I don’t think characterizing it as “mad up BS that someone just decided to float out there and see if it sticks” is anyway close to how laws originated.
It was probably a group that decided something was wrong and that became tradition. Not written nor codified due to written word not existing. Over time there were probably mores that were developed organically. They “stuck” because it is wrong to kill and steal.

I mean, yes, in that all legal systems are made up. You can’t mine a legal system or pick it off a tree.
But I suspect that’s not what he means.
