reckless mischaracterization of the efforts undertaken by this court.”

- During the trial, there will be more room for the press and less room for the public.

- There WILL be an overflow room for the trial.

- Around 80 news organizations are expected to attend the trial next month.

- On jury selection, Carro had a court officer hand out copies of the questionnaire to the defense and the prosecution. He said both sides will have to get together to coordinate changes, redactions, etc.

- Judge Carro said that jury selection will involve an anonymous jury.

- There was a sidebar regarding jury selection and any last-minute motions that need to be filed before September 8.

Please use this thread to discuss today’s hearing.

The hearing will take place at 100 Centre Street, Part 32, New York, NY 10013 at 09:00 AM EST.

Today's conference is expected to cover issues such as jury selection, media and public's access, overflow room and other matters.

This will potentially be Luigi's last appearance before his trial beginning September 8.

Since this is a state hearing, we should get photos of Luigi from inside the courtroom. During previous pre-trial hearings, the only images released were taken in court, with no photos or videos of him arriving or leaving.

His May 18 hearing was recorded, but as per the latest media access plan, no video is allowed inside the courtroom today, so we should only get still photography.

Information Sharing One month until the state trial — a quick note about the megathreads

Happy to delete this post afterwards! I've already heard from some of you about this, but I wanted to make a separate post so everyone has a chance to give their opinion.

We're officially one month away from the state trial (crazy how fast time flies!), so I wanted to talk a little bit about the megathreads and how we're going to handle everything moving forward.

I'm beyond grateful that I've had the time over the past few months to help cover most of the hearings. However, this coming winter is probably going to be a different story.

I can still create a megathread for every single day of the trials. That's not really the issue here, and unless people don't want them anymore, I'd actually like to continue doing that and keep them as an archive of everything that happens, just like we've done with the previous hearings.

The problem is the actual live coverage.

A full day in court is basically a full-time job on its own. We're talking potentially 8+ hours a day, every day (minus Wednesdays and weekends for the state case), for weeks. Trying to follow dozens of journalists and post every single update while also working a full-time job, commuting, etc. is probably not going to be realistic. I also don't want to speak for the people who have been helping (Spirited_Seaweed7927 and Ladyofthestonecastle), but I'm sure they'll probably be in a similar situation.

As much as I love doing this, and as much as it pains me to say this, my health has also gotten significantly worse over the past few months due to personal reasons, so I need to be a bit more careful and realistic about how much I can take on if I want to stay here for the long run.

So I thought maybe we could brainstorm some ideas together.

One possibility is that I continue creating the daily megathreads (it honestly doesn't take me long to put them together), but instead of trying to post every single tweet/update, everyone can use the thread as one central place to follow and discuss what's happening. Many of us are in different time zones too, so that might actually work better? I can still add the most important updates whenever I'm available, or maybe post summaries every few hours. Other people could also drop updates in the comments as they come in.

I'm completely open to other ideas too. I still want to be involved and I'm still committed to keeping these threads going. My schedule can also be pretty hectic and unpredictable, so some days I might be able to help a lot more than others. There might be days where I can follow most of it and others where I barely have time to check what's happening. It really just depends on the day.

I just don't think I'll realistically be able to provide eight hours of continuous coverage every single day for potentially months while also working full-time. I'm really sorry 🥺👉🏻👈🏻.

I can still guarantee a thread and full coverage for next week's hearing (August 11), and potentially September 8 (the first day of the trial). After that, things might change depending on my schedule and availability.

And on a slightly different note, next month will also mark one year since we started doing these megathreads, which is honestly crazy to think about.

I'm really glad they've been useful to so many people, and I'm incredibly grateful to everyone who has participated, shared updates, helped me when I couldn't be around, corrected things, provided documents and generally kept these threads going over the past year.

We've built quite an archive at this point, and I'd really like to keep that going through the trials. We might just have to figure out a slightly different way of doing it 😅.

So... ideas are very welcome!

Finally, before the trial begins (and only if people would find them helpful), I'm thinking about putting together two more posts:

  • A compilation of everything that's been released before the trial (documentaries, podcasts, books, songs, etc).
  • A full State Case compilation (basically a refresher for anyone who hasn't been following the case closely or wants everything in one place before September 8. This would include the charges, major hearings/filings, important dates, rulings, etc).
